Resolution No. 06- J '1. \ : Authorizing the City Manager to negotiate and execute an Agreement
between the Cities of Cupertino and San Jose for the Overlay of Stem Avenue between Stevens
Creek Boulevard and Approximately 340 Linear Feet South of Stevens Creek Boulevard.
BACKGROUND
One of the street segments included in the City's 2006 Annual Overlay project is that segment of
Stem Avenue that extends from Stevens Creek Boulevard south to Loree Avenue. A portion of
this street segment, the eastern half of Stem Avenue from Stevens Creek Boulevard to
approximately 340 feet south of Stevens Creek Boulevard, is in the City of San Jose (see attached
map). The Annual Overlay project includes the San Jose portion because it will be more cost
effective to overlay the entire segment of Stem Avenue at one time. Staff has arranged for
reimbursement for the cost of overlaying the San Jose portion of Stem Avenue through an
agreement with the City of San Jose.
FISCAL IMPACT
Authorizing the City Manager to negotiate and execute the Agreement for the overlay of Stem
Avenue will allow the City to recover the cost of overlaying the San Jose portion of Stem Avenue.
That cost is estimated at approximately $16,000.00.
STAFF RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 06-1.3:1: Authorizing the City
Manager to negotiate and execute an Agreement between the Cities of Cupertino and San Jose for
the Overlay of Stem Avenue between Stevens Creek Boulevard and Approximately 340 Linear
Feet South of Stevens Creek Boulevard.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN
AGREEMENT BETWEEN THE CITIES OF CUPERTINO AND SAN JOSE FOR THE
OVERLAY OF STERN AVENUE BETWEEN STEVENS CREEK BOULEVARD
AND APPROXIMA TEL Y 340 LINEAR FEET SOUTH OF STEVENS CREEK
BOULEVARD
WHEREAS, the City of Cupertino is proceeding with an Annual Overlay project
that includes the pavement overlay of Stern A venue between Stevens Creek Boulevard
and Loree Avenue; and
WHEREAS, a portion of the aforementioned segment of Stem A venue is within
the City of San Jose; and
WHEREAS, both the City of Cupertino and the City of San Jose have determined
that it will be mutually beneficial for the aforementioned segment of Stern A venue,
including the portion within the City of San Jose, to be included in Cupertino's Annual
Overlay project, and for the City of San Jose to reimburse the City of Cupertino for the
work done by the project within the Cit of San Jose; and
WHEREAS, the cities of Cupertino and San Jose propose to facilitate said
reimbursement through execution of an agreement between the parties,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino hereby authorizes the City Manager to negotiate and execute said agreement
between the cities of Cupertino and San Jose, a copy of which is attached hereto and
made a part hereof, and take all necessary associated actions on behalf of the City of
Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 20th day of June 2006, by the following vote:
