Dear Brian:
This letter is a follow up to the Action Letter clated July 22, 2010. The plans sets included in the
letter did not include the revised Site Plan (Sh��et A1) and Privacy Planting Plan (Sheet A8).
The revised Site Plan indicates a change in tr.e location of the driveway in order to reduce the
amount of paving within the front yard and tc� move the edge of the drive away from the North
side property line by 20 feet. Additionally, a six foot high fence along the North side property
line, behind the existing retaining wall, shall ��e provided. No other changes were made to the
Site Plan.
The Privacy Protection Plan has been amendec. to include five (5) 15 gallon Sporum Eugenoides
trees, four (4) 24-inch box Podocarpus Gacilio r trees, and two (2) 24-inch box Camphor trees
along the North property line.
The file has been updated with the correct approved plans and they are attached to this follow
up notice. T'his does not change the date of th � original approval.

1. APPROVED PROTECT
This approval is based on a plan set E�ntitled, "New Two Story House at 10231 Amelia
Court Cupertino, CA 95014, Lot 3; ' c onsisting of eight sheets dated April, 2010, with
revisions on July 14, 2010 to the Site Plan and elevations, and the color and material
sheet, except as may be amended by cc�nditions in this resolution.
2. PRIVACY PLANTING
The final privacy-planting plan sha] 1 be reviewed and approved by the Planning
Division prior to issuance of building permits. If an existing tree(s) is used for privacy
screening, a letter from a certified arbc►rist shall be submitted confirming that the tree(s)
is in good condition and is appropriatE for privacy protection in any season.
3. PRIVACY PROTECTION COVENANr
The property owner shall record a co�-enant on this property to inform future property
owners of the privacy protection mea:;ures and tree protection requirements, consistent
with the R-1 Ordinance, for all windc�ws with views into neighboring yards and a sill
height that is 5 feet or less from the second story finished floor. The precise language
will be subject to approval by the I)irector of Community Development. Proof of
recordation must be submitted to thf � Community Development Department prior to
final occupancy of the residence.
4. PRIVACY TREES
Four 24" box Podocarpus Gracilior t� ees, five 15 gallon Sporum Eugenoides trees, and
two 24" box Camphor trees shall be planted along the North property line as delineated
on the Privacy Protection Planting Plan submitted by the applicant in accordance with
request of the adjacent neighbor locat�d at 22250 Varian Way.
5. CONSULTATION WITH OTHER DEI'ARTMENTS
The applicant is responsible to consu lt with other departments and/ or agencies with
regard to the proposed project for additional conditions and requirements. Any

misrepresentation of any submitted d� ta may invalidate an approval by the Community
Development Departxnent.
6. EXTERIOR BUILDING MATERIALS/'I'REATMENTS
Final building exterior treatment plar (including but not limited to details on exterior
color, material, architectural treatmen :s and/ or embellishments) shall be reviewed and
approved by the Director of CommL nity Development prior to issuance of building
permits. The final building exterior plan shall closely resemble the details shown on the
original approved plans. Any exterior changes determined to be substantial by the
Director of Community Development shall require a minor modification approval with
neighborhood input.
7. WATER EFFICIENT LANDSCAPE OI.DINANCE
The applicant shall be required to comply with the requirements of the City's Landscape
Ordinance (Chapter 14.15 of the Cup��rtino Municipal Code) to reduce water waste in
landscaping and for irrigation efficier.cy, which includes requirements for a landscape
maintenance agreement.
8. HOUSING MITIGATION FEE
The applicant shall be required to ��ay a housing mitigation fee in the amount of
$2.67/square foot for each new home (inclusive of garage) to be constructed as part of
TM-2010-03 prior to final map, or as determined by the Director of Community
Development.
9. CONSTRUCTION MANAGEMENT PLAN
A Construction Management plan sh� ll be prepared by the applicant and approved by
the Community Development Depariment prior to issuance of building permits. The
construction management plan shall a�idress, but not be limited to:
➢ The staging, unloading, or parkin; of construction equipment or vehicles shall not
obstruct or otherwise make unsafe any public right-of-way.
➢ Delineate tree protection measur �s for the preservation of existing trees on the
property.
➢ Conformance with construction t►est management practices as prescribed by the
Public Works Department of the C.ty of Cupertino.
10. FINAL MAP REQUIREMENTS
Prior to issuance of any building perxrdt, the following shall be completed in accordance
with TM-2010-03:
a. The Final Map creating this pa��cel shall be approved by the City and recorded.
b. All existing structures on the p roperty shall be demolished.
c. The applicant shall record ea;;ements on the property in accordance with the
conditions of approval of TM-2010-03 for reciprocal ingress/egress easements,
private roadway access, public access, and maintenance of the easements and
associated improvements.
11. NOTICE OF FEES, DEDICATIONS, R:?SERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval sE t forth herein may include certain fees, dedication
requirements, reservation requiremen ts, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Con�iitions constitute written notice of a statement of
the amount of such fees, and a desci iption of the dedications, reservations, and other

exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), h� s begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on July 22, 2011.
The adjacent neighbor at 22250 Varian Way had concerns regarding trees and a fence along the
North property line. In addition, the same r eighbor had concerns with the original proposed
location of the driveway. The driveway lc cation was revised on the plans as well as the
requested trees and fencing (see attached letters).
Staff has made all the findings that are required for approval of a Two-story Residential Permit
as required by the of Cupertino's Municipal C:ode, Chapter 19.28.100 (D). Also, please note that
an appeal of this decision can be made withi n 14 calendar days from the date of this letter. If
this happens, you will be notified of a pu� lic hearing, which will be scheduled before the
Planning Comxnission.
