SUBJECT: Minor Residential Permit Action ]:etter - Application RM-2010-11:
This letter confirms the decision of the Direct�r of Community Development, given on August
18, 2010, approving a Minor Residential PE rmit to allow a single story addition along an
existing non-conforming 5' side yard setback, located at 7566 Kirwin Lane, with the following
conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitlE d, "The Chen Residence, 7566 Kirwin Lane,
Cupertino, CA 95014;" consisting of nine sheets, dated July 19, 2010, except as may be
amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult witl other departments and/or agencies with regard
to the proposed project for additional concLitions and requirements. Any misrepresentation
of any submitted data may invalidate an a�proval by the Community Development
Department.
3. EXTERIOR BUILDING MATERIALS/TRF ATMENTS
Final building exterior treatment plan (inc: uding but not limited to details on exterior color,
material, architectural treatments and/or E�mbellishments) shall be reviewed and approved
by the Director of Community Developme nt prior to issuance of building permits. The final
building exterior plan shall closely resemb le the details shown on the original approved
plans. Any exterior changes determined t� � be substantial by the Director of Community
Development shall require a minor modifi�ation approval with neighborhood input.
4. SIDE YARD SETBACK COVENANT
Prior to final occupancy, the property o��ner shall record a covenant on this property to
inform any future property owner that thf� existing five-foot setback along the east property
line is the conforming side. Any future aclditions along the west side of the house must be
setback at least 10 feet from the side pr�>perty line. No further extensions along existing
nonconforming building lines are permittE�d for the life of the house.
5. PLAN SET REVISIONS
Final architectural drawings shall be subr�utted to the City for review and approval prior to
issuance of building permits. The plan re�isions shall address the following:
a) The lot size is incorrectly listed at 8,125 sq. ft., when it should be 6,562. Update and
make the appropriate changes to tr e floor area ratio and lot coverage calculations.
b) Provide a floor area diagram show: ng where floor area was counted.
c) Add a note on the site plan that the existing driveway will be removed and re-
landscaped and the existing curb c� zt will be closed up with a new curb, gutter, and
sidewalk per the City's standard dE�tails. Another note should state that the new
driveway and curb cut will be inst� lled according to the City's standard details.
d) Show the width of the driveway an d curb cut. The new driveway and curb cut shall
be installed according to the City's standard details.
e) An encroachment permit through the Public Works Department is required for items
(c) and (d).
f) Show the side setback measuremer t to the new addition.
g) Show the 20' wide building setback. easement, which begins at the front property
line.
h) Show the 10' wide public service e� sement, which begins at the rear property line;
then show the 5' wide wire clearan :e easement, which begins 10' in from the rear
property line.
i) Show the areas that will be re-land:;caped and provide its square footage on the site
plan.
j) Show the species of the plants/trees proposed to be planted.
k) Show the building envelope on the front elevation view by drawing 10' high vertical
lines on the side property lines, then draw another line inward 25 degrees from the
10' mark. The building cannot encr �ach out of this area.
1) On the front elevation, the stone wi ll either need to be continued across the new
addition, or the contrasting color rr ust be deleted. Staff recommends that the stone
be continued.
6. NOTICE OF FEES, DEDICATIONS, RESE RVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, aiid other exactions. Pursuant to Government
Code Section 66020(d) (1), these Condition� constitute written notice of a statement of the
amount of such fees, and a description of t ze dedications, reservations, and other exactions.
You are hereby further notified that the 90 -day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to iile a protest within this 90-day period complying
with all of the requirements of Section 660:'.0, you will be legally barred from later
challenging such exactions.
Please be aware that if this permit is not used � vithin one year, it shall expire on August 18,
2011.
Staff has made all of the findings that are required for approval of a Minor Residential Permit as
required by the of Cupertino's Municipal Cod��, Chapter 19.28.090 (B). Also, please note that an
. appeal of this decision can be made within 1�E calendar days from the date of this letter. If
this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.
