SUBJECT: RESIDENTIAL DESIGN REVIEW �.CTION LETTER - Application R-2010-05:
This letter confirms the decision of the Directc�r of Community Development, given on August 24,
2010; approving the construction of a new ��,327 square foot, two-story single family residence
located at Lot 80, Santa Paula Avenue, with th� following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entit .ed, "A new Single-family Residence for: Paramount
Homes, APN 357-04-80, Lot 80 Santa P� ula Ave, Cupertino, CA 95014" consisting of nine
sheets labeled A0, A1, A1a, A2, A3, A4a, ��4b, A5 and A6 dated Apri11, 2010; a materials plan
labeled A7 and plans entitled Landscape Plan, Irrigation Plan and a Details and Notes plan
labeled L-1, L-2 and L-3; except as may be amended by conditions in this resolution.
2. PRIVACY PLANTING
The final privacy-planting plan shall be reviewed and approved by the Planning Division
prior to issuance of building permits. If existing tree(s) is used for privacy screening, a letter
from a certified arborist shall be submitted confirming that the tree(s) is in good condition and
is appropriate privacy protection in any s,�ason.
3. MODIFICATION OF PROPOSED PRIVA(:Y PLANTING PLAN
Prior to issuance of building permits, the applicant shall modify the proposed privacy
protection plan by replacing the proposE d Pinus Helipensis along the easterly property line
shared between the subject property and he property at 10385 Mira Vista Ave with one of the
following:
a. Carolina Laurel
b. Photinia
c. Podocarpus
d. Pittosporum
The new shrub shall be recorded as a�rivacy protection plant. The existing Wild Cherry
(Prunus Spp 9") and the Coast Live Oak (��uercus Agrifolia 9") located along that property line
shall also be retained and recorded as pri� acy protection trees.
4. PRIVACY PROTECTION COVENANT
The property owner shall record a covena 1t on this property to inform future property owners
of the privacy protection measures and t�ee protection requirements, consistent with the R-1
Ordinance, for all windows with views int o neighboring yards and a sill height that is 5 feet or
less from the second story finished floor. The precise language will be subject to approval by
the Director of Community Developmer t. Proof of recordation must be submitted to the
Community Development Department prior to final occupancy of the residence.
5. CONSULTATION WITH OTHER DEPAR'TMENTS
The applicant is responsible to consult wiih other departments and/or agencies with regard to
the proposed project for additional cond .tions and requirements. Any misrepresentation of
any submitted data may invalidate an app roval by the Community Development Department.
6. EXTERIOR BUILDING MATERIALSf TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color,
material, architectural treatments and/ or �mbellishments) shall be reviewed and approved by
the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resemti�le the details shown on the original approved plans.
Any exterior changes determined to be sut►stantial by the Director of Community Development
shall require a minor modification approv�il with neighborhood input.
7. LANDSCAPE INSTALLATION REPORT
The applicant shall provide an installat.on report from a certified landscape professional
verifying that the landscape has been in� talled in accordance with the approved Landscape
Plan, prior to final occupancy. The certiiied landscape professional shall make the required
finding identified in the Landscape Ordin� nce and incorporate it into the report.
8. LANDSCAPE MAINTENANCE AGREEMENT
Prior to final inspections and final occu� ancy, the owner(s) of the property shall enter into a
formal written landscape maintenance a greement with the City. The Agreement shall be
recorded against the subject property, wit 1 the County of Santa Clara Recorder's Office and it
shall be binding on all subsequent owners of land served by the proposed landscape.
The landscape maintenance agreement shall require that the installed landscape not be
modified and that maintenance activities r�ot alter the level of water efficiency of the landscape
from its original design, unless approve d by the City prior to the commencement of the
proposed modification or maintenance activity.
9. NOTICE OF FEES, DEDICATIONS, RESEI:VATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Governxnent Code
Section 66020(d) (1), these Conditions con:;titute written notice of a statement of the amount of
such fees, and a description of the dedic ations, reservations, and other exactions. You are
hereby further notified that the 90-day a� proval period in which you may protest these fees,
dedications, reservations, and other exacti �ns, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest v��ithin this 90-day period complying with all of the
requirements of Section 66020, you will be legally barred from later challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on August 24, 2011.
Staff has made all the findings that are required for approval of a Two-story Residential Permit as
required by the of Cupertino's Municipal Ccde, Chapter 19.28.100 (D). Also, please note that an
appeal of this decision can be made within �4 calendar days from the date of this letter. If this
happens, you will be notified of a public hearing, which will be scheduled before the Planning
Commission.

PLANTING NOTES
GENERAL NOTES: The Landscape Conhactor shall inspect the site and be familiaz with all existing site conditions prior to submitting liis bid.
Contractor shall not willfully proceed with construction as shown when it is obvious that obstrvctions, la�idscape area a�id/or grade differences
exist that may not have bern known during design. such conditions shali immediately be brought to die attention of the Landscape Arcl�itect. The
contractor shall assume full responsibility for all necessary revisious due to failure to give such notification. Conhactor sliall be responsible for
making himself familiar with all underground utilities, pipes, structures and obstructions. Contractor shall take sole responsibility for all costs
incurrcd due to damage and/or replacement of these items. Contractor shall be responsible for coordination between tredes and subcontractors as
required to accomplish la�idscape operations. The Landscape Contractor shall be responsible for any damage to existing facilities caused by or
during the perFormance of his work. All rcpaits shall be made at no cost to the Owner. Planting shall be installed in confonnance with all
applicable local codes and ordinances by experienced workmai and e licensed Landscape Coneactor who shall obtain all necessary pennits and
pay all required fees.
SOII. PREPARATION: The Landscape Contrector shall be responsible for finish gtading and all planting area drainage. Positive diainage away
from tlie building as per ciry codcs shall be maintained. No low spou which hold standing water will be accepted. The Landscape Conuactor shall
incorporate backfill soil mixes in planting areas as noted below. Where rototilling is not possible, incorporate soil amendments into top 6 inches
with hand tools. After instsllation of irrigation system, all planting areas aze to be fine graded to within 2 inches and slighdy mounded away from
edges of top of plenter, curb, walk, header, etc. and raked smooth with all rocks and debris over I inch in diameter removed.
BACKFII.L SOIL MIXES: i'he Landscape ConRactor shall amend existing soi1, by rototilling, 4 cu. yd.'nitrofied' soil conditioner (with a PH of
6.5-7.5) and IS Ibs. gcanulaz fertilizer (12-12-12) per 1,000 sq. ft. into the top 6 inclies ofsoil in atl planting areas. Pit Planting Mix: for trees and
sluvbs mix 1/3 organic amendment, 2/3 amended topsoil as noted above.
TREE PLANTING: The trees are to be planted as per details on plan; allow 5 ft. clearance from adjacent paving. Tree backfill shall be the'Pit
Planting Mix' az noted above. All trees shall receive 'Agriform' 21 gram (20-20-5) fertilizer tablets at the following rates: 24" box trees: 8 tablets.
Thoroughiy water trees immediately afraplanting.
MULCHING: Mulch all planting arees, excluding lawn, having a slope less tl�an 2:1 with a 3 inch minimum depth of U2"-3/4" fir bark (nugget
not slvedded materiel) with a PH of no higher dian 5.0. and free of noxious weeds and foreign materials. Keep mulch 3" &nm base of plant stems
to allow air access to plant rootball.
MAINTENANCE: The Contractor shall maintain the project for 90 days (or u requested by owner) following the approval to begin the
maintenance period. During the entire maintenance period, watering, cultivating, weeding, mowing, repair/tightening of stakes and tia, restoration
of basins, provision of supplemental water by hand in addition to imgation system as necessary, spraying for insects and disease shall be
performed. At tlte end of the 90 day maintaiance period a(I azeas are to be weed free and all plant material is to be in a healdiy, tluiving condition.
Fumish Owner with typed maintrnance manual oudining watering, fertilizing, weeding, pruning and mawing schedules.
TOPSOII.: If any p1az!ting areas require the impocting of topsoil, die imported soil shal] be clean, friable sandy loam; free of noxious weed seeds,
sticks, stones over 1 inch in diameter or any materials that could inhibit growtli. Incoiporate itnported topsoil into the top 6-8 inches of site soil by
rototilling or hand cultivating as necessary.
SUBST[NTIONS: Requests for substitutions of plant varieties shall be made to the L.andscape Architect within 15 deys after signing of contract.
GU1IRANTEE: All conswction, trees and stuubs by the Landscape Contractor and/or Uis subconh�ctors shall be guaranteed for (t) one yeu after
beginning of maintenance period. 7'he contractor shall replace, at no expense to thc Owner, any and all landscape materials diat are in an
unacceptable condieon for time of use, end tms or shrubs that are dead or not in a vigorous, healdiy growing condition; witliin two weeks of
notification of such condidon. Replacement shall be of tl�e same kind and size as du originally specified item and shall be replaced as originally .

conserving manner possible. lt is the responsibiliry of the Landscape Maintenance Contractor and/or the owner ro pmgiam
the lmgation Convollers to provide ihe minimum amount of water needed to sustain proper plan[ health. This includes
making adjustmen[s [o the program for scasonal wcathcr changcs, plant material needs, water mquircmcnts, changes in
elevation, sun, shade and wind exposures. Contractor shall assume responsibiliry for any damage, crosion, puddling, etc.
due ro impcopu pmgrumming. Elecuical Contractor to supply ] 20-VOLT A.C. (2.5 AMP) service & disconnect, junction
box and wndui[, as necessary, to contmller location, lrrigation Contractor to make final connection from clecvical stub-out
to convoller. lnstell new 9-VOLT Duracell battery(s) in conemlla (if required) ro re[ain program in memory during
temporrry power failures. Fach controller shall have its own independent ground wire as per manufacture�s ins[cuctions.
VALVES: Isolation and Control Valve locations shown are diagmmmatic lnscall in mulch areas and so as [o not interfere
with plunt hole excavatian. Ins[all valve 6oxa 12 inches from and perpendiculaz [o: walks, curbs, etc. and each valve shall
be 12 inches npnrt. The shott side of valve shall be pacallel to walk, curb, edge, etc. If pressure exceeds 80 PSI. Convac�or
shall install Pressure Reducine eauinment as reauired.
W1R1NG: Con[rol wires shall be U.L. epproved for direct burial in ground, Copper siu #]4-1. Common ground wire shall
have white insulatian jacke[. Control wire shall have insulation jacket of color other than white. Splicing shall be done with
3M it3570 Scotchlok scal packs. Splicing of 24-VOLT wices will not be pennitted cxccpt in valve boxa. Leave a 24 inch
coil of excel wire at each splice und at ]00 feet on center along wice run. Tape win in bundles at 10 feet on center. No
[aping permitted in sleeves. lnstall a control wire for each extra station left on die con[roller and a spare control wire of a
different color along the entire main line. Loop 24 inchcs of excess wire inro each single valve box nnd ineo one valve box
in cach group of valves.

for 2 hours, where it is necessary to excavate adjacent to existing trees, tlie conuactor shall use all possible care to avoid
injury [o trees, and tree root systems. Excavation in area where two (Z) inch and larger roots exis[ shall be done by hand.
Cut roots one (1) inch and larger in diameter sliall be painted witl� two coa[s of tree seal, or equal. Trencha edjacent to trees
should be closcd within twenty-four (24) hours; and where this is not possible, ehe side of the trench ndjacent ro[he tree
shnll be kept shaded with wet bur(ap or canvas.
SLEE\'E5: The laigetion Contreccor shall coordinote with the General Contcactor and odier Subcontractocs for tl�e
location and the installation of sleeves, conduit or pipe dvough walls, under roadways, paving, suvctures, etc. prior ro
conswc[ion. !n addition to the sleeves and conduits shown on [he drawings, the lrrigation Contractor shall be responsible
for the coordinntion and/or instullation of sleeva and conduia of sufficien[ siu under all paved areas.
IRRIGATION SY'STEM: The icrigation sysrem design is based on a minimum operating pressure (PSl) end a flow
demand (GPM) as nated on plan. The Irrigation Contractor shull verify wnter pmssure prior to conswction. Repon any
difference between the warer pressure indicated on che deawings and the actual preuure reading at the imga[ion Point-of
Connection to the Landscape Architect. Failure to do so will result in the contractor being iesponsible for any necessnry
changes due to [his difference.
GUARANTEE: All conswction, parts and products by the Landscape Conttnctor md/or his subcontrnctocs shall be
guaranteed for one (1) full year after the beginning of the mnintrnance period. The contractor shall repince (at no expense to
the Owner) eny and all irriga[ion products tha[ are in an unacceptable condition far the time of use. Aeplacement of any
items shell match originul description of item(s) on wnswction plans and shall be installed per specification. The
Conuacror shall not be held liable for loss of imgation parts or products due ro vandalism, accidencal wuses, or acts of
neglect by othecs than [he Contcactor, his agents or employees.
