This letter confirms the decision of the � irector of Community Development, given on
September 21, 2010, approving a Minor ResidE�ntial Permit to allow a single story addition along
an existing non-conforming 5' side yard setback, located at 6235 Shadygrove Drive, with the
following conditions:
1. APPROVED PROTECT
This approval is based on a plan set entitle d, "Jajko Residence, 6235 Shadygrove Drive,
Cupertino, CA 95014'' consisting of sheet� A through E, dated August 2, 2010, except as
may be amended by conditions in this resc�lution.
2. CONSULTATION WITH OTHER DEPAR TMENTS
The applicant is responsible to consult witl other departments and/or agencies with regard
to the proposed project for additional conclitions and requirements. Any misrepresentation
• of any submitted data may invalidate an a pproval by the Community Development
Department.
3. EXTERIOR BUILDING MATERIALS/TRF,ATMENTS
Final building exterior treatment plan (inc _uding but not limited to details on exterior color,
material, architectural treatxnents and/or E�mbellishments) shall be reviewed and approved
by the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resem� le the details shown on the original approved
plans. Any exterior changes determined t� � be substantial by the Director of Community
Development shall require a minor modification approval with neighborhood input.
4. SIDE YARD SETBACK COVENANT
Prior to final occupancy, the property o�vner shall record a covenant on this property to
inform any future property owner that thf� existing five-foot setback along the East property
line is the conforming side. Any future a��ditions along the East side of the house must be
setback at least 5 feet from the side prc�perty line. No further extensions along existing
nonconforming building lines are permittf�d for the life of the house.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set foYth herein may include certain fees, dedication
requirements, reservation requirements, a�td other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and cther exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to :'ile a protest within this 90-day period complying
with all of the requirements of Section 660 Z0, you will be legally barred from later
challenging such exactions.
Please be aware that if this permit is not used �vithin one year, it shall expire on September 20,
2011.
Staff has made all of the findings that are required for approval of a Minor Residential Permit as
required by the of Cupertino's Municipal Cod �, Chapter 19.28.090 (B). Also, please note that an
appeal of this decision can be made witliin 1� calendar days from the date of this letter. If
this happens, you will be not�fied of a publi�� hearing, which will be scheduled before the
Planning Commission.
