APPLICATION SUMMARY

Typically, Director Minor Modification �.pplications are approved by the Director of
Community Development. However, in this case the proposed minor modification is
being considered by the Planning Commission due to the concurzent height exception
proposal.
RECOMMENDATION
Staff recommends that the Commission a:�prove the Director's Minor Modification and
Height Exception per the model resol utions enclosed (Attachment 1). Planning
Commission action is final, unless appealE�d to ttte City Council.
BACKGROUND
The applicant, representing Clearwire, is ��roposing to install a personal wireless service
facility with antennas on top of a twelve-foot tall vertical extension of an existing 96-
foot tall PG&E lattice tower located betw��en a residence and a water tank on a hillside

property. Clearwire, a subsidiary of Clearwire Communications and Sprint-Nextel
Communications, is proposing to develop a new, high speed, wireless voice and
internet communications network in the San Francisco Bay Area and other parts of the
country.
The seven new antennas are proposed to be mounted at the top of a 12-foot tall vertical
extension to the PG&E lattice tower, which is located on a prominent ridgeline
according to the City's Residential Hillside Zoning (RHS) zoning ordinance. The
maximum proposed height of the tower will be 108 feet. The surrounding properties
are characterized by open hillside lands, with several accessory/utility structures and
other hillside residences (See aerial diagram below).

DISCUSSION
Location/Setback
The proposed antenna project complies �vith the City's Wireless Facilities Master Plan,
which prefers personal wireless facilities to be located in non-residential areas.
However, if the facility is located in a residential area, the preference is mounting the
equipment on existing tall structures, such as a lattice tower. Further, the Cupertino
Wireless Facilities Ordinance permits wireless facilities in the RHS zoning district to be
mounted on an existing utility pole or to�Ner, regardless of zoning district or setback to
a residential property line, as long as the facilities comply with federal exposure
standards for radio frequency energy.
Design/Hei�ht
The proposed antennas could only be mo unted above the lattice tower in order to avoid
the high voltage transmission lines. Mc�unting the antennas on the tower legs below
the lowest transmission line (below 55 fE�et) is not desirable due to the potential radio
interference from the trees growing aro und the base of the tower and the potential
visual impacts to the residents in the vicirity.
Ri�eline VisibilitU
Development on prominent ridgelines �is defined in the Residential Hillside (RHS)
zoning ordinance requires additional visizal analysis from six, key valley floor vantage
points. The objective is to determine if the proposed development will create a
significant visual impact as viewed frorr. any of these valley floor locations: Carmen
Road and Bellevue Road; Rainbow Dr. and Weymoth Dr.; Bubb Road & McClellan
Road; Hyannisport Dr. and Linda Vista l�r.; Foothill Blvd. & Starling Dr.; and Foothill
Blvd. & Alpine. Typically, the ridgeline guidelines pertain to new developments that
involve buildings. Since the proposed z ntenna project is located on top of a modest
addition to an existing lattice tower, no additional visual impacts are expected
especially as viewed from the valley Eloor vantage points (See visual analysis -
Attachment 3).
As a condition of this project, the applicant is required to paint all tower equipment,
(including but not limited to, cables, mou nting hardware and antennas) a flat grey color
to visually blend the equipment with the tower.
Below is a list of similar projects with comparable height exception requests on lattice
towers that the Planning Commission has supported and approved in the past:
1. Monta Vista PG&E substation at Califc�rnia Oak Way
(94 feet tall, file no. EXC-2005-17; 157 and 158 feet tall, file no. EXC-2009-08);
2. PG&E substation at Homestead Road :Zear Stelling Road
(94.3' and 85.5 feet tall, file no. EXC-2(108-1�;
3. 10655 Mary Avenue lattice tower
(148,149 feet tall, file no. EXC-2009-0'�;

Staff supports the project and the height exception request for the following reasons:
1. The project is consistent with the Wire less Master Plan policy that articulates the use
of existing vertical structures when v�ireless facilities are proposed in hillside and
residential areas.
2. Proposed rectangular panel antennas visually blend in with the rectangular lattice
tower extension.
3. The visibility of the proposed circular microwave dishes is minimized because of the
small size of the dishes and th eir height above ground level (See the
photosimulations - Attachment 2).
4. Antennas located at the lower height� on the tower legs are likely to be subject to
radio interference from the trees gro �ving around the tower base and will create
greater visual impacts to nearby residents.
Radio Frequency Ener� (RFE) Assessment
The applicant has commissioned the prf �paration of a Radio Frequency Energy (RFE)
report prepared by Hammett & Edison, Consulting Engineers (Attachment 4). The
report calculated the maximum effective radiated power, the RFE exposures at ground
level and at the second story of potenti �1 2-story residences. The exposure data was
evaluated against the adopted federal ex��osure standards.
The report concluded that the proposed facility will meet the federal safety standards
for RFE of 1.0 mW/cm The calculai:ed ground level exposure is 0.020% of the
applicable public exposure limit, and at tlle second floor of any nearby building, 0.024%
of the applicable public exposure limit. The exposure data includes the contribution
from the microwave dish antennas.
Since this project meets the federal safety standard for radio frequency energy, Federal
Telecommunications Law prohibits loca:� governments from denying such a wireless
facility based on the environmental effE cts of its radio frequency energy generation.
The attached chart depicts the RFE expo;;ures that are generated by various household
devices and compares it to a typical persc nal wireless service facility (Attachment 5).
Additional Concerns
Several years ago, Sprint PCS proposed a wireless facility on the same PG&E tower,
which was eventually withdrawn by t:ze applicant. At the time, the surrounding
neighbors expressed concerns regarding construction related damage to the privately-
owned road. Staff has added condition s to the Director's approval to address those
concerns. They are requirements to:
1) Repair any visible road damage caused by the construction activities, and
2) Mix the concrete on the prop��rty instead of transporting it to the site
(Attachment 1).

Public Noticin�
Staff had previously mailed the plan set �.nd photosimulations to area property owners
for comments and received one objection That application was eventually withdrawn,
but resubmitted several months later (tY�e current application). Hearing notices were
mailed to property owners with land wit:un a 1,000-foot radius of the project property.
No resident comments have been receivecl to date.
TECHNOLOGY, INFORMATION A:vD COMMUNICATION COMMISSION
(TICC) COMMENTS:
Per Ordinance requirements, Techr.ology Information and Communication
Commission provides technical advice to the Planning Commission on personal
wireless service facilities. The Tec:tnology Information and Communication
Commission has designated two of its niembers to review and comment on pending
applications. Their comments are attacr.ed (Attachment 6). Both concluded that the
radio frequency energy exposure was v��ell within the federal safety standards, that
mounting the antennas on the PG&E tower will make them almost un-noticeable to the
general public, and the facility will serve an area of Cupertino that historically has not
received any wireless communications co��erage from any of the carriers.

applicant shall bear the entire cost of dernolition and removal.
4. EXPIRATION DATE
This Director's Minor Modification sha] 1 expire ten (10) years after the effective date of
the permit. The applicant may apply f��r a renewal of the minor modification at which
time the Director of Community Development may review the state of wireless
communication and camouflage technc►logies to determine if the visual impact of the
personal wireless facility can be reduced.
5. CAMOUFLAGING OF EQUIPMENT
The antennas, mounting brackets, and cables that run from the antennas to the base
equipment shall be painted to match the color of the lattice tower.

6. AVOIDANCE OF DAMAGE AND REP AIR OF REGNART CANYON DRIVE
Prior to construction, the applicant sha:.l conduct a photographic survey of all Regnart
Canyon Drive road defects and provicie copies to the City and all affected property
owners. The applicant shall repair al: noticeable damage caused by its construction
activities.
In addition, the applicant shall not tr�nsport pre-mixed concrete to the project site.
Concrete for the equipment pad shall be mixed at the project site.

WHEREAS, in order to provide hei�;ht flexibility in situations where practical
difficulties, unnecessary hardships or resiilts inconsistent with the purpose and intent of
Chapter 19.108 occurs, an applicant for �ievelopment may file an exception request to
seek approval to deviate from the standaY ds; and
WHEREAS, the Planning Commission finds the following with regards to the Height

1. That the literal enforcement of the p��ovisions of this title will result in restrictions

to Government Code Section 66020(d; (1), these Conditions constitute written notice
of a statement of the amount of suc h fees, and a description of the dedications,
reservations, and other exactions. Yc�u are hereby further notified that the 90-day
approval period in which you may p��otest these fees, dedications, reservations, and
other exactions, pursuant to GoverruYient Code Section 66020(a), has begun. If you

The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained on behalf of Clearwire,
LLC, a personal wireless service provider, telecommunications carrier, to evaluate the base station
(Site No. CA-SF00438B) proposed to be lucated at 11640 Regnart Canyon Drive in Cupertino,
California, for compliance with appropriate �uidelines limiting human exposure to radio frequency
("RF") electromagnetic fields.
Prevailing E:xposure Standards
The U.S. Congress requires that the Feder� 1 Communications Commission ("FCC") evaluate its
actions for possible significant impact on the environment. In Docket 93-62, effective October 15,
1997, the FCC adopted the human exposure limits for field strength and power density recommended
in Report No. 86, "Biological Effects and �;xposure Criteria for Radiofrequency Electromagnetic
Fields," published in 1986 by the Congressionally chartered National Council on Radiation Protection
and Measurements ("NCRP"). Separate limit:; apply for occupational and public exposure conditions,
with the latter limits generally five times more restrictive. The more recent standard, developed by the
Institute of Electrical and Electronics Engineers and approved as American National Standard
ANSI/IEEE C95.1-2006, "Safety Levels with Respect to Human Exposure to Radio Frequency
Electromagnetic Fields, 3 kHz to 300 GHz," includes similar exposure limits. A summary of the
FCC's exposure limits is shown in Figure 1. These limits apply for continuous exposures and are
intended to provide a prudent margin of saf �ty for all persons, regardless of age, gender, size, or
health.
The most restrictive FCC limit for exposures of unlimited duration to radio frequency energy for
several personal wireless services are as folloti�s:

General Fa��ility Requirements
Base stations typically consist of two distinct �►arts: the electronic transceivers (also called "radios" or
"channels") that are connected to the traditiot�al wired telephone lines, and the passive antennas that
send the wireless signals created by the radio:, out to be received by individual subscriber units. The
transceivers are often located at ground level and are connected to the antennas by coaxial cables
about 1 inch thick. Because of the short w�ivelength of the frequencies assigned by the FCC for
wireless services, the antennas require line-of-sight paths for their signals to propagate well and so are
installed at some height above ground. The altennas are designed to concentrate their energy toward
the horizon, with very little energy wasted tov�ard the sky or the ground. Along with the low power of
such facilities, this means that it is generall} not possible for exposure conditions to approach the
maximum permissible exposure limits without being physically very near the antennas.
Computer Modeling Method
The FCC provides direction for determining compliance in its Office of Engineering and Technology
Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to
Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation
methodologies, reflecting the facts that a dire�;tional antenna's radiation pattern is not fully formed at
locations very close by (the "near-field" effect) and that at greater distances the power level from an
energy source decreases with the square of the distance from it (the "inverse square law"). The
conservative nature of this method for evalua� ing exposure conditions has been verified by numerous
field tests.
Site and Facility Description
Based upon information provided by Cleatwire, including construction drawings by Streamline
Engineering and Design, Inc., dated January 27, 2010, it is proposed to mount three Argus Model
LLPX310R directional panel BRS antennas �n an existing 108-foot PG&E lattice tower located at
11640 Regnart Canyon Drive in Cupertino. 'Che antennas would be mounted with 2° downtilt at an
effective height of about 103 feet above grc,und and would be oriented toward 45°T, 165°T, and
270°T. The m�imum effective radiated pov�er in any direction would be 970 watts. Also proposed
to be mounted on the tower are four microwave "dish" antennas, for interconnection of this site with
others in the Clearwire network. There arc; reported no other wireless telecommunications base
stations located nearby.

Study Results
For a person anywhere at ground, the m�irnum ambient RF exposure level due to the proposed
Clearwire operation, including the contribut ons of the microwave antennas, is calculated to be
0.00020 mW/cm which is 0.020% of the aPl�licable public limit. The m�imum calculated level at
the second-floor elevation of any nearby building* is 0.024% of the public exposure limit. It should be
noted that these results include several "wc�rst-case" assumptions and therefore are expected to
overstate actual power density levels.
No Recommended Mitigation Measures
Due to their mounting locations, the Clearwire antennas would not be accessible to the general public,
and so no mitigation measures are necessary tc� comply with the FCC public exposure guidelines. It is
presumed that PG&E already takes adequate p-ecautions to ensure that there is no unauthorized access
to its tower. To prevent exposures in excess o� the occupational limit by authorized PG&E workers, it
is expected that they will adhere to appropriate safety protocols adopted by that company.
C��nclusion
Based on the information and analysis above, �t is the undersigned's professional opinion that the base
station proposed by Clearwire, LLC at 1164(1 Regnart Canyon Drive in Cupertino, California, will
comply with the prevailing standards for liniiting public exposure to radio frequency energy and,
therefore, will not for this reason cause a significant impact on the environment. The highest
calculated level in publicly accessible areas is much less than the prevailing standards allow for
exposures of unlimited duration. This findir g is consistent with measurements of actual exposure
conditions taken at other operating base statior s.

Prediction methods have been developed for the near field zone of panel (directional) and whip
(omnidirectional) antennas, typical at wireless telecommunications base stations, as well as dish .
(aperture) antennas, typically used for microw;�ve links. The antenna patterns are not fully formed in
the near field at these antennas, and the FCC Office of Engineering and Technology Bulletin No. 65
(August 1997) gives suitable formulas for calc.�lating power density within such zones.

RFF = relative field factor at the d �section to the actual point of calculation, and
D= distance from the center of radiation to the point of calculation, in meters.
The factor of 2.56 accounts for the increase :n power density due to ground reflection, assuming a
reflection coefficient of 1.6 (1.6 x 1.6 = 2.56). The factor of 1.64 is the gain of a half-wave dipole
relative to an isotropic radiator. The factor o:' 100 in the numerator converts to the desired units of
power density. This formula has been built in :o a proprietary program that calculates, at each location
on an arbitrary rectangular grid, the total ex��ected power density from any number of individual
radiation sources. The program also allows for the description of uneven terrain in the vicinity, to
obtain more accurate projections.

1. Radiation exposure: Based on the d��ta provided, radiation exposure to general
public is minimal and well below FC:C limits. Moreover, since antennas will be
mounted on PG&E tower, all the saf�ty precautions have been take care of.
2. Esthetics: Since antennas will be mo �nted on PG&E tower, antennas will be
almost un-noticeable to general pub .ic.
3. Benefits to Cupertino Residents : To �ver will be well within Cupertino city limits
and hence it will benefit Cupertino r esidents.
