RPtroactive Tree Removal Permit to ap�rove the removal of three protected Coast Live Oak trees at an existing religious retreat. *Minor correction to the project descri��tion: The project includes two new retaining walls, proposed in three different phase�. RECOMMENDATION Staff recommends approval of the Arcltitectural & Site Approval and the Retroactive Tree Removal Permit with modifications per the model resolution (Attachment 1). BACKGROUND In the early 1970's, the Marianists' devel��ped a religious retreat and retirement facility unc�er County jurisdiction on a hillside � roperty at 22840 Mercedes Road. The property was subsequently annexed to the City of Cupertino. The development consists of an upper (southern) building at the termint.s of San Juan Road connected by a walkway to the lower (northern) building at the terrr.inus of Mercedes Road. The current property owner is the Legionaires of Christ. The applicant had recently submitted pl�ins for preliminary review to the Public Works and Planning Departments to install nev�� retaining walls that would replace existing and failing wood walls. However, staff ��iscovered that the applicant had already begun significant grading work along the driveway of the northern building without City review or approved permits. The u npermitted grading activity also resulted in the removal of three large Coast Live Oaks. ASA-2010-04, TR-2010-40 Our Lady of Santa ('lara Retaining Wall � 1 ree Removal October 7, 2010 Page 2 The proposed grading work, site modific ations and tree removals typically require Design Review Committee approval. Hc►wever, due to immediate hillside safety concerns, Public Works staff has authori::ed temporary shoring and the construction of a portion of the retaining wall to prevent hillside erosion and instability during the upcoming rainy season. DISCUSSION Proposed Retaining Walls The proposed project is broken into the following phases: Phase IA �retroactive): An approximately 212-foot long retaining wall behind the northern building and along the drivew��y. This proposal involves cutting back the slope to widen the driveway from 16 fee :(at the narrowest segment) to approximately 30 feet (at the widest segment) and the rE�moval of three protected Coast Live Oaks. Due to the varying topography of the pr��perty, the maximum height of the rPtaining wall varies from a height of 9 feet near t��e mouth of the driveway to 19 feet behind the northern building (See sheet C2.0 of the ��lan set). Please note as previously mentioned, the applicant has already cut the slope a�id removed the oaks and temporary shoring has been put in place to hold up� the hill. The construction of Phase IA wall is currently in progress. Phase IB: This approximately 120-foot lcmg retaining wall replacement is located midslope between the northern and soui hern buildings (above the recently approved single family home on Mercedes Road - Chi Residence). The wall also varies in height but is not more than 9 feet tall. It is locai ed in approximately the same location as the existing wood retaining wall. The construction of this wall will not involve any tree removals. Work has not begun on this pllase. Although the applicant has not specified a timeframe for commencement, due to :�afety considerations, Public Works staff has recommended that the Phase IB wall be �:ompleted as soon as possible even if it means construction during the rainy season (Oc�tober 1 to Apri115). Phase II: A continuation of the retaining wall in Phase IA above, this proposed 120-foot retaining wall replacement project is loc�ited along Mercedes Road and involves a more significant grading cut of the hillside to �illow perpendicular parking along the roadway. The uphill topography also varies with the retaining wall reaching a maximum height of 20 feet. One protected Coast Live Oak would be removed with this proposal. Work has not begun on this ��roject phase. The commencement of the Phase II wall construction is unknown. Relevant General Plan Policy The City's hillside protection General I'lan policies (Policies 2-48 to 2-52) prescribe the following: • Limit development on ridgelines, hazardous geologic areas & steep slopes; ASA-2010-04, TR-2010-40 Our Lady of Santa c;lara Retaining Wall � 1 ree Removal October 7, 2010 Page 3 � • Control colors and materials; • Minimize the brightness. of outdo��r lighting; � • Reduce visible building mass by stepping structures down the hillside; • Follow the natural contours of thE hillside; • Limit the height and mass of the ��all plane facing the valley floor; • Avoid mass grading and follow n�tural land contours; and • Retain significant specimen trees. The intent of the General Plan is to onl�- allow developments or improvements when it can respect and preserve the natural hil.side environment. Therefore, it is important to ensure that hillside retaining walls a��e limited to the lowest height necessary for structural support stepped to contour with the hillside to the maximum extent possible, and screened with appropriate sidir.g and native plantings to help blend the improvements into the hillside setting. Staff Recommended Modifications Phase IA: In order to minimize the visual impacts and the mass of the proposed wall, staff recommends that a 4-foot tall raised pla�lter wall with a 4 to 5 foot wide planting bed be built along the entire stretch of the re taining wall. A planter would not negatively impact the existing driveway access ai►d/or vehicle backup area. Further, the Fire Department has confirmed that they �vould not have any concerns with the added planter. The planter and soils above the retaining wall should be landscaped with screening native vegetation (including but not limited to appropriate shrubs and vines). The wall should also be textured with �. faux stone effect as proposed by the applicant (see Attachment 2). Phase IB: In order to better contour with and blencl into the hillside, this 9-foot high wall should be stepped to create two shorter walls ranging from 4 to 5 feet and landscaped with native plants at the top and bottom of each wal] . Phase II: This 20-foot high wall should be stepped to create three shorter walls ranging from 6 to 7 feet in height and landscaped with naiive plants at the top and bottom of each wall whenever practical. A condition has been added to requir � the revisions based on the final decision be reviewed and approved by the Director ��f Community Development prior to issuance of building permits. Also, the appropriatE� vegetation in the planters and the soils above ASA-2010-04, TR-2010-40 Our Lady of Santa (:lara Retaining Wall � 1 ree Removal October 7, 2010 Page 4 the retaining wall should be determined and approved by the City's Consulting Arborist. Retroactive Tree Removal: The arborist report (see Attachment 3) indicates that three protected Coast Live Oaks were removed in Phase IA. The ordinance guideline is replacement with six (6) - 24" box trees. The City's General Plan prescrit>es hillside areas to be landscaped with native vegetation. Staff is recommending the removed Coast Live Oaks be replaced in kind. The final replacement tree locations, ;preferably near the retaining walls) shall be determined by the Director of Communi ty Development upon consultation with the City Consultant Arborist. There may be another Coast Live Oak that may need to be removed at a later date during the construction of the Phase ] I wall. The applicant is required to obtain a separate tree removal permit for said tr��e prior to the issuance construction permits for the Phase II retailing wall. RETA INING WALL, PHASE IB AND PHASE II The retaining walls for Phases IB and II �re not approved. The applicant shall submit a separate Architectural and Site Approval application for the proposed walls in Phases IB and II at such time when the final retaining wall designs and landscaping plan are completed, taking into account the vi;�ual impact of these walls from neighboring residential properties. The application shall include a status report on the Phase IA landscaping. 4.
