SUBJECT: MINOR RESIDENTIAL PERMI T— Application RM-2010-21:
This letter confirms the decision of the Direcl or of Community Development, given on
November 10, 2010, approving a Minor Resi��ential Permit to allow a reduced rear yard
setback of 18 feet when 20 feet is required or a new 2,808 square foot, single story home
located at 10551 Johanson Drive, with the following conditions:
1. APPROVED PROJECT
This approval is based on a plan set entitl �d, "Proposed New Residence for Mr. and
Mrs. Allen and Cindy Hsu, 10551 Johans �n Drive, Cupertino, CA 95014" consisting
of eight sheets dated 9-15 -10, except as rr �ay be amended by conditions in this .
resolution.
2. TRELLIS FEATURE & EXTERIOR DE TAIL
The courtyard, trellis feature, and exterio�� materials must be constructed per the approved
plans. Any exterior changes determined � o be substantial by the Director of Community
Development shall require a minor modif ication approval with neighborhood input
3. REMOVAL OF SECOND DWELLING UNIT
The existing second dwelling unit in the Y ear yard must be removed from the property
prior to final occupancy.
4. ACCURACY OF THE PROJECT PLAN S
The applicant/property owner is responsil�le to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easements aaidlor construction records. Any
misrepresentation of any property data m�y invalidate this approval and may require
additional review.
5. LANDSCAPE INSTALLATION REPORr'
A landscape installation audit shall be c�onducted by a certified landscape professional
after the landscaping and irrigation system have been installed. The findings of the
assessment shall be consolidated into a 1� indscape installation report.
The landscape installation report shal include, but is not limited to: inspection to
confirm that the landscaping and irri€;ation system are installed as specified in the
landscape and irrigation design plan, system tune-up, system test with distribution
uniformity, reporting overspray or run-c►ff that causes overland flow, and preparation of
an irrigafiion schedule.
The landscape installation report shall i nclude the following statement: "The landscape
and irrigation system have been install ed as specified in the landscape and irrigation
design plan and complies with the criter ia of the ordinance and the permit."
6. LANDSCAPE MAINTENANCE AGREF;MENT
Prior to final inspections and final occL pancy, the owner(s) of the property shall enter
into a formal written landscape mainte:lance agreement with the City. The Agreement
shall be recorded against the property c r properties involved, with the County of Santa
Clara Recorder's Office and it shall be � inding on all subsequent owners of land served
by the proposed landscape.
The landscape maintenance agreement � hall require that the installed landscape not be
modified and that maintenance activitie:� not alter the level of water efficiency of the
landscape from its original design, unle�.s approved by the City prior to the
commencement of the proposed modific ation or maintenance activity.
7. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult v� ith other departments and/or agencies with
regard to the proposed project for additic�nal conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the Community
Development Department.
8. EXTERIOR BUILDING MATERIALS� TREATMENTS
Final building exterior treatment plan (ir�cluding but not limited to details on exterior
color, material, architectural treatments s�.nd/or embellishments) shall be reviewed and
approved by the Director of Community Development prior to issuance of building
permits. The final building exterior plar. shall closely resemble the details shown on the
original approved plans. Any exterior c]ianges determined to be substantial by the
Director of Community Development sr all require a minor modification approval with
neighborhood input.
9. NOTICE OF FEES, DEDICATIONS, R ESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set Eorth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Condi�:ions constitute written notice of a statement of
the amount of such fees, and a descriptic�n of the dedications, reservations, and other
exactions. You are hereby further notifi ed that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), ha;� begun. If you fail to file a protest within this
90-day period complying with all of the requirements of Section 66020, you will be
legally barred from later challenging su�;h exactions.
Please be aware that if this permit is not usE d within one year, it shall expire on November
10,2011.
A neighbor requested that the property owners consider increasing the front yard setback. It
should be noted that proposed home is consi;�tent with all of the prescribed minimum
setbacks in the R1 Ordinance. Further, there is not a predominate pattern in the
neighborhood that warrants a front yard setb �ck greater than the ordinance requirement. The
proj ect architect & applicant considered the � leighbor's request and have decided not to
modify the front yard setback. Instead, addi� ional modifications have been made to the
proj ect including a decorative stone veneer a long portions of the front elevation, a reduction
of the garage plate height, and enhancement:, to the courtyard trellis/gateway feature.
Staff has made all the findings that are requi:•ed for approval of a Minor Residential Permit as
required by Chapter 19.28.090 (B). Also, ple ase note that an appeal of this decision can be
made within 14 calendar days from the date �f this letter. If this happens, you will be
notified of a public hearing, which will be sc heduled before the Planning Commission.
