APPROVED PROTECT This approval is based on a plan set enti tled, "Planning Submittal for: The Musa Family, 10707 Santa Lucia Road, Cupertino, CA 95014" consisting of twelve (12) sheets dated July 19, 2010 with a revision date of SeptembE�r 28, 2010; Geotechnical Peer Review by Cotton, Shires, and Associates, Inc. dated Noveml�er 10, 2010; and color and material sheet, except as may be amended by conditions in this r��solution. 2. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsi �le to verify all pertinent property data including but not limited to property boundary loc�tions, building setbacks, property size, building square footage, any relevant easements an��/or construction records. Any misrepresentation of any property data may invalidate this a}�proval and may require additional review. 3. GEOLOGIC AND GEOTECHNIC REVIEV'I . The project shall incorporate all recommendations set forth in the engineering geologic and geotechnical investigation prepared for thE development by Murray Engineers Inc., dated November 2, 2010. �' In addition, the project shall incorporate all the following conditions set forth in the geologic and geotechnical peer review conductec. by Cotton, Shires and Associates, Inc., dated November 10, 2010: a) Structural Evaluation and S:ructural Plans. Prior to issuance of building permits, the Project Structural Engineer shall evaluate the ability of the existing footings to support the propo::ed loads, and shall provide suitable foundation designs for either replacing ttie existing rear retaining wall or designing the adjacent portion of the planr ed addition, assuming this old wall does not provide lateral support. Structural plans shall be submitted that reflect the recommendations of the Project Geotechnical Consultant. b) Geotechnical Plan Review. Pri �r to issuance of building permits, the applicant's geotechnical consultant shall rE view and approve all geotechnical aspects of the development plans (i.e. si� e preparation and grading, site drainage improvements and design parameters for foundations, drainage, pavement, and retaining walls) to ensure th �t their recommendations have been properly incorporated. The results of tl ie structural evaluation and structural plans as mentioned in condition 3a, anci geotechnical plan review shall be submitted to the City for review and appr��val by City staff prior to issuance of building permits. c) Geotechnical Construction Inspection. Prior to final (as-built) project approval, the geotechnical consultant sltall inspect, test (as needed), and approve all geotechnical aspects of the prc>ject construction. The inspections shall include, but not necessarily be limited �:o: site preparation and grading, site surface and subsurface drainage improvEments and excavations for foundations and retaining walls prior to the pla :ement of steel and concrete. The results of these inspections and the as-built conditions of the project shall be described by the geotechnical consultant in a let and submitted to the City Engineer for review prior to final project approval. 4. PRIVACY PLANTING The final privacy-planfing plan shall be r��viewed and approved by the Planning Division prior to issuance of building permits. If existing tree(s) is used for privacy screening, a letter from a certified arborist shall be submitte � confirming that the tree(s) is in good condition and is appropriate privacy protection in ar y season. 5. PRIVACY PROTECTION COVENANT The property owner shall record a coveiiant on this property to inform future property owners of the privacy protection measure� and tree protection requirements consistent with the R-1 Ordinance, for all windows with views into neighboring yards and a sill height that is 5 feet or less from the second story finis 1ed floor. The precise language will be subject to approval by the Director of Communit�� Development. Proof of recordation must be submitted to the Community Developm��nt Department prior to final occupancy of the residence. 6. CONSULTATION WITH OTHER DEPAR`CMENTS The applicant is,responsible to consult witl other departments and/or agencies with regard to the proposed project for additional con�iitions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 7. EXTERIOR BUILDING MATERIALS/TREATMENTS Final building exterior treatment plan (inc luding but not limited to details on exterior color, material, architectural treatments and/or �mbellishments) shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The final building exterior plan shall closely reser� �ble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a minor modifi�:ation approval with neighborhood input. 8. NOTICE OF FEES, DEDICATIONS, RESEIZVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of :he dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Sectior 66020, you will be legally barred from later challenging such exactions. Please be aware that if this permit is not used within two years, it shall expire on September 27, 2012. Staff received a comment from a neighbor iriquiring whether any of the hillside landscaping was proposed for removal and the setback requirement for the side yard. The applicant is not proposing to remove any hillside landscapin,;. The side setbacks on the first floor are five (5) feet on the east side and ten (10) feet on the west side. The side setbacks on the second floor are 20 feet on both the east and west sides. The pr.�ject's setbacks conform to the standards of the Rl Ordinance. Staff has made all the findings that are requir��d for approval of a Two-story Residential Permit as required by the of Cupertino's Municipal C'ode, Chapter 19.28.100 (D). Also, please note that an appeal of this decision can be made withi�t 14 calendar days from the date of this letter. In addition to evaluation of the ab� �ve referenced documents, we have reviewed pertinent technical documents from ou r office files and performed a recent site inspection. DISCUSSION The applicant proposes to construc�t a second-story residential addition onto the west side of the existing single-story resid ence. The southeast portion of the residence, which was formerly a garage and now a family room, is to be converted back into a garage and expanded slightly. SITE CONDITIONS The project site is characterized, i1 general, by moderately inclined (15- to 20- degree inclinations), natural, east-facing hillside topography. Grading for original residential construction has resulted in th� � development of a relatively level cut and fill building pad. This retaining wall ap: �ears to be in fair condition, but contains abundant near-vertical cracks up to 0.1-ir_ch in width. One weephole was observed in this wall, and one surface drain pipe extE nds through the wall immediately above the weephole. The weephole and drain pipE appear to discharge onto a drop inlet that conveys this runoff below a concrete pat o to an unknown location. A large retaining wall, up to approximately 8 feet in height. is located along the southwestern portion of the property, along the downslope side o= the driveway. This wall appears to support fill material along the outboard edge of the driveway. Abundant cracks are located along the outboard edge of the drivewa y, suggesting possible fill settlement and/ar creep. We also observed several large cr�icks (up to 0.2-inch width) in the residential foundation along the front of the structure. Our site observations reveal tl �at surface drainage conditions could be improved. Roof gutter downspouts disc��arge adjacent to the residential foundation, and localized areas of ponding likely occu r in the rear patio area. The drainage behind the upslope retaining wall is unknown, a 1d surface water on the slope above the wall does not appear to be effectively captc red and conveyed past the residence. The existing drop inlet at the foot of the rear re taining wall is somewhat unconventional. Published geologic maps of the are a reveal that the site is underlain, at depth, by valley floor alluvium and alluvial fan deposits (i.e., unconsolidated gravel, sand, silt, and clay). The City Geologic and Seismic Hazards Map indicates that the building site is located within an"F" zone, which defines a potential fault rupture hazard zone associated with the nearby Monta Vista :'ault. Traces of the potentially active Monta Vista fault have been mapped approxima tely 250 feet west of the site and 300 feet east of the site. The active San Andreas fault i� mapped approximately 3.5 miles southwest of the project site. CONCLUSIONS AND RECOMMENDEI� ACTION The proposed residential construc tion is potentially constrained by expansive surficial soil material, the potential for setl lement and creep of alluvial soil and artificial fill materials, poorly controlled surface drainage conditions, the suitability of the existing footings and potential for settlem �nt under the additional two-story loads, and the susceptibility of the site to very strc ng to violent seismic ground shaking. The Project Geotechnical Consultant has perfurmed a geotechnical investigation, including the excavation of 2 exploratory borings, ar�d has concluded that the potential for surface fault rupture to impact the proposed de��elopment is low. They have also concluded that the potential for landsliding, liquef, iction, and/or secondary seismic hazards to adversely impact the proposed additions : s low. We do not have geologic objections to the proposed layout of the residential adclitions, and thus, recommend approval of the permit application from a geologic standp� �int. COTTON, SHIRES AND ASSOCIATES, INC. � George Schroeder November 10, 2010 Page 3 C5080 However, we do have two pri mary concerns regarding the existing site conditions and their relationship to the ��roposed 2-story addition, specifically: 1) the existing footings may not be adequate for supporting the second-story loads; and 2) the condition of the rear retaining wall and ttie proximity of this wall to the proposed new addition. The Project Structural Enginee�• should evaluate the condition of the existing footings, specifically their ability to suppc►rt the proposed loads. Additionally, the rear retaining wall, as shown on the building sections, abuts the new two-story addition. This wall has abundant cracks and the P roject Geotechnical Consultant has indicated that this wall has unknown foundatio 1 conditions and should not be used for foundation support. Therefore, we do not recommend that the proposed addition abut this wall, and recommend that considera ion be given to removing and replacing this wall. Consideration could also be given 1 o designing the new residential living space adjacent to this wall to withstand the static� and dynamic lateral forces from this upslope area assuming the existing wall will iiot provide resistance. Consequently, the following items should be submitted prior to issuance of building permits: 1. Structural Evaluation and Structural Plans — The Project Structural Engineer should evaluate the � ibility of the existing footings to support the proposed loads, and shoul�i provide suitable foundation designs far either replacing the existing re�r retaining wall or designing the adjacent portion of the planned additior� assuming this old wall does not provide lateral support.
