West Valley Presbyterian Church's current program schedule is detailed in an official letter from Veronica Cruz, Office Manager at West Valley Presbyterian Church (Attachment 1). An additional Use Permit (1-U-94) was approved March 14th, 1994 to accommodate additional space for office area and church staff. Please refer to Attachment 11 for the plan set and Attachment 2 for the event schedule in 1994. On December 8th, 2009, a separate modification (M-2009-08) to Use Permit 25-U-83 was approved to allow Mandarin Academy Immersion School to occupy a portion of West Valley Presbyterian Church's facilities during the weekdays, replacing the Senior Nutrition Program. The school's hours of operation are Monday through Friday, 8:00 a.m. to 3:30 p.m., with an enrichment program to follow from 3:30 p.m. to 6:00 p.m. Staff hours begin at 7:30 a.m. and end at 6:30 p.m., while drop-off/pick-up hours are 7:45 a.m. and 6:30 p.m. The school was approved for an initial eight (8) students with a maximum of 49 students, but currently has only two (2) students at this time. West Valley Presbyterian Church is requesting a modification of the use permit to allow the operation of Haven Christian Preschool on its premises. The preschool will coexist with all current programs and activities on site without displacing other uses. A detailed discussion of the specifics for the proposed school is provided later in this report. Site Location The project site (see Attachment 4) is located on the northeast corner of Miller Avenue and Bollinger Road, and is surrounded by Hyde Middle School to the north and east, single family residences to the west across Miller Avenue, and a commercial shopping center to the south across Bollinger Road. The church also owns the duplex residence immediately adjacent and to the north of the church site. Sites south of Bollinger Road are within the City of San Jose. DISCUSSION Scliool Composition � There are a total of 13 classrooms at West Valley Presbyterian Church, most of which are used throughout the week for various church programs and activities, as well as on Sunday for Sunday school. Mandarin Academy currently occupies two out of the 13 classrooms for about two students in the morning and three students in the afternoon during the week in the classroom/admin building. They also have use of the multi-purpose room/parish hall, outdoor playground, lunch room, computer room, & library. Haven Christian Preschool plans to operate out of two of the 13 existing classrooms during the week in a separate building, using ancillary facilities such as restrooms and office space as y needed. The classrooms for Haven Christian Preschool and Mandarin Academy are separate and independent from one another, and both do not conflict with the church's current programs and activities. There will be no overlap in usage of classroom space. The preschool anticipates a maximum of 45 siudents, with children ranging in age from 2 years and 9 months old, to 6 years old. Only a maximum of 30 students for the proposed school will be on-site any given time (see Attachment 5). Initial enrollment is anticipated to be 20 students during the fall, with only 12 students enrolled in the summer. After the program has developed over the course of a few years, the preschool will be able to reach its maximum capacity of 30 students per State licensing requirements. 1-2 M-2010-09 West Valley Presbyterian Church February 22,1011 Page 3 There will be a total of five (5) etaff inembers, including four (4) teachers and one (1) office staff inember, with a child to teacher ratio of 7.5:1 at full capacity. Facility Sclzedule and Activities Haven Christian Preschool will regularly operate from September to May, with a starting time of 9:00 a.m. and an ending time of 6:00 p.m. Staff may arrive as early as 7:00 a.m., and leave as late as 6:30 p.m.. A summer program component will commence approximately June to August, and will consist of morning shift students only, hours ranging from 9:00 a.m. to 12:00 p.m. The Haven Christian Preschool will offer a variety of activities to occupy students throughout the morning and afternoon. These activities include but are not limited to indoor/outdoor unstructured playtime, story time, craft time, and breaks. . Mandarin Academy has use of the outdoor play area from 10:15 a.m. to 10:30 a.m., Monday through Friday for about two students. Haven Christian Preschool will use the outdoor play area for one-half hour in the morning, 9:00 a.m. to 9:30 a.m., and one hour in the afternoon, 12:00 p.m. to 1:00 p.m., for a total of 1.5 hours per day, Monday through Friday (see Attachment 6). Apart from the existing and proposed school uses, West Valley Presbyterian Church does not have any other weekday programs aside from those outlined in Attachment 1. Sunday school classes are only held on Sundays in conjunction with church services. There will not be any physical changes or additions to the church buildings since there are already existing classrooms for church use on Sundays. The school will operate from the existing classrooms. An overview of the hours of operation for the church facility and the approximate number of attendees is presented in Attachment 7. Hyde Middle School's Bell Schedule is included for comparison (see Attachment 8). Parking Analysis The following is a parking analysis for the existing and proposed uses at the church during the days and times the school will be in operation during the week. The parking requirement for the existing programs ancillary to the church use during the weekdays should already be captured within the required church parking per the ordinance. It is assumed that community programs are routinely held at church facilities during the day when service is not in session. However, in order to be conservative, we have calculated the parking requirement for the existing programs separate from the primary church use. We used the maximum number of attendees delineated in Attachment 2 as the maximum parking requirement. There are currently 93 parking spaces available on site. Per the ordinance, 69 spaces are required for the existing private school, 15 spaces are needed for the existing programs held by the church, and Haven Christian Preschool will require 5 additional spaces. Thus, the parking analysis indicates that a total of 89 spaces are required, while 93 spaces are provided on-site. Therefore, there will be sufficient parking on site to accommodate all uses. The project will not alter the existing circulation driveways or entrances to the church property. Drop-Off and Pick-Up Staggered drop-off and pick-up times are proposed to prevent queuing within the parking lot and to avoid vehicular traffic backing up onto Miller Ave and Bollinger Rd near Hyde Middle School. Children for Haven Christian Preschool may be dropped off as early as 7:30 a.m., while a majority will be dropped off between 8:45 a.m. up unti19:00 a.m. for the morning shift. Hyde Middle School drop-off times will be about 8:25 a.m. - 8:39 a.m. Monday, Thursday, and Friday, and about 8:58 a.m. - 9:13 a.m. Tuesday and Wednesday. A majority of Haven Christian Preschool students will be picked up as early as 3:45 p.m. - 4:00 p.m., and as late as 6:00 p.m. for the afternoon/full-day shift. Hyde Middle School pick-up times should be approximately 2:45 p.m. - 3:00 p.m. every weekday. All vehicles must adhere to the provided traffic flow plan, using the northern exit/entrance off Miller Ave as primary access to the church parking lot (Attachment 9). Vehicles must travel in the direction stipulated by the one-way parking aisle arrows as depicted in the traffic flow plan. However, parents are required to park vehicles and walk children to and from designated classrooms, supervising children at all times. Children 5 years of age and younger must be signed-in when arriving by a parent and signed-out when departing. At no point shall a child be left unattended within the designated church parking lot (see Attachment 10). A parent handbook will be distributed to parents with detailed instructions regarding the drop-off and pick-up procedure required by the traffic flow plan. As described previously, pick-up and drop-off times for Hyde Middle School and Haven Christian Preschool will not conflict with one another. Prior to issuance of building permits, the applicant is required to submit a final circulation and parking plan to the City for review and approval. 1-4 M-2010-09 West Valley Presbyterian Church February 22,1011 Page 5 Previous Concerns The Planning Commission had expressed concerns at the December 8, 2009 Planning Commission meeting for application M-2009-OS regarding the condition of on-site trees and the need for replacements. Jonathan Ferrante, our Public Works Supervisor for Tree/Right-of-Way has inspected the trees along Bollinger Road and within the parking lot off Miller Avenue. He has concluded that they are dormant and in good-to-fair condition and do not need replacing. Ofher Departments Review The Public Works, Building and Fire Departments have reviewed the application and have no major concerns regarding the proposed project. The Building Department has provided its comments to the applicant regarding fire sprinklers, accessibility, and occupancy requirements. The Fire Department has comments regarding fire sprinklers and potable water supplies, and building address identification. Environmental Review Since no physical changes to the existing church are proposed, no significant environmental effects are anticipated. Consequently, the project is considered Categorically Exempt under CEQA Section 15322. Staff Recommendation Staff is supportive of the proposed application as it is consistent with the City's Zoning Ordinance and is compatible with the surrounding neighborhood. Prepared by: Simon S. MODIFICATION TO CHURCH SCHEUDLE & FUTURE INTENSIFCATION Attachment 1, titled "Letter from West Valley Presbyterian Church" shall now supersede the prior church schedule, Exhibit B, titled "West Valley Presbyterian Church Event Schedule" as approved in the previous Use Permit (1-U-94). In the event that the number of attendees changes, the intensification of uses is proposed, or any activities that may generate additional vehicular traffic or impact parking or traffic circulation in any way is proposed, a modification shall be submitted to the City for review. 4. PREVIOUS CONDITIONS OF APPROVAL All prior use permit conditions of approval (25-U-83 and 1-U-94) and modifications to use permits (M-2009-08) shall remain in effect unless superseded by or in conflict with subsequent conditions of approval, including conditions of approval for �I-2010-09. 5. VEHICLE CIRCULATION AND PARKING PLAN Prior to issuance of any building permits, the applicant shall submit a final vehicle circulation and parking plan to the satisfaction of the Director of Community Development and the Public Works Department. SIGNAGE & SIGN PROGRAM Signage is not approved with this use permit application. The applicant shall be required to submit an application for a sign program and signage prior to installation of any signage on site. Signage shall conform to the City's Sign Ordinance. 8. STATE LICENSING REQUIREMENTS Operation of the preschool is continge�t upon the applicant obtaining proper licenses through � the State of California's Department of Social Services (Community Care Licensing Division). Applicant must adhere to all licensing requirements for a Child Care Center as required by state law. 9. This will be a state lieensed program and will abide by all the state licensing requirements. Haven Christian Preschool will lease 2 classrooms (1002 sq ft), restrooms and office space. The program will be able to service a maximum of 45 student ages 2 years 9 months to 6 years old. Only 30 students wilt be on site at any one point in time. These classrooms are currently used on Sundays only for similar use. The program vvill run Monday �hru Friday 9am to 6pm with staggered pick up and drop off times. In addition to the 2 classrooms some space in an adjoining classroom will be used for office space as required by state licensing, approximately 120 sq ft. The church outdoor play area will be used at regularly scheduled times so as to coordinate with existing use. The Outdoor play area is currently 2787 sq ft, fully fenced and meets all written sta.te licensing requirements. To run this program at full capacity 5 staff will be on site. There is no change to the current 20,076 sq f� of buildin�on the 2.1 acre property.
