Description MunicipalCodeAmendmenttoChapter19.100(ParkingOrdinance)oftheCupertinoMunicipal CodewithassociatedamendmentstoChapter19.08(DefinitionsOrdinance)regardingstorage andparkingofheavyequipment,aircraftandplannednon-operationalvehicles(seeAttachment A – DraftOrdinance). Thisitemwas postponedbytheCityCouncilfromitsNovember 16, 2010meeting. Discussion Background: OnJuly20,2010,theCityCouncilfirstreviewedtheamendmentstotheParkingOrdinance proposedbytheCodeEnforcementDivisiontoclarifyrequirementsregardingthestorageof vehiclesinresidentialzones.TheCouncildirectedthattheitembereviewedbythePlanning Commission. OnOctober12,2010,thePlanningCommissionreviewedandrecommendedapprovalofthe amendments(seeAttachmentB–CommissionmeetingminutesandAttachmentC- CommissionResolutionNo. 6613). Proposedchanges: Thefollowing sections ofthereport summarizekeyissues discussedatthePlanningCommission hearingandadditionalchangesrecommendedbystaffafterCommissionreview.Pleasereferto theOctober12,2010PlanningCommissionstaffreport(AttachmentD)andminutes (AttachmentB)fora detailed discussion. Heavy Equipment ThePlanningCommissionrecommendsallowingheavyequipmentinallzoningdistrictsaslong astheyarestoredineitheranenclosedstructureorbehindasix-foottallfencelocatedinthe interior sideyards orrearyardareasand notbe visiblefromthe street. SincetheCommissionhearing,staffisrecommendingsomechangestoSection19.100.040(L) oftheOrdinancetofurtherclarifytheheavyequipmentstorageprovision(seeitalicparagraph belowandAttachment E).Deletionsare shownwith strikeoutsandadditionsare underlined: Heavyequipment and airplanes shall be storedwithinentirelyenclosed structures or behind six- shallthese foot-highfencingininterior sideyard and rearyard setback areas.In nocasemay items bevisiblefromthestreetevenwhen placedin permitted areas.Heavyequipmentmaybe stored on site only duringtemporarilykeptforconstruction or installation ofimprovementswith avalid building or grading permit.
