THECITYCOUNCILOFTHECITYOFCUPERTINOORDAINSASFOLLOWS: Section 1.StatementofPurpose. Thisordinance amendmentclarifieslanguageregarding storageandparkingofvehicles. Section 2.CodeAmendment. A.Chapter19.08,entitled“Definitions,”oftheCupertinoMunicipalCode,isamendedtoread as showninExhibit 1; and B.Sections19.100.030and19.100.040inChapter19.100,entitled“ParkingRegulations,”ofthe Cupertino MunicipalCodeis amended, toreadas showninExhibit 2. Section 3.Severability. ShouldanyprovisionofthisOrdinance,oritsapplicationtoanypersonorcircumstance,be determinedbyacourtofcompetentjurisdictiontobeunlawful,unenforceableorotherwise void,thatdeterminationshallhavenoeffectonanyotherprovisionofthisOrdinanceorthe applicationofthisOrdinancetoanyotherpersonorcircumstanceand,tothatend,the provisionshereof are severable. Section 4.EffectiveDate. ThisOrdinanceshalltakeeffectandbeinforcethirty(30)daysfromandafteradoptionas provided by GovernmentCodeSection 36937. Section 5.Certification. TheCityClerkshallcertifytothepassageandadoptionofthisOrdinanceandshallgivenotice ofitsadoptionasrequiredbylaw.PursuanttoGovernmentCodeSection36933,asummaryof thisOrdinancemaybepublishedandpostedinlieuofpublicationandpostingoftheentire text. Section 6.CEQA. Becausethisordinancemakespurelyproceduralchanges,andimprovementsto readability,thisordinanceisexemptfromCEQAreviewpursuanttoCEQAGuidelines section 15061(b)(3). Section 7.Continuity. TotheextenttheprovisionsofthisOrdinancearesubstantiallythesameasprevious provisionsoftheCupertinoMunicipalCode,theseprovisionsshallbeconstruedas continuationsofthose provisions andnot as amendmentsofthe earlier provisions. A.“A”Definitions: 1.“Abandon”meanstoceaseordiscontinueauseoractivitywithoutintenttoresume,but excludingtemporaryorshort-terminterruptionstoauseoractivityduringperiodsof remodeling,maintaining,orotherwiseimprovingorrearranging a facility,orduringnormal periodsof vacationor seasonalclosure. 2.“Abutting”meanshavingpropertyordistrictlinesincommon. 3.“Accessorybuilding”meansabuildingwhichisincidentaltoandcustomarilyassociated withaspecificprincipaluseorfacilityandwhichmeetstheapplicableconditionssetforth inChapter 19.80. 4.“Accessorystructure”meansasubordinatestructure,theuseofwhichispurelyincidental tothatofthemainbuildingandwhichshallnotcontainlivingorsleepingquarters. Examplesincludeadeck,tenniscourts,trellisorcarshelter.Fenceseightfeetorlessare excluded. 5.“Addition”meansany constructionwhichincreases thesizeof abuildingorfacilityin terms of sitecoverage,height,length,width,or grossfloor arearatio. 6.“Adultbookstore”meansabuildingorportionthereofusedbyanestablishmenthavingas asubstantialorsignificantportionofitsstockintradeforsaletothepublicorcertain membersthereof,books,magazines,andotherpublicationswhicharedistinguishedor characterizedbytheiremphasisonmatterdepicting,describingorrelatingto“specified sexual activities”or “specified anatomical areas,”ashereinafterdefined. 7.“Adultcabaret”meansabuildingorportionthereofusedfordancingpurposesthereofor areausedforpresentationorexhibitionorfeaturingoftoplessorbottomlessdancers, strippers,maleorfemaleimpersonatorsorsimilarentertainers,forobservationsbypatrons or customers. 8.“Adultmotionpicturetheater”meansabuildingorportionthereoforarea,openor enclosed,usedforthepresentationofmotionpicturesdistinguishedorcharacterizedbyan emphasisonmatterdepicting,describingorrelatingto“specifiedsexualactivities”or “specifiedanatomicalareas,”ashereinafterdefined,forobservationbypatronsor customers. 9.“Agriculture”meansthetillingofthesoil,theraisingofcrops,horticulture,agriculture, livestockfarming,dairying,oranimalhusbandry,includingslaughterhouses,fertilizer yards, boneyard,orplantsfor thereductionofanimalmatteroranyothersimilaruse. 10.“Alley”meansapublicorprivatevehicularwaylessthanthirtyfeetinwidthaffordinga secondarymeansof vehicular access to abuttingproperty. 11.“Alteration”meansanyconstructionorphysicalchangeinthearrangementofroomsorthe supportingmembersofabuildingorstructure,orchangeintherelativepositionof buildingsorstructuresonasite,orsubstantialchangeinappearancesofanybuildingor structure. a.“Incidentalalteration”meansanyalterationtointeriorpartitionsorinteriorsupporting membersofastructurewhichdoesnotincreasethestructuralstrengthofthestructure;any alterationtoelectrical,plumbing,heating,airconditioning,ventilating,orotherutility services,fixtures,orappliances;anyaddition,closing,orchangeinsizeofdoorsor windowsintheexteriorwalls;oranyreplacementofabuildingfacadewhichdoesnot increase the structural strengthofthe structure. b. “Structural alteration”meansanyalterationnotdeemed anincidentalalteration. 12.“Amusementpark”meansacommercialfacilitywhichsuppliesvariousformsofindoor andoutdoor entertainmentandrefreshments. 13.Animal: a.Animal,Adult.“Adult animal”meansanyanimalfourmonthsof age orolder. b.“Animalcare”meansauseprovidinggrooming,housing,medicalcare,orotherservicesto animals,includingveterinaryservices,animalhospitals,overnightorshort-termboarding ancillary toveterinary care,indoororoutdoor kennels,and similar services. c.Animal,Large.“Largeanimal”meansanyequine,bovine,sheep,goatorswineorsimilar domesticorwildanimal, as determined by thePlanningCommission. d.Animal,Small.“Smallanimal”meansanimalswhicharecommonlyfoundinsingle-family residential areassuchaschickens,ducks, geese,rabbits,dogs, cats, etc. 14.“Apartment”means aroomorasuiteoftwoormoreroomswhichisdesignedfor,intended for, andoccupied by onefamilydoingitscooking therein. 15.“Apartmenthouse”meansabuildingdesignedandusedtohousethreeormorefamilies, livingindependentlyofeachother. 16.“Apartmentproject”meansarentalhousingdevelopmentconsistingoftwoormore dwellingunits. 17.“Architecturalfeature”meansanypartorappurtenanceofabuildingorstructurewhichis notaportionofthelivingareaofthebuildingorstructure.Examplesinclude:cornices, canopies,eaves,awnings,fireplaces,orprojectingwindowelements.Patiocoversorany projectionofthefloor area shallnot constitutean architecturalprojection. 18.“Atrium”meansa courtyard completelyenclosed by wallsand/orfences. 19.“Attic”meansanareabetweentheceilingandroofofastructure,whichisunconditioned (notheatedorcooled)anduninhabitable. 20.“Automotiveservicestation”meansauseprovidinggasoline,oil,tires,smallpartsand accessories,andservicesincidentalthereto,forautomobiles,lighttrucks,andsimilarmotor vehicles.Automotivemaintenanceandrepair(minor)maybeconductedonthesite.The saleoffoodorgroceryitemsonthesamesiteisprohibitedexceptforsoftdrinksandsnack foods,eitherfromautomaticvendingmachinesorinshelves.Thesaleofalcoholic beverageson the siteisgoverned by Chapter 19.106. 21.“Automotiverepairandmaintenance(minor)”meansthesupplyingofroutineautomotive servicessuchaslubrication,enginetuneups,smogcertificates,servicingoftires,brakes, batteriesandsimilaraccessories,andminorrepairsinvolvingengineaccessories.Any repairwhichrequirestheengine,drivetrain,transmissionassembly,exhaustsystem,or drivetrainpartstoberemovedfromamotorvehicleorrequirestheremovalofinternal partsshallnotbeconsideredminor.Bodyandpaintshopoperationsarenotminorrepairs ormaintenance. 22.“Averagepercentofslope”meanstheratiobetweenverticalandhorizontaldistance expressedinpercent;themathematicalexpressionisbasedupontheformuladescribed below: I xLx 100 æö S= A èø S=Average slopeof groundinpercent I=Contourintervalinfeet L=Combinedlengthinfeetof all contoursonparcel A=Areaofparcelinsquarefeet. B.“B”Definitions: 1.“Basement”meansanyfloorbelowthefirststoryinabuildingthatisfullysubmerged belowgradeexceptforlightwellsrequiredforlight,ventilationandemergencyegress.A basementmayhaveamaximumexteriorwallheightoftwofeetbetweennaturalgrade and ceiling. 2.“Block”meansanylotorgroupofcontiguouslotsboundedonallsidesbystreets,railroad rights-of-way,orwaterways,andnottraversedbyanystreet,railroadright-of-wayor waterway. 3.“Boardinghome”meansanybuildingusedfortherentingofroomsorprovidingoftable boardforfromthreetofivepersons,inclusive,overtheageofsixteenyears,whoarenot membersofthe samefamily. 4.“Building”meansanystructureusedorintendedforsupportingorshelteringanyuseor occupancywhenanyportionofabuildingiscompletelyseparatedfromeveryother portionthereofbyan“areaseparationwall”asdefinedbytheUniformBuildingCode, then each suchportion shall be deemedto be a separate building. a.Building,Attached.“Attachedbuilding”meansbuildingswhicharephysically connectedby any structuralmembersorwall, excludingdecks,patiosorfences. 5.“Buildingcoverage”meansthatportionofthenetlotareaencompassedwithinthe outermostwalllinewhichdefines a building enclosure. 6.“Business”or“commerce”meansthepurchase,saleorothertransactioninvolvingthe handlingordispositionofanyarticle,substanceorcommodityforprofitorlivelihood, including,inaddition,officebuildings,offices,shopsforthesaleofpersonalservices, garages,outdooradvertisingsignsandstructures,hotelsandmotels,andrecreationaland amusemententerprises conductedforprofit. 7.“Businessortradeschool”meansause,exceptacollegeoruniversity,providingeducation ortraininginbusiness,commerce,language,orsimilaractivityorpursuit,andnot otherwisedefinedas ahomeoccupation. C.“C”Definitions: 1.“Canopy”meansanyroof-likestructure,eitherattachedtoanotherstructureor freestanding,oranyextensionofaroofline,constructedforthepurposeofprotectionfrom the elementsin connectionwithoutdoorliving. 2.“Carshelter”meansaroofedstructureorapartofabuildingnotenclosedbywalls, intendedanddesignedto accommodateoneormore vehicles. 3.“Centerline”meansthecenterlineasestablishedbytheCountySurveyorofSantaClara County, theCityEngineer,or by theStateDivisionofHighwaysoftheStateofCalifornia. 4.“Changeofuse”meansthereplacementofanexistingusebyanewuse,orachangeinthe natureof an existinguse, butnotincluding a changeinownership, tenancyormanagement wherethepreviousnatureoftheuse,lineofbusiness,orotherfunctionissubstantially changed. 5.“Child”meansapersonwhoisundertenyearsofageforwhomcareandsupervisionare beingprovidedin a daycarehomeordaycarefacility. 6.“Childdaycarefacility”meansafacility,licensedbytheStateorCounty,whichprovides caretochildrenundereighteenyearsofageinneedofpersonalservice,supervisors,or assistanceessentialforsustainingtheactivitiesofdailylivingorfortheprotectionofthe individualonalessthantwenty-four-hourbasis.Childdaycarefacilityincludesdaycare centersandfamilydaycarehomesandincludesthefollowing: 1a.“Largechildcarefacility,”whichmeansafacilitywhichprovideschildanddaycareto seven totwelvechildreninclusive; 2b.“Smallchildcarefacility,”whichmeansafacilitywhichprovideschilddaycareforone to six childreninclusive. 7.“Church”meansauseprovidingfacilitiesfororganizedreligiousworshipandreligious educationincidentalthereto,butexcludingaprivateeducationalfacility.Apropertytax exemptionobtainedpursuanttoSection3(f)ofArticleXIIIoftheConstitutionoftheState ofCaliforniaandSection206oftheRevenueandTaxationCodeoftheStateofCalifornia, orsuccessorlegislation,constitutesprimafacieevidencethatsuchuseisachurchas definedin this section. 8.“College”or“university”meansaneducationalinstitutionofhigherlearningwhichoffers acourseofstudiesdesignedtoculminateintheissuanceofadegreeordefinedbySection 94302oftheEducationCodeof theStateofCalifornia,or successorlegislation. 9.“Commercialrecreation”meansauseprovidingrecreation,amusement,orentertainment services,includingtheaters,bowlinglanes,billiardparlors,skatingarenas,andsimilar services,operatedonaprivateorfor-profitbasis,butexcludingusesdefinedasoutdoor recreationservices. 10.“Community center”means a place, structure, area,orotherfacilityusedfor andproviding religious,fraternal,socialand/orrecreationalprogramsgenerallyopentothepublicand designated to accommodate andserve a significant segmentofthe community. 11.“Communityhousingproject”meansacondominiumprojectasdefinedinSection135of theCaliforniaCivilCode, a community apartmentproject as definedinSection 11004ofthe CaliforniaBusinessandProfessionsCode,containingtwoormorerightsofexclusive occupancy,orastockcooperative,asdefinedinSection11003.2oftheCaliforniaBusiness andProfessionsCode,containingtwoormore separatelyownedlots,parcelsor areas. 12.“Congregateresidence”meansanybuildingorportionthereofwhichcontainsfacilitiesfor living,sleepingandsanitation,asrequiredpursuanttotheUniformBuilding,Housingand FireCodesandmayincludefacilitiesforeatingandcookingfornontransientoccupancy primarilybypersonseighteenyearsoldandolder,inwhichtheresponsibilitiesforrent, housekeeping,cookingandotherhouseholdmaintenancechoresaresharedamongthe occupants. 13.“Convalescentfacility”meansauseotherthanaresidentialcarehomeprovidinginpatient servicesforpersonsrequiringmedicalattention,butnotprovidingsurgicaloremergency medicalservices. 14.“Conveniencemarket”meansauseoractivitythatincludestheretailsaleoffood, beverages,andsmallpersonalconvenienceitems,includingsaleoffoodindisposable containersprimarilyforoff-premisesconsumption,andtypicallyfoundinestablishments withlongorlatehoursofoperationandinrelativelysmallbuildings,butexcluding delicatessensandotherspecialtyfoodshopsandestablishmentswhichhaveasizable assortmentoffreshfruits, vegetables,andfresh-cutmeats. 15.“Conversion”meansachangeinthetypeofownershipofaparcel(orparcels)ofland, togetherwiththeexistingattachedstructures,tothatdefinedasacommunityhousing project,regardlessofthepresentorprioruseofsuchlandandstructuresandwhether substantialimprovementshavebeenmadeor areto be made to such structure. 16.“Corner triangle”meansa triangular-shaped areabounded by: 1a.Theintersectionofthe tangential extensionoffront andendpropertylines as formedby theintersectionoftwopublicrights-of-wayabuttingthe saidpropertylines; and 2b.Thethirdboundaryofthetriangular-shapedareashallbealineconnectingthefront andsidepropertylinesatadistanceoffortyfeetfromtheintersectionofthetangential extensionoffrontandsidepropertylines. 17.“Court”meansanopen,unoccupiedspace,otherthanayard,onthesamelotwitha buildingorbuildingsandwhichisboundedontwoormoresidesbysuchbuildingor buildings,includingtheopen spaceinahousecourtor court apartmentprovidingaccess. 18.“Coveredparking”meansacarportorgaragethatprovidesfulloverheadprotectionfrom theelementswithordinaryroofcoverings.Canvas,lath,fiberglassandvegetationarenot ordinarilyroof coverings and cannot be usedinprovidinga coveredparking space. D.“D”Definitions: 1.“Daycarecenter”meansanychilddaycarefacility,licensedbytheStateorCounty,other thanafamilydaycarehome,andincludesinfantcenters,preschools,andextendedday carefacilities. a.DayCareHome,Family.“Familydaycarehome”meansahome,licensedbytheState orCounty,whichregularlyprovidescare,protectionandsupervisionoftwelveor fewerchildren,intheprovider’sownhome,forperiodsoflessthantwenty-fourhours perday,whiletheparentsor guardian areaway,andincludes thefollowing: i.“Large-familydaycarehome,”whichmeansahomewhichprovidesfamilyday caretoseventotwelvechildren,inclusive,includingchildrenundertheageoften yearswhoreside at thehome; ii.“Small-familydaycarehome,”whichmeansahomewhichprovidesfamilyday caretosixorfewerchildren,includingchildrenundertheageofsixteenyearswho reside at thehome. 2. “Developer”meanstheownerorsubdividerwithacontrollingproprietaryinterestinthe proposedcommunityhousingproject,orthepersonororganizationmakingapplication thereunder. 3.“DevelopmentPermit”meansapermitissuedbytheCityCouncil,PlanningCommission, DesignReviewCommittee,DirectorofCommunityDevelopment,oranyotherdecision bodyasempoweredbytheCupertinoMunicipalCode,approvingarchitecture,site improvements, buildings,structures,landand/oruses.DevelopmentPermitsmayinclude but shallnot be limitedtoAdministrativeApprovals,Two-storyPermits, MinorResidential Permits,ArchitecturalandSiteApprovals,PlannedDevelopmentPermits,ConditionalUse Permits,Exceptions,VariancesorSubdivisionMaps. 4.“District”meansaportionoftheterritorywithintheCitywithinwhichcertainusesof land,premisesandbuildingsarepermittedandcertainotherusesofland,premisesand buildingsareprohibited,andwithinwhichcertainyardsandotheropenspacesare requiredandcertainbuildingsiteareasareestablishedforbuildings,allassetforthand specifiedinthis title. 5.“Drinkingestablishment”meansanactivitythatisprimarilydevotedtothesellingof alcoholicbeveragesforconsumptiononthepremises. 6.“Drive-throughestablishment”meansanactivitywhereaportionofretailingorthe provisionofservicecanbeconductedwithoutrequiringthecustomertoleavehisorher car. 7.Driveway,Curved.“Curveddriveway”meansadrivewaywithaccesstothefront propertylinewhichentersthegaragefromthesideatanangleofsixtydegreesorgreater tothefrontcurblineandwhichcontainsafunctionaltwenty-foot-deepparkingareathat doesnotoverhang thefrontpropertyline. 8.“Duplex”meansabuildingcontainingnotmorethantwokitchens,designedandusedto housenotmorethantwofamilieslivingindependentlyof eachother. 9.“Dwellingunit”meansaroomorgroupofroomsincludingliving,sleeping,eating, cookingandsanitationfacilities,constitutingaseparateandindependenthousekeeping unit,occupiedorintendedforoccupancybyonefamilyonanontransientbasisandhaving notmorethanone kitchen. E.“E”Definitions: 1.EmergencyShelter a.“Emergencyshelter,rotating”meansafacilitythatprovidestemporaryhousingwith minimalsupportiveservices.Suchsheltersshallbelimitedtoatimeperiodoftwo monthsinatwelve-monthperiodatanysinglelocationandshallmeetcriteriain Section19.64.040(A). b.“Emergencyshelter,permanent”meansafacilitythatprovidestemporaryhousing withminimalsupportiveservicesthatislimitedtooccupancyofsixmonthsorless. SuchsheltersmaybepermanentlyoperatedandshallmeetcriteriainSection 19.64.040(B). 2.“Enclosed”meansacoveredspacefullysurroundedbywalls,includingwindows,doors andsimilaropeningsorarchitecturalfeatures,oranopenspaceoflessthanonehundred squarefeetfullysurrounded by a buildingorwalls exceeding eightfeetinheight. 3.“Entryfeature”means astructural element,whichleads to an entrydoor. 4.“Equestriancenter”meansafacilityfortheshelter,display,exhibition,keeping,exerciseor ridingofhorses,poniesormules,orvehiclesdrawnbysuchanimals,withrelatedpasture lands,corralsand trails. 5.“Equipmentyard”meansauseprovidingformaintenance,servicingorstorageofmotor vehicles,equipmentorsupplies;orfor thedispatchingofservice vehicles;ordistributionof suppliesorconstructionmaterialsrequiredinconnectionwithabusinessactivity,public utilityservice,transportationservice,orsimilaractivity,includingbutnotlimitedto,a constructionmaterial yard, corporation yard,vehicular servicecenteror similaruse. F. “F” Definitions: 1.“Facility”means astructure, buildingorotherphysicalcontrivanceorobject. a.“Accessoryfacility”meansafacilitywhichisincidentalto,andcustomarilyassociated withaspecifiedprincipalfacilityandwhichmeetstheapplicableconditionssetforth inChapter 19.80. b.“Noncomplyingfacility”meansafacilitywhichisinviolationofanyofthesite developmentregulationsorotherregulations established by thistitle,butwaslawfully existingonOctober10,1955,oranyamendmenttothistitle,ortheapplicationofany districttothepropertyinvolvedbyreasonofwhichtheadoptionorapplicationthe facilitybecomesnoncomplying.(Forthedefinitionfor“nonconforminguse”seethe definition “use”inthischapter.) c.“Principalfacilities”meansamainbuildingorotherfacilitywhichisdesignedand constructedfororoccupied by a principaluse. 2.“Family”meansanindividualorgroupofpersonslivingtogetherwhoconstituteabona fidesinglehousekeepingunitinadwellingunit.“Family”shallnotbeconstruedto includeafraternity,sorority,club,orothergroupofpersonsoccupyingahotel, lodginghouse,orinstitutionof anykind. 3.“Familydaycarehome”meansahomewhichregularlyprovidescare,protection, supervisionofchildreninthehomeforperiodsoflessthantwenty-fourhoursaday,while theparentsor guardiansare away. 4.“Firstfloor”meansthatportionofastructurelessthanorequaltotwentyfeetinheight, throughwhichaverticallineextendingfromthehighestpointofexteriorconstructionto the appropriate adjoining grade,passesthroughone story. 5.“Floor area”meansthetotal areaofallfloorsofabuildingmeasured totheoutside surfaces of exteriorwalls,andincludingthefollowing: a.Halls; b.Baseofstairwells; c.Baseofelevatorshafts; d.Servicesandmechanicalequipmentrooms; e.Interiorbuildingareaabovefifteenfeetinheightbetweenanyfloorlevelandthe ceilingabove; f.Basementswithlightwells thatdonotconform toSection19.28.060F; g.Inallzonesexceptresidential,permanentlyroofed,buteitherpartiallyenclosedor unenclosed buildingfeaturesusedfor sales, service,display, storageor similaruses. 6.“Floor area”shallnotinclude thefollowing: a.Basementswithlightwellsthat conform toSection 19.28.060F; b.Lightwells; c.Attic areas; d.Parkingfacilities,otherthanresidentialgarages,accessorytoapermittedconditionaluse andlocatedon the samesite; e.Roofedarcades,plazas,walkways,porches,breezeways,porticos,courtsandsimilar featuresnotsubstantially enclosed by exteriorwalls. 7.“Floorarearatio”meansthemaximumratioofgrossfloorareaonasitetothetotalsite area. 8.“Frontwall”meansthewallofabuildingorotherstructurenearestthestreetuponwhich the buildingfaces, but excludingcertain architecturalfeatures as definedin thischapter. 9.“Fullcashvalue”hasthemeaningassignedtoitintheCaliforniaRevenueandTaxation Codeforproperty taxationpurposes. G.“G”Definitions: 1.“Garage”meansanaccessorybuilding(completelyclosed)usedprimarilyforthestorage ofmotor vehicles. 2.“Grade”or“finishedgrade”meansthelowestpointofadjacentgroundelevationofthe finishedsurfaceofthegroundpaving,orsidewalk,excludingareaswheregradehasbeen raisedbymeansofaberm,planterbox,orsimilarlandscapingfeature,unlessrequiredfor drainage,withintheareabetweenthebuildingandthepropertyline,orwhentheproperty lineismorethanfivefeetfromthebuilding,betweenthebuildingandalinefivefeetfrom the building. 3.“Grosslotarea”meansthehorizontalareaincludedwithinthepropertylinesofasiteplus thestreetareaboundedbythestreetcenterlineuptothirtyfeetdistantfromtheproperty line, thestreetright-of-waylineand the extendedside yard tothe streetcenterline. 4.“Group care activities”means a residential carefacilityproviding continuous carefor sixor fewerpersonsonatwenty-four-hourbasis,whichrequireslicensingbyagovernmental agency. 5.“Guestroom”meansaroomwhichisintended,arrangedordesignedtobeoccupiedby occasionalvisitorsornonpayingguestsoftheoccupantsofthedwellingunitinwhichthe roomislocated,andwhich containsno kitchenfacilities. H.“H”Definitions: 1.“Habitablefloor”meansthehorizontalspacebetweenafloorareaofatleastseventy squarefeetandtheceilingheightmeasuringatleastsevenfeetsixinchesaboveit,except for a kitchenwhichshallhave aceilingheightnotlessthansevenfeetabove saidfloor. 2.“Habitablespace”meansspaceinastructureforliving,sleeping,eatingorcooking. Bathrooms,toiletcompartment,closets,halls,storageorutilityspaceandsimilarareasare not consideredhabitablespace. 3.“Heavyequipment”meansanymechanicalormotorizeddevicethatisnotavehicleora commercialvehicleasdefinedin19.08.030(V),including,butnotlimitedto,abackhoe, cementmixer,crane,ditchwitch,dozer,earthmover,generator,grader,tractororany similardevice. 4.“Height”meansa verticaldistance measuredparallelto thenaturalgradetothe highestpointof exteriorconstruction, exclusiveofchimneys, antennasorother appurtenances,except thatentryfeaturesare measuredtothetopof thewallplate. Heightrestrictionshall beestablishedby establishingaline HeightLimitforEntryFeatures paralleltothenatural grade. 5. “Homeoccupation”means an accessory activity conductedin a dwellingunit solely by the occupantsthereof,inamannerincidentaltoresidentialoccupancy,inaccordwiththe provisionsofthistitle.(Forfurtherprovisions,seeregulationsforhomeoccupationin Chapter 19.92.) 6.“Hospital”meansafacilityforprovidingmedical,psychiatricorsurgicalservicesforsick orinjuredpersons,primarilyonaninpatientbasis,andincludingancillaryfacilitiesfor outpatientandemergencytreatment,diagnosticservices,training,research, administration,and service topatients, employeesor visitors. 7.“Hotel”meansafacilitycontainingroomsorgroupsofrooms,generallywithout individualkitchenfacilities,usedorintendedtobeusedbytemporaryovernight occupants,whetheron atransientorresidentialoccupancybasis,andwhetherornot eating facilitiesareavailableonthepremises.Hotelincludesmotel,motorhotel,touristcourt,or similaruse,butdoesnotincludemobilehomeparksor similaruses. 8.“Householdpets”meanssmallanimalscommonlyfoundinresidentialareassuchas chickens,ducks,geese,rabbits,dogs, andcats,butexcludinganimalssuchasanybovineor equineanimal,oranygoat,sheeporswine.Thistitledoesnotregulatethekeepingof smallhouseholdpets,suchasfish,birdsorhamsters,whichisincidentaltoanypermitted use. I.“I”Definitions: None. J.“J”Definitions: 1.“Junkyard”meanstheuseofmorethantwohundredsquarefeetoftheareaofanylotfor thestorageorkeepingofjunk,includingscrapmetalsorotherscrapmaterial,and/orfor thedismantlingorwreckingof automobilesorother vehiclesormachinery. K.“K”Definitions: 1.“Kitchen”meansanareainhabitablespaceusedforthepreparationoffoodandincluding atleastthreeof thefollowing: a.Cookingappliance(s)orprovisionforacookingappliance(suchas220Voutlets,gas connectionsand spacefor appliances between counters; b.Counter; c.Refrigerator; d.Sink. L.“L”Definitions: 1.“Landscaping”meansanareadevotedtoordevelopedandmaintainedwithnativeor exoticplanting,lawn,groundcover,gardens,trees,shrubs,andotherplantmaterials, decorativeoutdoorlandscapeelements,pools,fountains,waterfeatures,pavedor decoratedsurfacesofrock,stone,brick,blockorsimilarmaterial(excludingdriveways, parking,loadingor storage areas),andsculpturalelements. 2.“Lateeveningactivities”meansanactivitywhichmaintainsanyhoursofoperationduring theperiodof elevenp.m. to seven a.m. 3.“Legal substandardlot”means anyparceloflandorlotrecorded andlegally created by the CountyorCitypriortoMarch17,1980,whichlotorparcelisoflessareathanrequiredin thezone;orlotsorparcelsofrecordwhicharereducedtoasubstandardlotsizeasaresult ofrequiredstreetdedicationunlessotherwiseprovidedintheCityofCupertinoGeneral Plan.Theownerofalegallycreated,substandardpropertywhichislessthansixthousand squarefeetbutequaltoorgreaterthanfivethousandsquarefeetmayutilizesuchparcel forresidentialpurposes.Theownerofalegallycreatedparceloflessthanfivethousand squarefeetmayalsodevelopthesiteasasingle-familyresidentialbuildingsiteifitcanbe demonstratedthatthepropertywasnotunderthesameownershipasanycontiguous propertyon thesame streetfrontage as ofor afterJuly 1, 1984. 4.“Lightwell”meansanexcavatedarearequiredbytheUniformBuildingCodetoprovide emergency egress,lightand ventilationfor belowgraderooms. 5.“Liquor store”means a userequiring a StateofCalifornia “off-sale generallicense”(salefor off-siteconsumptionofwine,beerand/orhardliquor)andhavingfiftypercentormoreof the totaldollarsalesaccountedfor bybeverage coveredunder theoff-salegenerallicense. 6.“Living space”meanshabitable spaceandsanitation. 7.“Loadingspace”meansanareausedforloadingorunloadingofgoodsfromavehiclein connectionwith theuseof thesiteonwhichsuch spaceislocated. 8.“Lodging”meansthefurnishingofroomsorgroupsofroomswithinadwellingunitoran accessorybuildingtopersonsotherthanmembersofthefamilyresidenceinthedwelling unit,forovernightoccupancyonaresidentialoccupancybasis,whetherornotmealsare providedtosuchperson.Lodgingshallbesubjecttotheresidentialdensityrequirements of thedistrictinwhichtheuseislocated. 9.“Lodgingunit”meansaroomorgroupofroomsnotincludingakitchen,usedorintended forusebyovernightoccupantsasasingleunit,whetherlocatedinahoteloradwelling unitprovidinglodgingwheredesignedorusedforoccupancybymorethantwopersons; eachtwo-personcapacityshallbedeemedaseparatelodgingunitforthepurposeof determiningresidentialdensity;eachtwolodgingunitsshallbeconsideredtheequivalent ofonedwellingunit. 10.“Lot”or“site”meansaparceloflandconsistingofasinglelotofrecord,usedorintended foruseunder theregulationsof this title as onesitefor a useor a groupofuses. a.“Cornerlot”meansalotsituatedattheintersectionoftwoormorestreets,orbounded on twoormore adjacentsides by streetlines. b.“Flaglot”means a lothavingaccess to a street bymeansofaprivatedrivewayorparcel oflandnototherwisemeetingtherequirementofthistitleforlotwidth. c.“Interiorlot”means a lotother thana cornerlot. d. “Keylot”meansthefirstlottotherearofacornerlot,thefrontlineofwhichisa continuationofthe sidelineofthecornerlot, andfrontingonthestreetwhichintersects orinterceptsthestreetonwhichthe cornerlotfronts. e.“Lotarea”meanstheareaofalotmeasuredhorizontallybetweenboundarylotlines, butexcludingaportionofaflaglotprovidingaccesstoastreetandlyingbetweena frontlotlineandthestreet,andexcludinganyportionofalotwithinthelinesofany naturalwatercourse,river,stream,creek,waterway,channelorfloodcontrolor drainageeasementandexcludinganyportionofalotwithinastreetright-of-way whether acquiredinfee,easementorotherwise. 11.“Lot coverage”meansand encompassesthefollowing: a. “Single-familyresidentialuse”meansthetotallandareawithinasitethatiscoveredby buildings,includingallprojections,butexcludingground-levelpaving,landscape features,lightwells,andopenrecreationalfacilities. b. “Allotherusesexceptsingle-familyresidential”meansthetotallandareawithinasite thatiscoveredbybuildings,excludingallprojections,ground-levelpaving,landscape features,andopenrecreationalfacilities. 12.“Lotdepth”meansthehorizontaldistancefromthemidpointofthefrontlotlinetothe midpointoftherearlotline,or to themostdistantpointon anyotherlotlinewhere thereis no clearrearlotline. 13.“Lotline”meansany boundaryof a lot. a.“Frontlotline”meansonaninteriorlot,thelotlineabuttingastreet,oronacornerlot, theshorterlotlineabuttingastreet,oronaflaglot,theinteriorlotlinemostparallelto andnearestthe streetfromwhich accessisobtained. b. “Interiorlotline”meansanylotlinenotabutting a street. c. “Rearlotline”meansthelotlinenotintersectingafrontlotlinewhichismostdistant fromandthemostcloselyparalleltothefrontlotline.Alotboundedbyonlythreelot lineswillnothave a rearlotline. d. “Sidelotline”meansanylotlinewhichisnotafrontorrearlotline. e. “Streetlotline”means anylotline abuttinga street. 14.“Lotofrecord”meansalotwhichispartofasubdivisionrecordedintheofficeofthe CountyRecorder,oralotorparceldescribedbymetesandboundswhichhasbeen recorded. 15.“Lotwidth”meansthehorizontaldistancebetweensidelotlines,measuredattherequired front setbackline. M.“M”Definitions: 1.“Manufacturing”meansauseengagedinthemanufacture,predominantlyfrom previouslypreparedmaterials,offinishedproductsorparts,includingprocessing fabrication,assembly,treatment,packagingofsuchproducts,butexcludingbasic industrialprocessingofextractedorrawmaterials,processesutilizinginflammableor explosivematerial(i.e.,materialswhichigniteeasilyundernormalmanufacturing conditions),andprocesseswhichcreatehazardousorcommonlyrecognizedoffensive conditions. 2.“Massage”meansanymethodofpressureonorfrictionagainstorstroking,kneading, rubbing,tapping,pounding,vibratingorstimulatingtheexternalpartsofthehumanbody withthehandsorwithanymechanicalorelectricalapparatusorotherappliancesor deviceswithorwithoutsuchsupplementaryaidesasrubbingalcohol,liniment,antiseptic, oil,powder,cream,lotion,ointmentorothersimilarpreparations. 3.“Massageparlor”meansabuildingorportionthereof,oraplacewheremassageis administeredforcompensationorfromwhichamassagebusinessorservicefor compensationisoperatedwhichisnotexemptedorregulatedbytheMassage EstablishmentOrdinanceascontainedinTitle9,HealthandSanitationoftheCupertino MunicipalCode,Chapter 9.06. 4.“Mobilehome”meansavehicle,otherthanamotorvehicle,designedorusedas semipermanenthousing,designedforhumanhabitation,for carryingpersons andproperty onitsownstructure,andforbeingdrawnbyamotorvehicle,andshallincludeatrailer coach. 5.“Mobilehomepark”meansanyareaortractoflandwherelotsaresold,rented,orheldout forrenttooneormoreownersorusersofmobilehomes,excludingtravel-trailers,forthe purposeofpermanentor semipermanenthousing. 6.“Multiple-familyuse”meanstheuseofasiteforthreeormoredwellingunitswhichmay beinthesame buildingorin separatebuildingson the samesite. N.“N”Definitions: 1.“Naturalgrade”meansthecontourofthelandpriortoimprovementsordevelopment, unlessotherwiseestablishedbyacityapprovedgradingplanthatispartofasubdivision map approval. 2.“Netlotarea”meansthetotalareaincludedwithinthepropertylinesofasite,excluding thefollowing: a.Anyportionof a sitewithin theright-of-wayofan existingpublic street; b.Theportionofaflaglotconstitutingtheaccesscorridorlyingbetweenthefrontproperty lineandthefrontagelineof the corridor at the street; c.Thefullwidthofanylegal easementusedforaccesspurposes. 3.“Nightclub”meansanestablishmentprovidingalcoholicbeverageservice andlateevening (past elevenp.m.)entertainment,withorwithoutfood service. O. “O”Definitions: 1.“Office”means: a.“Administrativeorexecutiveoffices”includingthosepertainingtothemanagementof officeoperationsorthedirectionofenterprisebutnotincludingmerchandisingorsales services. b.“Medicaloffice”meansauseprovidingconsultation,diagnosis,therapeutic, preventativeorcorrectivepersonaltreatmentservicesbydoctors,dentists,medicaland dentallaboratories,andsimilarpractitionersofmedicalandhealingartsforhumans, licensedforsuchpracticebytheStateofCaliforniaandincludingservicesrelatedto medicalresearch, testing andanalysis. c. “Professionaloffices”suchasthosepertainingtothepracticeoftheprofessionsandarts including,butnotlimitedto,architecture,dentistry,engineering,lawandmedicine, butnotincludingsaleofdrugsorprescriptionsexceptasincidentaltotheprincipal uses andwherethereisexternal evidenceof suchincidentaluse. 2.“Offset”meanstheindentationorprojectionofawallplane. 3.“Open”meansaspaceonthegroundorontheroofofastructure,uncoveredand unenclosed. 4.“Organizationaldocuments”meansthedeclarationofrestrictions,articlesofincorporation, bylawsandanycontractsforthemaintenance,managementoroperationofalloranypart of a communityhousingproject. 5.“Outdoorrecreationuse”meansaprivatelyownedoroperateduseprovidingfacilitiesfor outdoorrecreationactivities,includinggolf,tennis,swimming,ridingorotheroutdoor sportorrecreation,operatedpredominantlyintheopen,exceptforaccessoryorincidental enclosed servicesorfacilities. P.“P”Definitions: 1.“Park”meansanyopenspace,reservation,playground,swimmingpool,golfcourse, recreationcenter,oranyotherareaintheCityownedorusedbytheCityorCountyand devoted to activeorpassiverecreations. 2.“Parkingarea”meansanunroofed,pavedarea,delineatedbypaintedorsimilarmarkings, intendedanddesignedto accommodateoneormore vehicles. 3.“Parkingfacility”meansanareaonalotorwithinabuilding,orboth,includingoneor moreparkingspaces,togetherwithdriveways,aisles,turningandmaneuveringareas, clearancesandsimilarfeatures,andmeetingtherequirementsestablishedbythistitle. Parkingfacilityincludesparkinglots, garagesandparking structures. 1a.“Temporaryparkingfacility”meansparkinglotswhich arenotrequiredunder this title andwhichareintendedasinterimimprovementsofpropertysubjecttoremovalata laterdate. 4.“Parkingspace”meansanareaonalotorwithinabuilding,usedorintendedforusefor parkingamotorvehicle,havingpermanentmeansofaccesstoandfromapublicstreetor alleyindependentlyofanyotherparkingspace,andlocatedinaparkingfacilitymeeting therequirementsestablishedbythistitle.Parkingspaceisequivalenttotheterm“parking stall”anddoesnotincludedriveways,aislesorotherfeaturescomprisingaparkingfacility aspreviouslydefinedinthischapter. 5.“Personalfitnesstrainingcenter”meansafacilityprovidingspaceandequipment,withor withoutsupervision,forgrouporindividualathleticdevelopment,increasedskill developmentin sports activity,orrehabilitativetherapyfor athleticinjury. 6.“Picnicarea”meansafacilityprovidingtablesandcookingdevicesforpreparationand consumptionofmealsoutofdoorsorwithinanunenclosedshelter structure. 7.“Practicerange”meansafacilityprovidingcontrolledaccesstofixedormovableobjects which areused to testandmeasure accuracyofdischargefrom a weapon. 8.“Privateeducationalfacility”meansaprivatelyownedschool,includingschoolsowned andoperatedbyreligiousorganizations,offeringinstructionintheseveralbranchesof learning and studyrequired to be taughtin thepublic schools by theEducationCodeofthe StateofCalifornia. 9.“Professionaloffice”meansauseprovidingprofessionalorconsultingserviceinthefields oflaw,architecture,design,engineering,accounting,andsimilarprofessions,including associatedtestingandprototypedevelopment,butexcludingproductmanufacturingor assembly. 10.“Projectimprovements”meansallpublicroadimprovements,undergroundingutility improvements,andimprovementstotheon-siteutilitynetworksasrequiredbytheCityof Cupertinofor a communityhousingproject. 11.“Projection”meansarchitecturalelements,notpartofthemainbuildingsupport,that cantileversfromasinglebuildingwallorroof,involvingnosupportstothegroundother than theonebuildingwallfromwhich the elementprojects. 12.“Property”meansrealpropertywhichincludesland,thatwhichisaffixedtotheland,and thatwhichisincidentalorappurtenanttothelandasdefinedinCivilCodeSections658 through 662. a.Property,Adjoining.“Adjoiningproperty”meansanyunitofrealproperty,excluding landsusedaspublicstreets,sharingoneormorecommonpointswithanother property. 13.“Provider”meansapersonwhooperatesachilddaycarehomeandislicensedbytheState ofCalifornia. 14.“Publicdancehall”isabuildingorportionthereofusedfordancingpurposestoandin whichthegeneralpublicisadmittedandpermittedtodance,uponpaymentofanyfee otherthancompensation,oruponpaymentofachargeforadmission,orforwhichtickets orotherdevices are sold,orinwhich a chargeismadefor theprivilegeofdancingwith any otherpersonemployedforsuchpurposebytheoperatorofsuchestablishment,including butnotlimitedtotaxidances,butexcludingrestaurants,hotelroomsandnightclubsin which thedancingisincidentalonlytootherentertainment. Q. “Q”Definitions: None. R.“R”Definitions: 1. “Recreationalopenspace”meansopenspacewithinacommunityhousingproject (exclusiveofrequiredfrontsetbackareas)whichshallbeusedexclusivelyforleisureand recreationalpurposes,fortheuseandenjoymentofoccupants(andtheirvisitors)ofunits ontheprojectandtowhichsuchoccupants(andtheirvisitors)havetherightofuseand enjoyment.Accessorystructuressuchasswimmingpools,recreationalbuildingsand landscaped areasmay beincluded as open space. 2.“Recyclingcenter”meansfacilitiesappurtenantandexteriortoanotherwisealloweduse, whichareutilizedforcollectionofrecyclablematerialssuchasmetal,glass,plastic,and paperstoredinmobilevehiclesortrailers,permanentstorageunits,orinbulkreverse- vendingmachinesexceedingfifty cubicfeetinsize. 3.“Religiousinstitution”meansaseminary,retreat,monastery,conferencecenter,orsimilar usefortheconductofreligiousactivitiesincludingaccessoryhousingincidentalthereto, butexcludingaprivateeducationalfacility.Anysuchuseforwhichapropertytax exemptionhasbeenobtainedpursuanttoSection3(f)ofArticleXIIIoftheConstitutionof theStateofCaliforniaandSection206oftheRevenueandTaxationCodeoftheStateof California,orsuccessorlegislation,orwhichisusedinconnectionwithanychurchwhich hasreceived suchan exemption,shall be primafaciepresumed to be areligiousinstitution. 4.“Residentialcarefacility”meansabuildingorportionthereofdesignedorusedforthe purposeofprovidingtwenty-four-hour-a-daynonmedicalresidentialliving accommodationspursuanttotheUniformBuilding,HousingandFireCodes,inexchange forpaymentofmoneyorotherconsideration,wherethedurationoftenancyisdetermined, inwholeorinpart,bytheindividualresident’sparticipationingrouporindividual activitiessuchascounseling,recoveryplanning,medicalortherapeuticassistance. Residentialcarefacilityincludes,butisnotlimitedto,healthfacilitiesasdefinedin CaliforniaHealthandSafetyCode(H&SC)Section1250etseq.,communitycarefacilities (H&SCSection1500etseq.),residentialcarefacilitiesfortheelderly(H&SCSection1569et seq.),andalcoholismordrugabuserecoveryortreatmentfacilities(H&SCSection 11384.11),andother similar carefacilities. 5.Restaurant: a.Restaurant, Fast-Food.“Fast-foodrestaurant”means a retailfood serviceestablishment inwhichpreparedfoodsorbeveragesareservedorsoldonorindisposablecontainers, includingthoseestablishmentswhereasubstantialportionofthepatronsmayserve themselvesandmayconsumethefoodandbeveragesoff-site.Aseparatebarfacility forservingalcoholicbeveragesisnotpermitted.Anyarea,tablesorroomsreservedfor servingalcoholicbeveragesshallbeconsideredaseparatebarfacility.Specialtyfood stores,suchasicecreamstores,bakeriesorshops,shallnotbeconsideredfast-food restaurants. b.Restaurant,FullService.“Full-servicerestaurant”meansanyrestaurantwhichisnota fast-foodrestaurant.Alcoholicbeveragesmaybeservedwithmealsatacustomer’s diningtable;however,aseparatebarfacilityforservingalcoholicbeveragesisnot permittedwithout a usepermit.
