Exhibit CC 01-18-2011 Item No. 3 Coffee Society Lease Cupertino Chamber of Commerce 3 C .- cc iiiiiiD Your Partner in Silicon Valley Cupertino City Council January 18, 2011 10300 Torre Avenue Cupertino, CA 95014 Dear Mayor Wong and Council Members Santoro, Wang, Chang, and Mahoney, At the directive of the Cupertino Board of Directors, I am writing to officially express our collective and unanimous dismay and disapproval at the outcome of the vote by the Council on January 4th to reopen the bid process with respect to the 10800 Torre Avenue site. We urge you to reverse your decision and counter - execute the lease agreement with Coffee Society as recommended by City staff. While Coffee Society is not currently a member of the Cupertino Chamber, it is our obligation to speak not only for our members, but to address City processes and policy issues as they affect business in Cupertino. As we understand it, the bid process was well advertised and noticed and all interested parties were clearly aware that the bid process was open. The bid process, which has been in place for years, has generally served the City very well and certainly any legitimate business owner either understands the process, or can with a little effort, get up to speed on the process. It is not the obligation of the Council or City staff to "court" specific business owners or to hand -hold them through the process. It is critical that local government exhibit fairness, transparency, and consistency when dealing with business. For companies to make crucial decisions, such as expanding and relocating, governmental leaders must treat members of the private sector with a high degree of professionalism and consistently apply the policies of the City. The Chamber feels neither was the case with the Council's action relative to the Coffee Society. This decision, and the resulting negative publicity, present a picture of a city that has an unwelcoming attitude towards business and is capable of acting in an unfair manner. Additionally, accusations against City staff in a public forum seem particularly ill- advised and unwarranted. We believe that the actions of Council will result not only in needless expense and additional staff time, but will put in question the validity of the bid process for future projects, and likely open the City to the potential of litigation. The Chamber of Commerce would like the Council to reconsider the position and award the lease to Coffee Society as originally signed and agreed upon by both parties. Thank you for your consideration in this very important matter.
