RecommendedAction StaffrecommendstheCityCouncilintroducetheordinancetorevisethereconsideration procedures. Description Cupertino MunicipalCodeSection 2.08.096 dealswithreconsideration ofitemsbytheCity Councilattherequest ofamember ofthe public.The provision,firstintroducedin 1999 was revisedin 2007 and 2008.Whenthe sectionwasrevisedin 2007, therevisionrequiredmailed noticebytheClerkandthatthe petition befiled“within 10 days ofthedate ofmailing.”In addition, such petitionsweremade subjecttoafee. The 2008 amendmentaddedthe possibility ofarefund ofthepetitionfee. Overthe pastseveralyears,reconsideration has beenrequested on a number ofmattersandthe process hasbeentimeconsumingfortheCityCouncil, staff,applicants,petitionersand interested parties.Asaresult,revisionsare proposedtoimprovethe operationalaspects of reconsideringanitem. The proposedchangesincludemodifyingthe publicreconsideration provisionto provideinitial reviewanddeterminationbya subcommitteeappointedbytheCityCouncil.Onlyifthe subcommittee determinesthatatleast one ofthecriteria specifiedin 2.08.096 has beenaddressed willthematter bereferredtotheCityCouncilforareconsideration hearing.Ifthe petition does notmeettheminimum standard,asdeterminedbythe subcommittee,the petitionwill be denied. Discussion Thechanges: 1.ClarifythattheCityClerkistomail noticestotheapplicant orappellant. 2.Clarifythetimeperiodwithinwhicha petitionforreconsiderationmust befiled.Fifteen(15) calendar days should bea sufficienttime periodand shouldrunfromthedate of decision. 3.Clarifythetimeperiodwithinwhicha decision on reconsiderationmust bemade. The currentlanguagecallsforthematterto be scheduledwithin sixty(60)calendar days ofthe petition beingfiled;additionallanguagecallsforthematterto beconcludedwithin sixty(60) calendar days oftheendofthe new hearing. Thenewlanguagewillrequirea decisionbythe subcommitteewithinthirty(30)daysandafinaldecisionbytheCityCouncil no laterthan sixty (60) daysafterfilingthepetition,intheeventtheitemisreferredtotheCityCouncil. 4.Adda provision providingforaninitialreviewofthewrittenmaterialinthe petition,bya CityCouncil subcommittee,fora determination ofwhetheratleast one ofthecriteriaismet.In theevent no criteriaarefound,thereconsideration hearing shall notgoforward.Ifafteran initialreview,the subcommitteefindsatleast onecriterionismet;a dateshall be setforafull CityCouncilreview ofthe petition on themerits. _____________________________________ Preparedby:TeresaZueger Reviewedby:DavidW.Knapp ApprovedforSubmissionby:DavidW.Knapp,CityManager Attachments:
