102-Draft Ordinance.pdf ORDINANCENO. 11-____ ANORDINANCEOFTHECITYCOUNCILOFTHECITYOFCUPERTINO AMENDINGCHAPTER 2.08.096 OFTHECUPERTINO MUNICIPALCODE REGARDINGRECONSIDERATION-SOUGHTBY INTERESTED PERSON THECITYCOUNCILOF THECITYOFCUPERTINODOESHEREBY ORDAINASFOLLOWS: Section 1.Code Amendment.Section 2.08.096 oftheCupertino MunicipalCode is herebyamendedtoreadasfollows: A.Afterthe decision oftheCityCouncil,theCityClerk shallforthwithmailall notices of decisionstothe applicant or appellantafterthedecision oftheCity Council.Anyinterestedperson, priorto seekingjudicialreviewofany adjudicatory decision oftheCityCouncil, shallfilea petitionfor reconsiderationwiththeCityClerkwithinfifteen(15)calendardaysofthe date ofthemailing ofthe notice ofdecision.Failuretofileapetitionfor reconsiderationconstitutesawaiver oftherighttorequestreconsiderationand theCityCouncil’s decision shall befinalforall purposes.Upontimely receipt ofa petitionforreconsideration,theCityClerk shall schedulea reconsideration hearingto becommencedbytheCityCouncil no laterthan sixty(60)daysafter thefiling ofthe petition. Mailed notices ofthe date,time and placeof such hearingwill be provided toallinterested personsatleastten (10) days priortothehearing.Attheconclusionofthe hearingfor reconsideration,theCityCouncilmayaffirm,reverse, ormodifyits original decision,andmayadoptadditionalfindings offact based upon theevidence submittedinanyandallcity hearingsconcerningthematter. B.A petitionforreconsideration shall specify,in detail,eachandeveryground forreconsideration.Failure ofapetitionto specifyanyparticulargroundor groundsforreconsideration precludesthatparticular omitted ground or groundsfrom beingraised orlitigatedina subsequentjudicial proceeding. The groundsforreconsiderationarelimitedtothefollowing: 1.An offer of newrelevantevidencewhich,intheexercise ofreasonable diligence,could not have been producedatanyearliercity hearing. 2.An offer ofrelevantevidencewhichwasimproperlyexcludedatany priorcCityCouncil hearing. 3.Proof offactswhich demonstratethattheCityCouncil proceeded without, orinexcess ofits,jurisdiction. 4.Proof offactswhich demonstratethattheCityCouncilfailedto provideafair hearing. 5.Proof offactswhich demonstratethattheCityCouncilabusedits discretionby: a.Not proceedinginamannerrequiredbylaw;and/or Ordinance No. 11-___Page 2 b.Renderinga decisionwhichwas not supportedbyfindings of fact;and/or c.Renderinga decisioninwhichthefindingsoffactwere not supportedbytheevidence. C.Withinthirty(30)calendar days of receipt of a petitionfor reconsideration a two person subcommittee oftheCityCouncil shall reviewthewrittenmaterial and determineifthecriteriafor reconsideration aremet.Onlyif atleast one ofthecriteriafor reconsiderationismet, shallthematter actually be reconsideredbytheCityCouncil.TheCityClerkshall advisethe petitionerin writing ofthe subcommittee determination. 1.Ifthe subcommitteedeterminesthat one or more ofthecriteria aremet, theCityClerk shall scheduletheitemforCityCouncilconsideration withinforty-five(45)calendar days oftheir decision,which shall be held nolaterthan sixty(60)calendar daysfromthe datethe petitionwasfiled withtheCityClerk.Mailednoticesofthe date,timeand placeof such hearingwillbe providedtothe petitioneratleastten(10)calendar days priortothe hearing. D.Attheconclusion oftheCityCouncil hearingforreconsideration,theCity Councilmay affirm, reverse, or modifyits original decision, and may adopt additionalfindings offact based upon theevidence submittedin anycity hearingsconcerningthematter.TheCityCouncil decision shall befinal shall takefinal actionwithin sixty(60) daysandthat action shall not be subjectto further reconsideration. E.A petitionforreconsiderationis subjecttoareconsiderationfeeas prescribed byresolution oftheCityCouncil.Attheconclusion ofthereconsideration hearing,theCityCouncilmay,inits sole discretion,refundall, ora portion, of thereconsiderationfee. Section 2.Statement of Purpose.TheAmendmentisintendedtoclarifythe proceduralaspects ofthereconsideration process. Section 3.Severability.Shouldany provision ofthisAmendment, orits applicationtoany person orcircumstance, bedeterminedbyacourt ofcompetent jurisdictionto be unlawful, unenforceable or otherwise void,that determination shall have no effect on any other provision ofthisOrdinance ortheapplication ofthis Ordinancetoany otherperson orcircumstanceand,tothatend,the provisions hereofare severable. ThisOrdinance shalltakeeffectthirty daysafter Section 4. EffectiveDate. adoptionas providedbyGovernmentCodeSection 36937. Section 5.Certification.TheCityClerkshallcertifytothepassageand adoptionofthisOrdinanceandshallgivenoticeofitsadoptionasrequiredbylaw.
