RESOLUTION NO. 4509
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING DENIAL OF A
GENERAL PLAN CHANGE FROM VERY LOW DENSITY RESIDENTIAL, 5-20 ACRE SLOPE DENSITY
FORMULA TO VERY LOW DENSITY RESIDENTIAL SEMI-RURAL 5 ACRE SLOPE DENSITY
FORMULA ON APPROXIMATELY 185 NET ACRES KNOWN AS REGNART CANYON
SECTION I: FINDINGS
� WHEREAS, the Planning Commission of the City of Cupertino received an application for a General
Plan Amendment as described on this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Planning Commission has held a meeting to consider the granting of
General Plan Amendment hearing; and
WHEREAS, the Planning Commission considered the potential environmental impacts of the project and
found they were not significant; and
WHEREAS, the Planning Commission finds that the subject General Plan Amendment:
1) Would constitute a spot change in the Hillside Protection Area,
2) Would establish a precedence for other requests for hillside density increases.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for General Plan Amendment is hereby recommended for denial; and
I That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application 2-GPA-93 as set forth in the Minutes
of the Planning Commission Meeting of February 14, 1994, and are incorporated by reference as though
fully set forth herein.
