SUBJECT: Minor Residential Permit Action Letter — Application RM-2011-07:
This letter confirms the decision of the Director of Community Development, given on Apri126,
2011 approving a Minor Residential Permit to allow a portion of a 224 square foot addition to
encroach five (5) feet into the 20 foot rear setback, located at 1087 November Drive, with the
following conditions:
1. APPROVED PROTECT
This approval is based on a plan set drawn by Britt-Rowe entitled, "Anad Residence, 1087
November Dr., Cupertino, CA 95014," consisting of six (6) sheets labeled, "A0.1," "A2,"
"A3," "A4," "A5," and "A6," dated February 25, 2011 with redlines drawn by the architect
dated Apri126, 2011; and a plan sheet drawn by Robert J. Craig entitled, "Topographic Map,
Lot 14, Tract No. 3634...," consisting of one (1) sheet labeled, "A1," dated July 19, 2010 with
redlines drawn by the architect dated April 26, 2011, except as may be amended by
conditions in this resolution.
2. CONSTRUCTION PLAN REVISIONS
Prior to issuance of building permits, the construction plans shall reflect the following
revisions:
a) The northeasterly corner of the rear addition flooring shall be cantilevered 30 inches
beyond the edge of foundation to avoid encroaching into the 2:1 slope stability
protection area established by th� Santa Clara Valley Water District.
b) Demonstrate through building section diagrams that the area projecting outside the
building envelope is the gable end of a roof enclosing an attic space.
c) Identify all existing trees on the property. If any of the trees are on the City's Protected
Tree List, an arborist's report will be required to evaluate potential impacts to them and
recommend preservation measures.
3. GEOLOGIC AND GEOTECHNICAL REVIEW
The project shall incorporate all recommendations set forth in the soils investigation
prepared for the development by Capex Engineering Inc., dated February 20, 2011.

In addition, the project shall incorporate all the following conditions set forth in the geologic
peer review conducted by Cotton, Shires and Associates, Inc., dated March 21, 2011:
a) Geotechnical Plan Review. Prior to issuance of building permits, the applicant's
geotechnical consultant shall review and approve all geotechnical aspects of the
development plans (i.e. site preparation and grading, site drainage improvements and
design parameters for foundations and retaining walls) to ensure that their
recommendations have been properly incorporated.
The results of the geotechnical plan review shall be submitted to the City for review and
approval by City staff prior to approval of building permits.
b) Geotechnical Field Inspection. Prior to final (as-built) project approval, the geotechnical
consultant shall inspect, test (as needed), and approve all geotechnical aspects of the
project construction. The inspections shall include, but not necessarily be limited to: site
preparation and grading, site surface and subsurface drainage improvements and
excavations for foundations and retaining walls prior to the placement of steel and
concrete. The following shall be addressed:
• The project geotechnical consultant shall closely inspect all foundation
excavations to assure that they extend through artificial fill and loose colluvial
soil and achieve sufficient embedment into competent, low-expansion potential
earth materials.
The results of these inspections and the as-built conditions of the project shall be
described by the project geotechnical consultant in a letter and shall be submitted to the
City Engineer for review prior to final (as-built) project approval (final occupancy).
4. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
5. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color,
material, architectural treatments and/or embellishments) shall be reviewed and approved
by the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resemble the details shown on the original approved
plans. Any exterior changes determined to be substantial by the Director of Community
Development shall require a minor modification approval with neighborhood input.
6. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easements and/or construction records. Any
misrepresentation of any property data may invalidate this approval and may require
additional review.
7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS

The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Please be aware that if this permit is not used within one year, it shall expire on Apri126, 2012.
Staff received a letter from the Santa Clara Valley Water District regarding the proposed
addition's encroachment into the recommended 2:1 setback from Regnart Creek prescribed by
the District's Guidelines and Standards for Land Use near Streams. The District recommended a
32 foot setback from the toe of creek bank. The applicant worked with the District and Public
Works Department to modify the plans to cantilever 30 inches of flooring at the northeasterly
corner of the rear addition beyond the edge of the foundation to avoid encroaching into the
slope stability protection area, where the edge of foundation is located approximately 36 feet
from the toe of creek bank.
Staff also received a comment from a neighbor regarding the safety of the neighborhood during
remodeling and whether the proposed gable ends of the roofs above the garage and living room
could be changed to hip roofs. The Sheriff's Office does not particularly increase patrols near
construction projects but can be called at 408-868-6600 to report suspicious activity. The
proposed roof design and articulation of the house are compatible with the existing architecture
and are consistent with the regulations and intent of the R1 Ordinance.
Staff has made all of the findings that are required for approval of a Minor Residential Permit as
required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B). Also, please note that an
appeal of this decision can be made within 14 calendar days from the date of the decision. If
this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.

5. In addition to inspections required by CBC 110, the owner, contractor andlor slructural
engineer of record, acti�g as the owner's agent, shall employ one or more special inspectors or
Testing Agencies, who shall provide "Special Inspections" during the course of construction for
the following types or work per CBC 1704, 1707 or 1708 includiny but not limited to:
a) Concrete: Where the siructural design exceeds e(F'c) of 2500 PSI
b) On site sfructural welding, including weWing oi reinforcing steel.
c) Drilled piers, caissons and structural maso�ry.

6. All contractors shall be licensed with possession of the appropriate insurance poiicies ie:

7. The contractor and/or subcontractors are to verify ALL existing conditions and/or discrepancies
before commencing with work in order to ensure conformance with the "Construction
Documents". ALL discrepancies shall be brought to the ettention of Britt Rowe and/or the
Shuctural Engineer of Record prior to commencement of construction. All requests for "Change
Orders" shall be submitted in writing to Britt Rowe for approval.
8. Britt Rowe is not responsible for the erection, fabrication and/or relative job sefety. The general
contractor shall comply with all required safety orders per CAL-OSHA requiremeMS and
reguiations.
9. Regardless of dimensions shown, all new work shall align exacdy with existing work with respect to
floor elevations, column centerlines, wall faces, etc... (UNO)
70. Layout for new work is largely based upon relationships to existing condkions of the site andlor
existing siructures. Any questions regarding the intent related to the layout of the new work shai�
be brougM to the attention of Britt Fowe, prior to the commencement of any work. The contractor
shall immediately notity Britt Rowe of all discrepancies prior to the commencement ot any work.

measurements. The "Plans, Specifications and General Notes" are intended to agree and

12. All work shall be plumb, square and true and shall be of good "WOrkmanlike' quaiity as acceptable
to the appropriate Irade's standard practices and those of the trade's counciis and/or
wganizations.
13. Any work and/or item not specifically calied tor in the drawings, but required for a complete and
tulty functioning installation consistent with the intent of the "Construction Documents" shall be
supplied by the general contractor and/or subcontractors as raquired.

15. The project "Specification Book" shali take Orecedence over noted specifications when

17. Britt Rowe retains all rights and ownership to all drawings and specifications. These documenls
may not be used in whoie, or in part, without ihe expressed written consent from Britt Rowe.
18. The Owner/Developer/Client reserves the right to make alterations to the design during the course
ot construction. All changes shall be approved by the local buikling official and shall, in any case,
comply wtth the currenf edftions ot the CRC, CBC, CMC, CPC, CFC, CEC and/or CES as required.
19. New Construction or remodeling is larc�ely dependent upon existing site conditio�s and therefore
a"Site Survey° is recommended and if provided, shalt be generated by a licensed Land Surveyor
or Registered Civil Engineer and shall contain the tollowing intormation: Property corners, property
lines, existing building(s), easements, topography lines, utililies and/or significant trees. If a Site
Survey is �QT provided, Britt Rowe wiil not be held responsible for any and all discrepancies
