Subject Santa Clara County Citizens Redistricting Commission Recommended Action Discuss possible recommendation to the Santa Clara County Citizens Redistricting Commission ADJOURNMENT The City of Cupertino has adopted the provisions of Code of Civil procedure §1094.6; litigation challenging a final decision of the City Council/Redevelopment Agency must be brought within 90 days after a decision is announced unless a shorter time is required by State or Federal law. Any interested person, including the applicant, prior to seeking judicial review of the city council's decision with respect to quasi-judicial actions, must first file a petition for reconsideration with the city clerk within ten days after the council's decision. Any petition so filed must comply with municipal ordinance code §2.08.096. In compliance with the Americans with Disabilities Act (ADA), the City of Cupertino will make reasonable efforts to accommodate persons with qualified disabilities. Description Once every 10 years, following the decennial census, it is required by California law to adjust the boundaries of the supervisorial districts. This practice ensures equal representation for all. Since 1991, the County of Santa Clara has convened a Citizens Redistricting Commission to oversee the process and act in an advisory capacity to the Board of Supervisors. The Commission is composed of 11 members: two from each of the five districts and a Chair, appointed by the Board President. The Commission has held a series of public hearings beginning in March to encourage community participation in the redistricting process. The Commission will then develop a plan or plans and make a recommendation to the Board of Supervisors. The Citizens Redistricting Commission is also bound by certain legal requirements and guidelines. Legal Requirements • Census 2010 Data • Redistricting Law 030311 • Maximize Equal Representation • Minimize Community Fragmentation • Avoid Gerrymandering Guidelines • Maintain Communities of Interest • Maintain Present Districts to the Extent Possible • Provide for Income Diversity Within Districts • Consider the Number and Size of Cities Within Districts There are currently five maps under discussion by the commission. These maps can be found on the Citizens Redistricting Commission website at www.seegov.org, under "Hot Items." Each map emphasizes a different aspect of the commission's mandate. • Map 1: Supervisorial Districts Map 1 (Emphasis: No Changes) April 7,2011 • Map 2: Supervisorial Districts Map 2 (Emphasis: Sunnyvale to D5) April 7,2011 • Map 3: Map 3 replaced by Map 4: Supervisorial Districts Map 3 (Emphasis: Sunnyvale to D3) April 7,2011 • Map 4: Supervisorial Districts Map 4 (Emphasis: Sunnyvale to D3) April 21, 2011 • Map 5: Supervisorial Districts Map 5 (Emphasis: Sunnyvale to D5 and Conformity to San Jose Council Districts) May 5, 2011 The commission's final meeting will be held on May 19, at 6:30 PM. The commission will vote to make its final recommendation to the Board of Supervisors at that meeting. Should the Cupertino City Council wish to weigh in on the proposed district configurations, it should do so at this time. The Commission will make recommendations to the County Board of Supervisors that are likely to considered by the Board as it makes final decisions regarding the redistricting process. The Commission has held six meetings at various locations in the county to allow for ample opportunity for community input. However, as we are nearing the end of our process we want to ensure that all the cities in Santa Clara County, particularly the ones that may potentially be impacted by changes to proposed district boundaries that the Commission may recommend, are fully aware of the process and have the opportunity to take a position if they so desire, There are currently five maps under discussion by the Commission. These maps can be found on the Citizens Redistricting Commission website, which can be found at www.scegov.or under "Hot Items." Also on the website are the agendas and minutes from our previous meetings, along with the criteria that the Commission is using in the redistricting process. The Commission's final meeting is scheduled for Thursday, May 19 at 6:30 p,m. in the County Government Center Board Chambers and will also be webcast live on the county website. At that meeting, the Commission will take a final vote on which maps to forward to the Board of Supervisors for their consideration. There will also be opportunity for Input at the two hearings scheduled for the Board of Supervisors meetings on June 7 at 1:30 time certain, and June 21, time TBD, You are welcome to attend any of the above mentioned meetings, or you can send a letter stating your or your city's position to me through Melissa Erickson, Redistricting Program Manager via email at melissa.erickson@ceo.sccgov.org.
