RecommendedAction AdoptResolutionNo. 11-____. Discussion Since1992,theNonpointSourceProgram,mandatedbytheStateofCaliforniaandtheUS EnvironmentalProtectionAgencyregulations,hasbeenfundedlocallyfromastormfeeapplied toeachpropertyintheCity.Thefee,collectedbytheSantaClaraCountyTaxCollectorand providedtotheCity,is subjecttoannualreviewandapprovalbytheCityCouncil. Theexisting stormdrainfees supporttheCity’sStateandfederallymandated programsandState waterqualitycontrolrequirements.Alsosupportedbythesefunds,aretheoperationand maintenanceofstormdrainfacilities(totheextentnotcoveredbyexistingGeneralFund activities),aportionoftheannualstreetsweepingcontract,fundingforregionalwatershed monitoringandothercomplianceworkconductedonbehalfofthecitiesandagenciesbythe SantaClaraValleyUrbanRunoffPollutionPreventionProgram(SCVURPPP). Thefeeshaveremainedthesamesincetheywerefirstleviedin1992andnoincreaseis proposed. Theannualfeesforeach propertycategoryareasfollows: CategoryRate perYear Single-Family, Town homes,Condominiums $ 12.00 / premise Commercial/Industrial/Apartments $ 144.00 /acre Unimproved/Recreation $ 36.00 /acre FiscalImpact ThefeeschedulewhenleviedonallpropertiesintheCityofCupertinogeneratesapproximately $366,000.TheproposedprogrambudgetforFY2010-2011isapproximately$500,000.This budgetedamountrepresentsincreasedstafftimeformandatoryinspectionsanddatatrackingto preventillegaldischargesandconnectionstotheCitystormdrainsystemandimpacttoState waters.ThebudgetedamountisnecessarytomeetincreasinglystringentStateandFederalclean waterrequirements,highermunicipalNationalPollutantDischargeEliminationSystem (NPDES)feesproposedbytheStateandanincreaseinSCVURPPP(countywidecollaborative) programcosts.Thedifferencebetweenthebudgetedamountandtherevenuefromfeeswillbe coveredbytheGeneralFund.Anyincreaseinthecurrentfeeamountwouldbesubjecttothe two-thirds vote provisions ofProposition 218 and no changeisrecommendedatthistime. _____________________________________ Preparedby:CheriDonnelly, EnvironmentalPrograms Manager Reviewedby: TimmBorden,Director ofPublicWorks ApprovedforSubmissionby:DavidW.Knapp,CityManager Attachments: A-Resolution,ApprovingtheRenewalandCollection ofthe ExistingStormDrainFees
