RESOLUTIONNO.11- ARESOLUTIONOF THECITYCOUNCILOF THECITYOFCUPERTINO APPROVING THERENEWALANDCOLLECTIONOF THE EXISTING STORMDRAINFEESATNOINCREASEINRATESFORFISCALYEAR 2011-2012 WHEREAS,theCityCounciloftheCityofCupertinohaspreviouslyenactedMunicipalCode Chapter3.36forthepurposeofmeetingtheCity’sfederallymandatedNonpointSourceControland StormwaterManagementProgramandestablishingtheauthorityforimposingandchargingastorm drainage servicecharge;and WHEREAS,areportconcerningthemethodofassessinganenvironmentalfeetofundthe City’sNonpointSourceProgramwaspreparedbytheDirectorofPublicWorkspursuanttoSection 3.36.080(B)oftheCity’sMunicipalCodeandfiledwiththeCityClerkonApril7,2011.Areport, entitled“Engineer’sReport,AssessmentofFeesforStormDrainagePurposesNonpointSource PollutionProgram”,was prepared bytheDirector ofPublicWorksandis dated May 27, 2011;and WHEREAS,thereport,filedwiththeCityClerk,wasavailableforpublicinspectionand reviewten(10) days priortothis public hearing;and WHEREAS,theCityCouncil oftheCity ofCupertinofindsand determinesasfollows: 1.Afterconsideringthereportentitled“Engineer’sReport,AssessmentofFeesforStorm DrainagePurposesNonpointSourcePollutionProgram”andthetestimonyreceivedatthispublic hearing,theCityCouncil herebyapprovesthereportand hereinincorporatesitintheresolution. 2.ThereisaneedintheCityforthecontinuationofastormdrainageservicechargeto coverthecostsofthefederallymandatedprogramasheretoforedescribed,inthatpropertieswithinthe citywillnototherwisecontributetheirfairsharetowardsthisprogramandwithouttheavailabilityof such storm drainage servicecharge,theCity’sgeneralfundwill be depleted. 3.Thefactsandevidencepresentedestablishthatthereisareasonablerelationship betweentheneedforthisfeeandtheimpactsforwhichthisfeeshallbeused,andthatthereisa reasonablerelationshipbetweenthefee’suseandtheproperties,whicharetobechargedthisfee. Theserelationships or nexusesare describedinmore detailintheabovereferencedreport. 4.Theamountsofthefeeforeachcategoryofproperty,assetforthbelow,arereasonable amountsas suchfeesare based on runoffcoefficientsestablishedinthe MasterStormDrainStudy. 5.Itisfurtherdeterminedthateachandeveryparceloflandcontainedinsaidreportwill, andhasreceivedabenefitofthestormdrainagesystemandthatthechargesimposedhereinoneach suchparcelareinconformitywiththebenefitsthatsuchparcelhasreceivedasfurtherdescribedinthe report. NOW, THEREFORE,BEITRESOLVED, bytheCityCouncil oftheCity ofCupertino,that: 1.Charge.Thestormdrainageservicechargeshallcontinuetobechargedtoeachparcel withinthecitytocoverthecostsoftheCity’sfederalandstaterequirementsforNonpointSource ControlandaStormwater ManagementProgram. 2.UseofRevenue.Therevenue derivedfrom saidcharge shall be usedinconnectionwith implementingandenforcingChapters3.36oftheCupertinoMunicipalCodeentitled“StormDrainage ServiceCharge”andChapter9.18entitled“StormwaterPollutionPreventionandWatershed Protection.” 3.Schedule ofCharges. Theterm"nonpointsourcepollution"representsaprocesswherebypollutants,debris,sedimentand chemicalswhichaccumulateonstreets,inneighborhoods,constructionsites,parkinglotsandother exposedsurfacesarewashedoffbyrainfallandcarriedawaybystormwaterrunoffintolocalcreeks andtheSanFranciscoBay.Sourcesofthesepollutantsmayincludeautomobileexhaustandoil, pesticides,fertilizers,chemicals,erodedsoil,detergents,paints,litterandotherdiscardedmaterial carriedthroughthestormdrainsystem,withouttreatment,directlytotheBay.Thesepollutantsare hazardoustoaquaticand humanlife. TheCityofCupertinohasimplementedseveralprogramstomitigatethisproblemthatinclude eliminationofillegaldischargesandwastedisposalintostormdrains,monitoringpollutants,public educationand publicawareness,and operationandmaintenance of storm drainfacilities. TheStateSanFranciscoBayRegionalWaterQualityControlBoard(WaterBoard)approvedthe MunicipalRegionalPermit(MRP)onOctober14,2009.Thepermitwasissuedto76agenciesor co-permittees(includingtheCityofCupertino)whichdischargestormwaterthroughdrainage systemstotheSanFranciscoBay.TheMRPincludesseveralmandatedrequirementsthatare beingphasedinoverfiveyears.TheSantaClaraValleyUrbanRunoffPollutionPrevention Program(SCVURPPP)hashadtoincreaseitsco-permitteeassessmentsbyabout20%tomeet thesenewrequirements.TheOrderrequiresBayAreamunicipalitiestoinstalltrashfull-capture devicestoremovetrashanddebrisfromthirtypercentofacity’swholesaleandcommercialland useacreage.TheCityofCupertinoisonrecordashaving213acresofwholesaleandcommercial landusearea.TheCitymustalsoinspectandcleanitsdraininletsandstormdrainconveyance systemannuallypriortotherainyseason.WiththeseandvariousotherMRPrequirementsonthe horizontheCityhashadtoincreasetheNPSbudgettoensurecontinuedcompliance.While Proposition218essentiallypreventstheCityfromincreasingstormwaterfees,itisimportantthat thefeesthat have beenin place since 1992 continueto becollected. B.EstimatedExpenditures Thetotalestimatedbudgettoimplementtherequiredprogramsdescribedaboveforfiscalyear 2011-2012isapproximately $520,000.
