C.Meetings A“meeting”shallmeanaconvention,conference,seminar,workshop,meal, orlikeassembly havingtodowithmunicipalgovernmentoperations.Anemployeeservingonapanelfor interviews ofjobapplicants shall notcome underthis definition. 4 219 D.TrainingSession Atrainingsessionisanytypeofseminarorworkshoptheattendanceatwhichisforthe purposeofobtaininginformationofaworkrelatednaturetobenefittheCity’soperationsor toenhancetheattendee’scapabilitiesinthe discharge ofassigned dutiesandresponsibilities. IIIREIMBURSEMENTANDADVANCEPAYMENTSCHEDULE A.Intent Thisscheduleiswrittenwiththeintentthattheemployeewillmakeeveryefforttofindthe lowestpossiblecosttotheCityfortravelingonCitybusiness.Forexample,ifpayingfor parkingattheairportislessexpensivethatpayingforataxiorairportshuttle,thenthe employeeshoulddrivetheircarandparkattheairport;orifrentingacarislowerthantaking taxisattheout-of-townlocation,thenacarshouldberented;orairreservationsshouldbe bookedinadvancetoobtaindiscountedfares.Thefollowingproceduresapplywhetherthe expenseis being paidthroughareimbursement ora directadvance. B.Registration Registrationfeesforauthorizedattendanceatameeting ortraining sessionwill be paid bythe City. C.Transportation TheCitywillpaytransportationcostsonthebasisofthelowestcostintentstatedin paragraphA.Eligibletransportationcostsincludeairfare(withcoachfarebeingthe maximum),vanortaxiservicetoandfromtheattendee’shomeandairport,destinationor airportparkingcharges,taxiandshuttleservicesattheout-of-townlocation,trains,tolls,or rentalcars.UseofapersonalautomobileforCity business shall bereimbursed oradvancedat theratepermileineffectforsuchuse,exceptinnocaseshallitexceedaircoachfareifthe vehicleisbeingusedforgettingtothedestination.Governmentorgroupratesofferedbya provider oftransportationmust be usedwhenavailable. ReimbursementoradvancesforuseofapersonalautomobileonCitybusinesswithinalocal areawillnotbemadesoastosupplementthatalreadybeingpaidtothose personsreceivinga monthlymileageallowance. D.Lodging Hotelorlodgingexpensesoftheemployeeresultingfromtheauthorizedeventoractivity definedinthispolicywillbereimbursedoradvancedifthelodgingandeventoccursoutside ofthelocalarea.Notcoveredwillbelodgingexpensesrelatedtoperson(s)whoare accompanyingtheCitymember,butwhothemselvesarenotonCitybusiness.Inthis instance,forexample,thedifferencebetweensingleandmultipleoccupancyratesforaroom will not bereimbursed. 5 21: Wherethelodgingisinconnectionwithaconferenceorotherorganizededucationalactivity, City-paidlodgingcostsshallnotexceedthemaximumgroupratepublishedbythe conferenceoractivitysponsor,providingthatlodgingatthegrouprateisavailableatthetime ofbooking.Ifthegrouprateattheconferencehotelisnotavailable,thenthenon-conference lodgingpolicydescribedinthe next paragraph should befollowedtofindanothercomparable hotel. Wherelodgingisnecessaryforanactivitythatisnotrelatedtoaconferenceorother organizededucationalactivity,reimbursementoradvancesshallbelimitedtotheactualcost oftheroomatagrouporgovernmentrate.Intheeventthatagrouporgovernmentrateisnot available,lodgingratesthatdonotexceedthemedianpriceforlodgingforthatareaandtime periodlistedontravelwebsiteslikewww.hotels.com,www.expedia.comoranequivalent service shall beeligibleforreimbursement oradvancement. E.Meals 1.WithNoConference Paymentstowardorreimbursementofmealsrelatedtoauthorizedactivitiesorevents shallbeattheInternalRevenueServiceperdiemrateformealsandincidentalexpenses foragivenlocation,asstatedbyIRSpublications463and1542andbytheU.S.General ServicesAdministration.Theperdiemshallbesplitamongmealsasreasonablydesired andreducedaccordinglyforlessthanfulltraveldays.Ifperdiemisclaimed,noreceipts arenecessary.Alternatively,theactualcostofamealcanbeclaimed,withina standard of reasonableness, butreceiptsmust be keptand submittedfortheexpenseincurred. 2.AsPart ofaConference WhenCitypersonnelareattendingaconferenceorotherorganizededucationalactivity, theyshallbereimbursedoradvancedformealsnotprovidedbytheactivity,onaper diemoractualcostbasis.Theperdiemandactualcostrateshallfollowtherules describedinthemealswith no conference paragraph. F.Other Expenses Paymentstowardorreimbursementofexpensesatsuchfunctionsshallbelimitedtothe actualcostsconsistentwiththeapplication ofreasonable standards. Otherreasonableexpensesrelatedtobusinesspurposesshallbepaidconsistentwiththis policy. Nopaymentshallbemadeforanyexpensesincurredwhichareofapersonalnatureornot withinastandardofreasonablenessforthesituationasmaybedefinedbytheFinance Department. 6 221 G.Non-Reimbursable Expenses TheCitywillnotreimburseoradvancepaymenttowardexpensesincluding,butnotlimited to: 1.The personal portion ofanytrip; 2.Political orcharitablecontributions orevents; 3.Familyexpenses,includingthoseofapartnerwhenaccompanyingtheemployeeonCity- related business,aswellaschild or pet-relatedexpenses; 4.Entertainmentexpenses,includingtheatre,shows,movies,sportingevents,golf,spa treatments,etc. 5.Gifts ofany kindforany purpose; 6.Serviceclubmeals;ofthose besideseconomic development staff; 7.Alcoholic beverages; 8.Non-mileagepersonalautomobileexpensesincludingrepairs,insurance,gasoline,traffic citations;and 9.Personallossesincurredwhile on City business. IVATTENDANCEAUTHORIZATION A.BudgetaryLimitations Notwithstandinganyattendanceauthorizationcontainedherein,reimbursementoradvances forexpensesrelativetoconferences,meetingortrainingsessionsshallnotexceedthe budgetarylimitations. B.ConferenceAttendance Attendanceatconferences or seminars byemployeesmust beapproved bytheir supervisor. B.TrainingSessions Paymentstowardorreimbursementofexpensesincurredinattendanceattrainingsessions, will beappropriatedannuallythroughthe budget process. VI.DIRECTCASHADVANCEPOLICY Fromtimetotime,itmaybenecessaryforaCityemployeetorequestadirectcashadvance tocoveranticipatedexpenseswhiletravelingordoingbusinessontheCity’sbehalf.Such requestforanadvanceshouldbesubmittedtotheirsupervisornolessthansevendaysprior totheneedfortheadvancewiththefollowinginformation:1)Purposeoftheexpenditure;2) Theanticipatedamountoftheexpenditure(forexample,hotelrates,mealcosts,and transportationexpenses);and3)Thedatesoftheexpenditure.Anaccountingofexpenses andreturnofanyunusedadvancemustbereportedtotheCitywithin30calendardaysofthe employee’sreturn on theexpensereport describedinSectionVII. DiscussionandFiscalImpact Since1965,guestsstayingatCityhotelshavepaidaTransientOccupancyTax(TOT)basedon theroomcharge.Unlikeothercities,thetaxhasbeen10%oftheroomchargesince1991.Hotels collectthetaxfromthehotelcustomeralongwiththeroomrevenuesandthenforwardthetaxto theCity.UnlesstheyarepayingforahotelroomintheCity,Cityresidentsdonotpaythetax. ThemoneygoesintotheCity’sGeneralFundandisusedtohelpmaintaingeneralCityservices suchaslibraryservices,neighborhoodpolicepatrols,citystreetmaintenance,rapid9-1-1 emergencyresponsetimes,currentlevelsof police officers,and schooltraffic safetyandcrossing guards.Itisnotlimitedtotheseservices,however,andcouldbeusedforothergeneralCity purposessuchasmaintainingCupertinoparks,picnicareas,andathleticfieldsandmaintaining fundsfor parksand openspaceimprovement projects. TheCityhashistoricallybeenheavilydependentonsalestaxasamajorGeneralFundrevenue sourceforgeneralCityservices,withmuchofthetaxconcentratedinthevolatilebusiness-to- businesssector.Hewlett-Packard,oneoftheCity’shighestsalestaxproducers,willmoveoutof theCityinearly2012.TheirlandhasbeenpurchasedbyApple,Inc.toexpandtheirown campus,whicheliminatesanypotentialfornewsalestaxgeneratorstooccupythesiteand supplantthelostrevenuestream.Accordingly,theCity’sFiscalStrategicPlanCommittee,with itsgoalofstabilizingandrepositioningCityrevenuesources,lookedatpossiblerevenue enhancingmeasuresfor2011/12.Afterdiscussingvariousoptions,includingasalestaxincrease ornewparceltax,theCommitteeproposedaTOTincreaseof2%thatcouldprovideabout $450,000inadditionalrevenues peryear,basedonalong-termaverage of$2,250,000 peryearin taxrevenues.FactorsfavoringthisoptionarethattheTOTaffectsthoselivingoutsideofthe City,involvesmostlythehotelsorbusinessesusingthehotels,andneedsa50%plusonesimple majority of votersatageneralelectionto passasopposedtotwo-thirds. 242 StaffdiscussedthetaxincreasewiththeCity’sfourexistinghotels,ownersoftheShashiHotel andtheChamber’sLegislativeActionCouncilandBoard.Threeofthefivehoteliersdidnot takeissuewiththetaxincreasewhileCypressandCupertinoInnopposedduetothetimingof theeffectivedate.Possibledelaysinthe January1,2012effectivedatewerealsodiscussedinan th efforttomeettheconcernsofthehotels.TheChamberBoardvotedonJune 8toopposethe measure,andApple,Inc–alargeuserofourhotelnights–willremainneutralontheissueas their negotiatedcontractsare on roomrates onlyand do notaddresslocaltaxrates. At12%,CupertinowouldbeequaltoCampbellandPaloAlto,butbelowSanJose’s14%+in SantaClaraCounty,asperthetableofcurrenttaxratesbelow.Seventy-threepercentof Campbellvotersapprovedanincreasefrom10to12%in2010whileeighty-onepercentinPalo Altodidthesamein2007.AMarch2011GodbeSurveyindicatedthat62to68%ofCupertino voterswouldsupportasimilarincrease.Seventy-threepercentwouldsupporta1%increase,but becausethesupportfor2%ismorethanadequateforasimplemajorityrequirement,staff recommendssubmittingtwopercenttothevoters.Onepercentwouldgenerateapproximately $225,000 peryear.
