DiscussionStaffreliesontheexpertiseofDr.MitchellRoth,DCinadministeringthepractical examto ourapplicants.Dr.Roth hasadministered ourpracticalexam since 1995.Dr.Rothworks forseveralotherCitiesandPoliceagenciesastheadministratoroftheirpracticalexams.Staff recommendsthatweupholdthedecisionofDr.Roththattheapplicantisnotqualifiedtoworkas aMassageTherapist,intheCityofCupertino,basedonherperformanceduringbothattemptsof the practicalexam. PerCupertinoMunicipalCodeSection9.06.120,theapplicantshalltakeandpassawrittentest andpracticalperformanceexamination,whereintheapplicanthasbeenrequiredtodemonstratea basicknowledgeofanatomy,physiology, hygieneandmassage.Iftheapplicantfailsthepractical exam,he/sheshallbepermittedtoretaketheexamonce,afteratleastthirtybutnomorethansixty dayshaveelapsedfromthedateofthefirstexam,providedthattheapplicantpaystheapplicable examfeesforasecondtime.Shouldtheapplicantfailtheexamasecondtime,theapplication shallbedenied,andtheapplicantshallnotbepermittedtoapplyagainforamassagetherapist permitfora period of oneyear.Exhibit A Chapter9.06oftheMunicipalCodedefinesandoutlinestherequirementsforobtainingapermit toworkasa Massage TherapistintheCity ofCupertino. OnFebruary11,2011,Ms.NguyenbegantheprocesstoobtainaMassageTherapistpermit.Ms. NguyenmetwithStaffandwasgivendocumentstoreturn.Sheprovidedavalididentification andshoweddocuments/transcriptsoutlining100hoursofmassagecourseworkattheMilpitas ElectrolysisCollegeinMilpitas,CA.ThiscourseworkwascompletedinNovember1996. ExhibitB Ms.Nguyenshoweddocuments/transcriptsoutlining600hoursofmassagecourseworkatthe MilpitasElectrolysisCollegeinMilpitas,CA.ThiscourseworkwascompletedinMay1997. ExhibitC Ms.Nguyenshoweddocuments/transcriptsoutlining102hoursofmassagecourseworkattheSan FranciscoSchoolofMassageinSanFrancisco,CA.ThiscourseworkwascompletedinOctober 1989.ExhibitD OnFebruary16,2011,Ms.Nguyensubmittedherapplicationandbackgroundinvestigation questionnaire.FeeswerepaidtotheCityofCupertino.Nguyenwas verballyadvisedofavailable translationservices.Nguyencompletedherapplicationformanddeclinedtheofferedtranslation services.Exhibit E Nguyenwasgivenaninstructionalpacketonthewrittenandpracticalexamination.Thispacket includedDr.Roth’saddress,phonenumberandotherinstructionstotheapplicant.Fourforms wereincludedinthisinstructionalpacketgivingNguyentheoptiontoobtaintranslationservices, priortotakingtheexamination.NguyenwasadvisedtocallDr.Rothtomakeanappointmentfor thepracticalexam.WhenanapplicantcontactsDr.Roth’soffice,theapplicantisagainverbally giventheopportunityofrequestingtranslationservices,priortotakingtheexamination.The applicantisresponsibleformakinganappointmentwithDr.Rothandpayingafeedirectlytohim.
