ATTACHMENTA-1 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 1 PROGRAMPURPOSEANDDEFINITIONSFOR ELIGIBILITY ItisCityofCupertinopolicythatthosecertainpersonsholdingpositionshereinafter definedanddesignatedeitherasmanagementorconfidentialpositionsshallbeeligiblefor participationundertheUnrepresentedEmployeesCompensationProgramasherebyadoptedby actionoftheCityCouncilandassamemaybeamendedorasotherwisemodifiedfromtimeto time. ItisthestatedpurposeofthisCompensationProgramtogiverecognitiontoandto differentiatethoseeligibleemployeesfromrepresentedemployeeswhoachieveeconomicgain andotherconditionsofemploymentthroughnegotiation.Itistheintentthatthroughthispolicy andthosewhichareadoptedorasmaybemodifiedorrescindedfromtimetotimesuch recognitionmay begiven. EligibilityforinclusionwiththisCompensationprogramislimitedtopersonsholding positionsasmanagementorconfidentialemployeesasdefinedundersection2.52.290ofthe CupertinoMunicipalCode.TheseareasdesignatedbytheAppointingAuthorityandmaybe modifiedascircumstanceswarrant. AlthoughsubjecttochangeinaccordancewithprovisionofthePersonnelCode,the positionsinthefollowingclassifications have been designatedas unrepresented. Adopted byAction oftheCityCouncil April 1, 1974 Revised 8/78, 7/79, 6/80, 7/92, 6/95 3 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 3 TRAININGANDCONFERENCES I.POLICY A.ManagementPersonnel ItisCityofCupertinopolicythateligiblepersonsunderthisCompensationProgramshallbe reimbursedorreceiveadvancesinaccordancewiththeschedules,termsandconditionsasset forthhereinforattendanceatconferences,meetingsandtrainingsessionsasdefinedbelow foreach.Itistheintentofthispolicytoencouragethecontinuingeducationandawareness ofsaidpersonsinthetechnicalimprovementsandinnovationsintheirfieldsofendeavoras theyapplytotheCityortoimplementaCityapprovedstrategyforattractingandretaining businessesintheCity.Onemeansofimplementingthisencouragementisthroughaformal reimbursementandadvancescheduleforauthorizedattendanceat suchconferences,meetings andtraining sessions. B.Non-ManagementPersonnel Whenauthorizedbytheirsupervisor,anon-managementpersonmayattendaconference, meetingortrainingsessionsubjecttothestatedtermsandconditionsincluded hereinforeach withpaymenttowardorreimbursementofcertainexpensesincurredasdefinedbelowfor each. IIDEFINITIONS A.Conferences Aconferenceisanannualmeetingofaworkrelatedorganizationthemembershipofwhich may be heldinthe name oftheCity ortheindividual. B.LocalArea ThelocalareaisdefinedtobewithinSantaClaraandSanMateoCountiesandwithina40- mile distancefromCupertinowhentravelingtoAlamedaCounty. C.Meetings A“meeting”shallmeanaconvention,conference,seminar,workshop,meal, orlikeassembly havingtodowithmunicipalgovernmentoperations.Anemployeeservingonapanelfor interviews ofjobapplicants shall notcome underthis definition. 4 D.TrainingSession Atrainingsessionisanytypeofseminarorworkshoptheattendanceatwhichisforthe purposeofobtaininginformationofaworkrelatednaturetobenefittheCity’soperationsor toenhancetheattendee’scapabilitiesinthe discharge ofassigned dutiesandresponsibilities. IIIREIMBURSEMENTANDADVANCEPAYMENTSCHEDULE A.Intent Thisscheduleiswrittenwiththeintentthattheemployeewillmakeeveryefforttofindthe lowestpossiblecosttotheCityfortravelingonCitybusiness.Forexample,ifpayingfor parkingattheairportislessexpensivethatpayingforataxiorairportshuttle,thenthe employeeshoulddrivetheircarandparkattheairport;orifrentingacarislowerthantaking taxisattheout-of-townlocation,thenacarshouldberented;orairreservationsshouldbe bookedinadvancetoobtaindiscountedfares.Thefollowingproceduresapplywhetherthe expenseis being paidthroughareimbursement ora directadvance. B.Registration Registrationfeesforauthorizedattendanceatameeting ortraining sessionwill be paid bythe City. C.Transportation TheCitywillpaytransportationcostsonthebasisofthelowestcostintentstatedin paragraphA.Eligibletransportationcostsincludeairfare(withcoachfarebeingthe maximum),vanortaxiservicetoandfromtheattendee’shomeandairport,destinationor airportparkingcharges,taxiandshuttleservicesattheout-of-townlocation,trains,tolls,or rentalcars.UseofapersonalautomobileforCity business shall bereimbursed oradvancedat theratepermileineffectforsuchuse,exceptinnocaseshallitexceedaircoachfareifthe vehicleisbeingusedforgettingtothedestination.Governmentorgroupratesofferedbya provider oftransportationmust be usedwhenavailable. ReimbursementoradvancesforuseofapersonalautomobileonCitybusinesswithinalocal areawillnotbemadesoastosupplementthatalreadybeingpaidtothose personsreceivinga monthlymileageallowance. D.Lodging Hotelorlodgingexpensesoftheemployeeresultingfromtheauthorizedeventoractivity definedinthispolicywillbereimbursedoradvancedifthelodgingandeventoccursoutside ofthelocalarea.Notcoveredwillbelodgingexpensesrelatedtoperson(s)whoare accompanyingtheCitymember,butwhothemselvesarenotonCitybusiness.Inthis instance,forexample,thedifferencebetweensingleandmultipleoccupancyratesforaroom will not bereimbursed. 5 Wherethelodgingisinconnectionwithaconferenceorotherorganizededucationalactivity, City-paidlodgingcostsshallnotexceedthemaximumgroupratepublishedbythe conferenceoractivitysponsor,providingthatlodgingatthegrouprateisavailableatthetime ofbooking.Ifthegrouprateattheconferencehotelisnotavailable,thenthenon-conference lodgingpolicydescribedinthe next paragraph should befollowedtofindanothercomparable hotel. Wherelodgingisnecessaryforanactivitythatisnotrelatedtoaconferenceorother organizededucationalactivity,reimbursementoradvancesshallbelimitedtotheactualcost oftheroomatagrouporgovernmentrate.Intheeventthatagrouporgovernmentrateisnot available,lodgingratesthatdonotexceedthemedianpriceforlodgingforthatareaandtime periodlistedontravelwebsiteslikewww.hotels.com,www.expedia.comoranequivalent service shall beeligibleforreimbursement oradvancement. E.Meals 1.WithNoConference Paymentstowardorreimbursementofmealsrelatedtoauthorizedactivitiesorevents shallbeattheInternalRevenueServiceperdiemrateformealsandincidentalexpenses foragivenlocation,asstatedbyIRSpublications463and1542andbytheU.S.General ServicesAdministration.Theperdiemshallbesplitamongmealsasreasonablydesired andreducedaccordinglyforlessthanfulltraveldays.Ifperdiemisclaimed,noreceipts arenecessary.Alternatively,theactualcostofamealcanbeclaimed,withina standard of reasonableness, butreceiptsmust be keptand submittedfortheexpenseincurred. 2.AsPart ofaConference WhenCitypersonnelareattendingaconferenceorotherorganizededucationalactivity, theyshallbereimbursedoradvancedformealsnotprovidedbytheactivity,onaper diemoractualcostbasis.Theperdiemandactualcostrateshallfollowtherules describedinthemealswith no conference paragraph. F.Other Expenses Paymentstowardorreimbursementofexpensesatsuchfunctionsshallbelimitedtothe actualcostsconsistentwiththeapplication ofreasonable standards. Otherreasonableexpensesrelatedtobusinesspurposesshallbepaidconsistentwiththis policy. Nopaymentsshallbemadeunless,whereavailable,receiptsarekeptandsubmittedforall expensesincurred.Whenreceiptsarenotavailable,qualifyingexpendituresshallbe reimbursed upon signing ofanaffidavit ofexpenditure. Nopaymentshallbemadeforanyexpensesincurredwhichareofapersonalnatureornot withinastandardofreasonablenessforthesituationasmaybedefinedbytheFinance Department. 6 G.Non-Reimbursable Expenses TheCitywillnotreimburseoradvancepaymenttowardexpensesincluding,butnotlimited to: 1.The personal portion ofanytrip; 2.Political orcharitablecontributions orevents; 3.Familyexpenses,includingthoseofapartnerwhenaccompanyingtheemployeeonCity- related business,aswellaschild or pet-relatedexpenses; 4.Entertainmentexpenses,includingtheatre,shows,movies,sportingevents,golf,spa treatments,etc. 5.Gifts ofany kindforany purpose; 6.Serviceclubmeals;ofthose besideseconomic development staff; 7.Alcoholic beverages; 8.Non-mileagepersonalautomobileexpensesincludingrepairs,insurance,gasoline,traffic citations;and 9.Personallossesincurredwhile on City business. IVATTENDANCEAUTHORIZATION A.BudgetaryLimitations Notwithstandinganyattendanceauthorizationcontainedherein,reimbursementoradvances forexpensesrelativetoconferences,meetingortrainingsessionsshallnotexceedthe budgetarylimitations. B.ConferenceAttendance Attendanceatconferences or seminars byemployeesmust beapproved bytheir supervisor. C.Meetings Anyemployee,managementornon-management,mayattendameetingwhenauthorizedby their supervisor. D.TrainingSessions Anyemployee,managementornon-management,mayattendatrainingsessionwhen authorized bytheir supervisor. 7 V.FUNDING A.AppropriationPolicy It shall bethe policy oftheCitytoappropriatefunds subjecttoavailability ofresources. B.TrainingSessions Paymentstowardorreimbursementofexpensesincurredinattendanceattrainingsessions, will beappropriatedannuallythroughthe budget process. VI.DIRECTCASHADVANCEPOLICY Fromtimetotime,itmaybenecessaryforaCityemployeetorequestadirectcashadvance tocoveranticipatedexpenseswhiletravelingordoingbusinessontheCity’sbehalf.Such requestforanadvanceshouldbesubmittedtotheirsupervisornolessthansevendaysprior totheneedfortheadvancewiththefollowinginformation:1)Purposeoftheexpenditure;2) Theanticipatedamountoftheexpenditure(forexample,hotelrates,mealcosts,and transportationexpenses);and3)Thedatesoftheexpenditure.Anaccountingofexpenses andreturnofanyunusedadvancemustbereportedtotheCitywithin30calendardaysofthe employee’sreturn on theexpensereport describedinSectionVII. VII. EXPENSEREPORTREQUIREMENTS Allexpensereimbursementrequestsorfinalaccountingofadvancesreceivedmustbe approvedbytheirsupervisor,onformsdeterminedbytheFinanceDepartment,within30 calendardaysofanexpenseincurred,andaccompaniedbyabusinesspurposeforall expendituresandareceiptforeach non- per diemitem. Revised 7/83, 7/85, 7/87, 7/88, 7/91, 7/92, 12/07,7/10 8 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 4 AUTOMOBILEALLOWANCESAND MILEAGEREIMBURSEMENTS ItisCityofCupertinopolicythateligiblepersonsunderthisCompensationProgramshall becompensatedfairlyfortheuseofpersonalautomotivevehiclesonCitybusiness.Inmany instancestheuseofpersonalvehiclesisaconditionofemploymentduetotheabsenceof sufficientCityownedvehiclesforgeneraltransportationpurposes.Itisnotintended,however, thatsuchaconditionofemploymentshouldworkanunduehardship.Forthisreason,the following policies shallapplyformileagereimbursements. ThosepersonswhooccasionallyarerequiredtousetheirpersonalautomobilesforCity businessshallbereimbursedforsuchuseatanappropriaterateestablishedbytheCityCouncil. Submission ofreimbursementrequestsmust beapproved bytheDepartmentHead. Eachassociationforwhichmembershipisclaimedmustbedirectlyrelatedtothefieldof endeavorofthepersontobebenefited.EachclaimforCitysponsoredmembershipshallbe submittedbyorthroughtheDepartmentHeadwiththeirconcurrencetotheCityManagerfor approval. Subscriptionstoorpurchaseofprofessionalandtechnicalpublicationsmaybeprovided atCityexpensewhensuchhavebeenauthorizedbytheDepartmentHeadprovidingthesubject matterandmaterialgenerallycontainedthereinarerelatedtomunicipalgovernmental operations. Adopted byAction of theCityCouncil April 1, 1974 Revised 7/92 10 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 6 OVERTIMEWORKED Managementandnon-representedprofessionalemployeesareineligibleforovertime paymentsfortimeworkedinexcessofwhatotherwisewouldbeconsideredasanormalwork dayorworkweekforotheremployees.However,nodeductionfromleavebalancesaremade whensuchanemployeeisabsentforlessthanaregularworkdayaslongastheemployeehas his/hersupervisor’sapproval.Nothinginthispolicyprecludesthealternativeworkschedule, whichmayincludeanabsenceofafulleighthourday,whenfortyhourshavebeenworkedinthe same seven daywork period. Adopted byAction oftheCityCouncil April 1, 1974 Revised 6/80, 7/91, 7/92, 6/96, 7/97, 4/07 11 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 7 HEALTHBENEFITSPLAN- EMPLOYERCONTRIBUTION ItisthepolicyoftheCityofCupertinotoprovidegrouphospitalandmedicalinsurance underwhichemployeesinManagementandConfidentialpositionsandtheirdependentsmaybe covered.Thepurposeofthisprogramistopromoteandpreservethehealthofemployeesand theirfamiliesthroughcomprehensive health plansavailable onlythroughemployer sponsorship. Althoughthepremiumcostfortheinsuranceprovidedremainstheultimateresponsibility oftheemployeeinthesepositions,theCityshallcontributetheamountslistedbelowtowardsthe premiumorpaythefullcostofthepremiumiflessthanthestatedamounts.Ifthepremium amountsforanyemployeecoveredbythispolicyarelessthantheamountslistedbelowper month,thedifferencebetweenthepremiumamountandthestatedamountswillbeincludedin theemployee’sgrosspay.TheCitywillnolongerpaymedicalinsurancecashback(excessof themonthlypremiumlessthecostofthemedicalcoverage)for newemployees hiredafterJuly 1, 2005. Employeesoccupyingthesepositionsshallbeprovided20hourspercalendaryearas non-worktimewithfullpayandbenefits.Employeesmayaccumulateflexibleholidayhoursup totwotimestheirannualaccrual. Adopted byAction of theCityCouncil July 7, 1975 Revised 6/80, 6/89, 7/92, 7/99 13 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 9 LIFEANDLONG TERMDISABILITYINSURANCE ItisthepolicyoftheCityofCupertinotomakeavailablegroupinsurancefor ManagementandConfidentialemployeesthatwillmitigatethepersonalandfamilyfinancial hardshipsresultingfromcontinuingdisabilitythatpreventsanemployeefromperforming gainfullyinhisorheroccupation.ItisfurtherthepolicyoftheCityofCupertinotoprovidelife insurancebenefitsinanamountoftwoandonehalftimestheemployee’sannualsalarytoa maximum of $250,000.00. Employeesoccupyingunrepresentedpositionsmayenrollinthedisabilityincome programandthelifeinsuranceprogramofferedifeligibleunderthecontractprovisionsofthe policyandthepersonnelrulesoftheCity.Thefullcostofpremiumsfortheseprogramsshallbe paid bytheCityfor suchemployees. Adopted byAction of theCityCouncil September 16, 1976 Revised 7/76, 6/80, 6/81. 6/82, 6/92 14 City ofCupertino UNREPRESENTED EMPLOYEES’COMPENSATIONPROGRAM PolicyNo. 10 DEFERREDCOMPENSATION ItisthepolicyoftheCityofCupertinotoprovideequitablecurrentcompensationand reasonableretirementsecurityformanagementandconfidentialemployeesforservices performedfortheCity.TheCityparticipatesintheCaliforniaPublicEmployees’Retirement System(PERS)anddeferredcompensationplanshavebeenestablished.Boththeemployeeand employermaymakecontributionsfromcurrentearningstotheseplans.Thepurposeofthis policyistopromotemeansbywhichcompensationmaybeprovidedinsuchmannerandformto bestmeettherequirementsoftheCityandtheneedsofindividualemployees,therebyincreasing theability,toattractandretaincompetentmanagementandconfidentialemployees. TheCityshallmaintainandadministermeansbywhichemployeesinthese positionsmay deferportionsoftheircurrentearningsforfuture utilization.Usage of such plans shall be subject tosuchagreements,rulesandproceduresasarenecessarytoproperlyadministereachplan. Employeecontributionstosuchplansmaybemadeinsuchamountsasfeltproperandnecessary totheemployee. Employercontributions shall beas determined bytheCityCouncil. ThepremiumcostfortheinsuranceprovidedbytheCityshallnotexceed$77.26per monthperemployee.Enrollmentintheplanorplansmadeavailablepursuanttothis policy shall beinaccordancewithPersonnelRulesoftheCityandtheprovisionsofthecontractforsuch insurance betweentheCityandcarrier orcarriers.
