RESOLUTIONNO. 11- ARESOLUTIONOFTHECITYCOUNCILOFTHE CITYOFCUPERTINOSUBMITTINGTOTHEVOTERSATTHENOVEMBER 8, 2011GENERALMUNICIPALELECTIONANORDINANCEAMENDINGTITLE 3 OFTHECUPERTINOMUNICIPALCODEINCREASINGTHETRANSIENT OCCUPANCYTAX WHEREAS, since 1965 transient hotelguests have paida TransientOccupancy Tax (TOT) on hotelroomsinCupertino.Likemany otherCaliforniacities,Cupertino usesthis fundingto provideessential public servicesthroughitsgeneralfund,andwithoutthis revenue,theCitywouldbeforcedtocutfundingthat supports:libraryservices, neighborhood police patrols,rapid 9-1-1emergencyresponsetimes,city streetmaintenance, currentlevels of policeofficers,and schooltraffic safetyandcrossingguards;and WHEREAS,therate ofthe TOT hasbeenten percent(10%) since 1991;and WHEREAS,manyresidentsliveinCupertino becauseit offersa higherlevel of service, programsand quality oflifethan neighboringcities;and WHEREAS, TOTisanimportantrevenue sourceandincreasingthatrevenuetothe generalfundwillensurethattheCitycanmaintainthe high quality of public safety, support library services,maintaincity streets,andcontinueassistingwith schooltraffic safetyand crossingguards;and WHEREAS, TOTis paidby hotelguests onlyandnot directlybyCupertinoresidents; and WHEREAS,anincreaseinthe TOTratetotwelve percent(12%)wouldhelpmaintain city services,includinglibrary services, neighborhood police patrols,city streets, 9-1-1 emergencyresponsetimes,currentlevels of police officers,and schooltraffic safetyand crossingguards. NOW, THEREFORE,BEITRESOLVED THAT: 1.AttheNovember 8, 2011General Municipal Election,there shall be submittedtothe qualified voters oftheCity ofCupertinoan ordinanceamending Title 3 oftheCupertino MunicipalCode,toamendChapter 3.12.030, theTransientOccupancyTax. 2. Thetext ofthe ballotmeasureisattachedtothisresolutionas ExhibitAand incorporatedhereinbythisreference. Thetext ofthemeasure shall not be printedinthe sample ballot pamphletmaterials, butcopies ofthemeasure shall beavailablefromthe CityClerk. 3. The proceduresfor votingforandagainst said question shall bethoseestablishedby SantaClaraCountyandthe question shall be printedin substantiallythefollowingform: CupertinoTransientOccupancyTax. To maintain and protectgeneralcityservices,includinglibrary services, neighborhoodpolice patrols,rapid 9-1-1YES emergencyresponsetimes,city streetmaintenance, currentlevels of policeofficersand schooltraffic safetyandcrossingguards, shalltheCityof Cupertinoincreasetheexistingtransient occupancy tax paidby hotelguestsfrom 10%to 12%with NO proceeds placedintheCity'sGeneralFundforlocal use,requiringannualauditsand publicexpenditure review? 4. The ballotsto be usedattheelection shall beintheformandcontentasrequiredby law. 5. The polls shall be openat 7:00am ofthe dateoftheelectionand shallremain open continuouslyfromthattime until 8:00 pm ofthe same daywhenthe polls shall beclosed,except as providedinSection 14401 oftheCalifornia ElectionsCode. 6. TheCity ofCupertinorequeststhattheRegistrar ofVotersofSantaClaraCounty conducttheelectionsandcanvassthereturns. TheRegistrar shall bereimbursedforallcosts incurredby saidservices. 7. TheCity ofCupertinorequeststhat saidelection beconsolidatedwith otherNovember electionsandthatthisgoverningbodyconsentsto suchconsolidation. 8. The voterequirementfor passageofthemeasureisamajorityofthe votescast(50% plus 1). 9.Inall particulars notrecitedinthisresolution,theelection herebycalledshall beas providedby stateandlocallawfor holdingmunicipalelectionsintheCity. 10.Notice ofthetimeand place of holdingtheelectionisgivenandtheCityClerkis authorized,instructedand directedtogivefurtheroradditional notice oftheelection,intime, formandmannerasrequiredbylaw. 11.Argumentsinfavororagainstthe proposedmeasure shall befiledwiththeCityClerk by Tuesday,July 5, 2011at 5:00 p.m. 12.Rebuttalstoargumentsinfavor oragainstthe proposedmeasure shallbefiledwith theCityClerkbyFriday,July 15, 2011 at 5:00 p.m. 13. TheCityAttorney shall prepareanimpartialanalysis ofthemeasure nottoexceed 500wordsinlengthandwhichisto befiledwiththeCounty no laterthanFriday,August 19, 2011. 14. TheCityClerk shallcausethefollowing statementto be printedintheImpartial Analysis,to beprepared bytheCityAttorney:“Theabove statementisanimpartialanalysis of Measure ____. Ifyou desireacopy ofthemeasure, pleasecalltheCityClerk’s officeat 408- 777-3223andacopywill bemailedat no costtoyou.” 15. TheCityClerk shallpublisha notice ofelectionandsynopsis ofthemeasure onetimeina newspaperof generalcirculation.
