Subject: Director's Minor Modification, DIR-2011-19, to allow temporary parking lot
improvements including parking lot striping and landscaping following demolition
of an existing gas station and associated improvements at 20755 Stevens Creek
Boulevard.
Chapter 19132 of the Cupertino Municipal Code allows for admulistrative
approval of minor changes in a project. The Director reports his decision to the
City Council and P1aruling Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
Project Description
The applicant, Greg Swanson, representing D. Barrett Watkins, is proposing to install
temporary parking lot improvements following the demolition of an existing 76 gas station
located at 20755 Stevens Creek Boulevard.
The following is a summary of the temporary improvements that will remain in place until the
site is redeveloped:
• Installing a parking lot and striping 18 parking stalls
• Adding new drive aisles (circulation plan has been reviewed by the City Traffic Engineer)
• Extending the landscaping planter near the intersection of Stevens Creek Boulevard and
Saich Way
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Site Demo: Parking Lot Plan, 20755 Stevens Creek
Blvd., Cupertino, CA 95014;' prepared by Total ProjeX Corporation consisting of one sheet,
except as may be amended by the conditions contained in this resolution.
2. TREE PLANTING
Additional trees and/ or shrubs shall be planted in the landscape planter to screen the
parking lot subject to approval by the Director of Community Development. All new
landscaping features shall be properly irrigated and maintained.

3. CONSTRUCTION BOND
A bond in the amount of $14,000 was provided to the City by the ConocoPhillips Company
on June 23, 2011 for the cost of the temporary parking lot improvements. The bond shall be
returned after completion of construction and verification of the parking lot improvements,
subject to the satisfaction of the Director of Community Development.
4. FUTURE REDEVELOPMENT OF THE SITE
Upon future development, additional site improvement requirements may include, but are
not limited to closure of curb cut driveways, installation of a detached sidewalk,
removal/undergrounding of utility structures, and other improvements outlined in the
Heart of the City Specific Plan.
5. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/ or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective June 24, 2011. The fourteen calendar day appeal period will
expire on July 8, 2011.
