GRANTING CONSENT OF THE CITY COUNCIL OF THE CITY
OF CUPERTINO TO THE CITY OF SUNNYVALE TO ACQUIRE
AND CONSTRUCT PUBLIC IMPROVEMENTS AND TO PROVIDE
THAT THE COSTS THEREOF SHALL BE ASSESSED UPON A
SPECIAL DISTRICT PURSUANT TO SPECIAL ASSESSMENT
AND ASSESSMENT BOND ACTS
CITY OF SUNNYVALE
GENERAL STREET ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Cupertino, California,
that
WHEREAS, it is the intention of the Council of the City of Sunnyvale
to undertake appropriate special assessment and assessment bond proceedings
for the acquisition of public Improvements,, more particularly hereinafter
described;
WHEREAS, said contemplated acquisitions and improvements, in the
opinion of said Council, are of more than local or ordinary public benefit,
and the cost and expenses of doing said work and the expenses incidental
thereto, are to be made chargeable upon the district benefited thereby, the
exterior boundaries of which said district have been declared by said
Council to be the coterminous boundaries of the composite and consolidated
area shown on the map of said assessment district, designated "General
Street Assessment District ", on file in the office of the Director of Public
Works, to which reference is hereby rla.de for a more detailed description
thereof;
WHEREAS, parcels of property proposed to be assessed, and some of
said work and improvements are within incorporated territory in the City of
Cupertino;
WHEREAS, this Council has investigated and been fully informed as to
the nature of said facilities and of the property which will be benefited
by the acquisition and improvement thereof, and is fully advised in the
premises;
WHEREAS, there has been filed wLth this Council a proposed form of
Resolution of Preliminary Determinat:lon and of Intention to be used in said
proceedings;
WHEREAS, the public interest, convenience and necessity will be served
by the making of said acquisitions and improvements;
WHEREAS, the acquisitions and improvements are described as follows:
Project Unit No. 1
(a) The acquisition of easements 31 feet in width along
the westerly side of Wright Avenue from The Dalles to a point 384
feet more or less northerly thereof and the improvement thereof by
clearing, grading, paving and the construction and installation of
Portland cement concrete curbs, gutters and sidewalks.
(b) The acquisition of easements 31 feet in width along
the northerly side of The Dalles from Wright Avenue to a point 475
feet more or less westerly thereof and the improvement thereof by
the construction and installation of Portland cement concrete curbs
and gutters.
Project Unit No. 2
The acquisition of easements 31 feet in width along the
easterly side of Wright Avenue from a point 140 feet more or less
southerly of the extension of Cascade Drive to a point 140 feet more
or less northerly of said extension and the acquisition of easements
62 feet in width for the extension of Cascade Drive from the westerly
terminus thereof westerly to Wright Avenue and the.improvement thereof
by clearing, grading, paving, the construction and installation of
Portland cement concrete curbs, gutters, sidewalks, water mains to-
gether with valves, hydrants and appurtenances, sanitary sewer mains
together with standard manholes, frames and covers, surface and sub-
surface storm drainage facilities and electroliers..
Project Unit No. 3
The acquisition of easements for the extension of Chahalis
Drive 56 feet in width from its present westerly terminus westerly
208 feet more or less and the improvement thereof by clearing, grading,
paving, the construction and Installation of Portland cement concrete
curbs, gutters, sidewalks, sanitary sewer mains together with standard
manholes, frames and covers, surface and sub - surface storm drainage
facilities and electroliers.
Project Unit No. 4
The acquisition of easements 31 feet in
westerly side of Wright Avenue from Astoria Drive
and for a curb return at the southeasterly corner
and Fremont Avenue and the improvement thereof by
paving, the construction and installation of Port,
curbs, gutters, sidewalks and electroliers.

westerly side.of Mathilda Avenue from Civic Center Way to a point
120 feet.more.or less southerly thereof and the improvement thereof

Project Unit No. 6
(a) The acquisition of easements 40 feet in width along
the southerly side of Arques Avenue from Fairoaks Avenue to Britton
Avenue and for curb returns at the northeasterly corner of Fairoaks
Avenue and Arques Avenue and at the northwesterly corner of Arques
Avenue and Britton Avenue and the improvement of all of Arques Avenue
as widened between the limits above described by clearing, grading,
paving, the construction and installation of Portland cement concrete
curbs, gutters, sidewalks, water mains together with valves, hydrants
and appurtenances, sanitary sewer mains together with standard manholes,
frames and covers, surface and sub- surface storm drainage facilities
and electroliers. '
(b) The acquisition of easements 15 feet in width along
the southerly side of Arques Avenue from a point 800 feet more or less
easterly of Commercial Avenue to a point 800 feet more or less westerly
of Commercial Avenue and the improvement thereof by clearing, grading,
paving, the construction and installation of Portland cement concrete
curbs, gutters, sidewalks, water mains together with valves, hydrants
and appurtenances, sanitary sewer mains, together with standard man-
holes, frames and covers and appurtenances, surface and sub- surface
storm drainage facilities.
Project Unit No. 7
The acquisition of easements 62 feet in width to provide for
the extension of Lakewood Drive westerly from Lakewood Village No. 3
to Lakewood Village No. 4 and the acquisition of easements 31 feet in
width along the southerly side of Lakehaven Drive from Jadelake to a
point 105 feet more or less easterly thereof and the acquisition of
easements necessary to complete a cul -de -sac for Jadelake for its
entire length and the improvement of all of the above by clearing,
grading, paving, the construction and installation of Portland cement
concrete curbs, gutters, sidewalks, water mains and together with valves,
hydrants and appurtenances, sanitary sewer mains together with standard
manholes, frames and covers and appurtenances, surface and sub - surface
storm drainage facilities and electroliers.
Project Unit No. 8
The acquisition of easements 31 feet in width along the
eaterly side of Wright Avenue from Helena Avenue northerly 400 feet
more or less and the improvement t:nereof by clearing, grading, paving,
and the construction and installation of Portland cement concrete curbs
and gutters.
Project 'Unit No. 9
The acquisition of easements 31 feet in width along the
southerly side of Helena Avenue from Bernardo Avenue easterly 865 feet
more or less and the improvement thereof by clearing, grading, paving
and the construction and installation of Portland cement concrete curbs
and gutters.
Project Unit No. 10
The acquisition of easements for a curb return at the northerly
corner of Sunset Avenue and West Iowa Avenue and the improvement of the
northerly side of West Iowa Avenue between Sunset Avenue and Pastoria
Avenue by the construction and installation of Portland cement concrete
curbs, gutters and sidewalks.
The acquisition of easements and the performing of work aux-
iliary to any of the above necessary to complete the same.

NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows:
1. The facilities proposed to be acquired in said proceedings are an
integral part of the ultimate single comprehensive scheme of work and facil-
ities which will be required to provide proper traffic circulation within
and without the City of Sunnyvale and the City of Cupertino; are of such a
character that they will directly and peculiarly affect property not only
within the boundaries of the City of Sunnyvale but also incorporated terri-
tory in the City of Cupertino, and the purpose sought to be accomplished can
best be accomplished by a single comprehensive scheme of work and acquisition;
and it is necessary and manifestly desirable that said acquisitions and
improvements be accomplished under the jurisdiction of the City of Sunnyvale
in order to accomplish said single comprehensive scheme.
2. That consent be, and the same is hereby, granted to said City to
the formation of the assessment distract and to the work described in said
Resolution of Preliminary Determination and of Intention and the assumption
of jurisdiction thereover for the purposes aforesaid, and to construct and
acquire said improvements and to levy assessments upon property benefited
thereby, including property within the incorporated territory in this City.
3. That consent be, and the same is hereby, granted to said City of
Sunnyvale to construct said improvements, said work to be done under the
direction of the Director of Public Works of said City pursuant to plans and
specifications approved by the City Engineer of this City and in conformity
with good engineering practice, said :Director of Public Works to require of
the contractor that all of the provisions of the specifications approved by
the City Engineer of the City of Cupertino be complied with. Said work shall
be performed to the satisfaction of said City Engineer.
4. That the form of Resolution of Preliminary Determination and of
Intention to be adopted by said Council of said City be, and the same is
hereby, approved.
5. That the City Clerk of the City of Cupertino shall forward a
certified copy of this Resolution to the City Clerk of the City of Sunnyvale.
