SUBJECT: Minor Residential Permit Action Letter - Application RM-2011-18:
This letter confirms the decision of the Director of Community Development, given on August
4, 2011 approving a Minor Residential Permit to allow an eight foot six inches (8'-6") extension
of a 11'-7" legal, non-conforming side yard setback and to allow a five foot (5') encroachment
into the required 20 foot rear yard setback, located at 11197 Linda Vista Drive, with the
following conditions:
1. APPROVED PROTECT
This approval is based on a plan set drawn by Richard Morrison, Architect-Interior
Designer, entitled, "Addition & Alterations to 11197 Linda Vista Drive;' consisting of four
(4) sheets, (Sheet Numbers A-1, A-2, A-3 and A-4), dated June 2011, except as may be
amended by conditions in this resolution.
2. NON-CONFORMING BUILDING WALL LINE COVENANT
Prior to issuance of final occupancy, the property shall contact the P1aruling Division to
draft a covenant document that restricts future extensions of non-conforming building lines
for the life of the house. The covenant shall be recorded with the Santa Clara County Clerk
Recorder's Office.
4. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
5. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color,
material, architectural treatments and/ or embellishments) shall be reviewed and approved
by the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resemble the details shown on the original approved
plans. Any exterior changes determined to be substantial by the Director of Community
Development shall require a minor modification approval with neighborhood input.
7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later .
challenging such exactions.
Staff received comments from a neighbor inquiring about privacy and noise concems owing to
this minor residential addition.
a. This addition is not expected to result in an increase in noise levels other than
intermittent increase in noise levels during construction. The construction shall be
. conducted in accordance with the requirements of the Community Noise Control
Ordinance, Chapter 10.48.
b. Single story residential additions are not required to meet privacy screening
requirements. Additionally the concerned neighbor' property is at a higher elevation
than the applicant's property.
c. This addition shall adhere to City of Cupertino StormWater Control requirements to
ensure rain water is contained onsite.
Please be aware that if this permit is not used within one year, it shall expire on August 4, 2012.
Staff has made all of the findings that are required for approval of a Minor Residential Permit as
required by the of Cupertino's Municipal Code, Chapter 19.28.090 (B). Also, please note that an
appeal of this decision can be made within 14 calendar days from the date of the decision. If
this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.

deducted proportionally at each payment. This retainage will not be due to
the Contractor until Final CompleLon.

CONSTRUCTION SCHEDULE
Within 15 days after Notice to Proceed, provid3 a bar�chert type progress
schedule, In calendar days, showing the propc,sed time duration for each
major catepory of work. The list of items shou d be similar to the Schedule
of Values. The Schedule shall take into ea;ou�t any required phasing of
project. Show any periods attecting Owners u:�e of space, such as utility
ahut-oHs and periods of restricted acoess. If si3nificant changes to Contrect
Time occur, modiiy and reissue schedule.
SCHEDULE OF VALUES
Prior to the first applicr3tion for payment, provicle a detalied breakdown of
the agreed Contract Sum showing values alloceted to each of the various
parts of the Work. Verity with the Architect thai suHicient information is
included for adequate evaluation of payment r��quest. 5upply additional

TEMPORARY UTILITIES

for calls related to the project. No calls will be permitted from Owner's
phone. Contrector may use Owner's toilet faciL!ies, provided that these are
kept in clean condition. If Contractor is unable to maintain an acceptable
level of deanliness to Owner, Contractor shall �,,rovide portable toilet,
acceptable to Building Otticial, at no additionai expense to Owner.
PROTECTION OF PROPERTY
Contractor shall be responsible for providing a watertight condition at all
areas where the work requires penetrating exterior walis or roof. Any
damage caused by failure of this condition, due to water, shall be repaired

exterior wall during an extended period. Contrector shall be responsible for
