APPROVED PROTECT This approval is based on a plan set entitled, "Freund Residence, 10401 Plum Tree Lane, Cupertino, CA 95014" consisting of 17 sheets dated August 26, 2011; except as may be amended by conditions in this resolution. 2. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 3. PLAN SET REVISIONS The applicant shall include the following information for Planning Department review prior to building permit issuance: a. Addition of a 24-inch box size Australian Willow tree along southern property line adjacent to the existing Bottle Brush tree on the Landscape Plan (Sheet L-01). b. Indicate that all existing trees used for privacy planting are Evergreen/Non-Deciduous trees that provide adequate privacy screening year-round on the Landscape Plan (Sheet L-Ol). 4. PRIVACY PLANTING The final privacy-planting plan shall be reviewed and approved by the Planning Division prior to issuance of builcling permits. If existing tree(s) is used for privacy screening, a letter from a certified arborist shall be submitted confirming that the tree(s) is in good condition and is appropriate privacy protection in any season. 5. PRIVACY PROTECTION COVENANT The property owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements consistent with the R-1 Ordinance, for all windows with views into neighboring yards and a sill height that is 5 feet or less from the second story finished floor. The precise language will be subject to approval by the Director of Community Residential Design Review Action Letter Page 2 R-2011-16 Development. Proof of recordation must be submitted to the Community Development Department prior to final occupancy of the residence. 6. CONSTRUCTION NOISE As part of this approval, the applicant has voluntarily agreed to restrict the hours of construction as follows: • Weekdays: 7:00 am to 5:00 pm (Ordinance allows 7:00 am to 8:00 pm) • Weekends: 9:00 am to 5:00 pm (Ordinance allows 9:00 am to 6:00 pm) The above information must be clearly identified on the building permit plan sets prior to issuance of building permits. The project must conform to all other regulations and noise limits stipulated in the Community Noise Control Ordinance. 7. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 8. EXTERIOR BUILDING MATERIALS/TREATMENTS Final building exterior treatment plan (including but not limited to details on exterior color, material, architectural treatments and/or embellishments) shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The final building exterior plan shall closely resemble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a minor modification approval with neighborhood input. 9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has received comments from concerned neighbors with regard to privacy trees and maintenance, placement of windows, noise, a covered patio, and hazardous material: One neighbor felt that the area proposed for privacy planting on the northern side of the property would be too small for the privacy trees and create maintenance issues in the future. Instead, the neighbors would prefer if the applicant were to raise the height of the window on the northern elevation above five feet from the finished second floor to avoid the need for privacy planting. The applicant has considered the request, but has opted to keep the window location as is and retain the privacy trees, which conforms to the Single-Family Residential Ordinance. Privacy trees must provide substantial screening within three years of planting. However, the applicant will be required to record a covenant to maintain all privacy trees on site, which must be immediately replaced if they die. Residential Design Review Action Letter Page 3 R-2011-16 In addition, the neighbor had concerns regarding the noise that will be emitted from the air conditioning (A/C) unit along the side yard area. The A/C unit must be at least three feet away from the northern property line to mitigate any potential noise that neighbors might hear. Furthermore, the equipment must adhere to maximum noise levels delineated within the City's Community Noise Control Ordinance. The applicant has confirmed that the selected A/C unit will be of a quieter model. Staff also received anonymous concerns regarding the amount of privacy trees along the southern side of the property, the missing front yard tree, and questions concerning a patio. The applicant will be required to install an additional Australian Willow tree along the southern side of the property prior to building permit issuance. Furthermore, a certified arborist has concluded that the addition of a new front yard tree would conflict with the existing Magnolia tree. The neighbor also inquired whether a new patio is proposed; it is not. Another neighbor had concerns with construction noise and hazardous material. Maximum construction noise levels are detailed in the City's Community Noise Control Ordinance. The neighbor has requested that construction times be limited from 8:00 am to 5:00 pm, whereas the Noise Ordinance allows 7:00 am to 8:00 pm during the weekdays and 9:00 am to 6:00 pm during the weekend. The applicant has agreed to limit the hours of daytime construction from 7:00 am to 5:00 pm during the weekdays, and weekend construction times from 9:00 am to 5:00 pm. If hazardous materials are found on site, the applicant/contractor shall be responsible for notifying the city of Cupertino Building Department, Environmental Division, and the county of Santa Clara Department of Environmental Health for proper management and disposal. In addition, the project must follow the 'Best Management Practices for the Construction Industry' published by the Santa Clara Valley Urban Runoff Pollution Prevention Program. Staff has made all the findings that are required for approval of a Two-story Residential Permit as required by the of Cupertino's Municipal Code, Section 19.28.100 (D), Ordinance No. 2039. Also, please note that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission.
