RESOLUTION NO. 06-153
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
SETTING A PUBLIC HEARING FOR CONSIDERATION OF ANNEXING
TERRITORY DESIGNATED "CUPERTINO POCKETS 06-01", PROPERTIES
LOCA TED IN THE UNINCORPORATED AREA GENERALLY BOUNDED BY
STEVENS CREEK BOULEVARD, STELLING ROAD, THE SOUTHERLY CITY
LIMITS AND STEVENS CANYON ROAD, AN AREA OF APPROXIMATELY 17.38
ACRES.
WHEREAS, the City Council of the City of Cupertino is interested in annexing
territory designated "Cupertino Pockets 06-01 "; and
WHEREAS, the properties, consisting of 17.382: acres located in the
unincorporated area, generally bounded by Stevens Creek Boulevard, Stelling Road, the
southerly City limits and Stevens Canyon Road, which are contiguous to the City of
Cupertino and are within its urban service area; and
WHEREAS, annexation would provide for use of City services; and
WHEREAS, the following City taxes and fees will be extended to this area upon
annexation and the residents and property owners will be duly notified in advance. The
taxes and fees are:
1) The Utility Users' Tax, which is currently 2.4% of the natural gas, electricity,
local and long distance telephone charges. Homeowners age 65 or over may
apply for a utility users' tax exemption at City Hall.
2) The Storm Drainage Service Fee, which is currently $12.00 per single-family or
duplex residential parcel, $144.00 per acre of apartment, commercial, or industrial
land, and $36.00 per acre of vacant land, on an annual basis.
3) The Business License Fee applies if you have a home business in Cupertino. The
annual fee is currently $105.00 for most home businesses.

WHEREAS, this territory was pre-zoned as follows:

WHEREAS, the City of Cupertino, as Lead Agency for environmental review,
has completed an initial study and environmental review for the annexation;
environmental review was previously completed for the prezonings of territory; and
WHEREAS, the County Surveyor of Santa Clara County has found the maps and
descriptions (Exhibits "A" and "B") to be in accordance with Govermnent Code Section
56757(c)(2), the boundaries to be definite and certain, and the proposal to be in
compliance with LAFCO's road annexation policies; and
WHEREAS, certain islands are completely surrounded by City boundaries and do
not require a legal description for the purposes of annexation according to LAFCO; and
WHEREAS, the County Assessor of Santa Clara County has found the boundaries
of the proposed annexation described in the aforementioned maps and descriptions
conforming to lines of assessment or ownership;
WHEREAS, the fees set by the County of Santa Clara to cover staff cost for
above certifications have been waived by the County; and
WHEREAS, the annexation does not create islands or areas in which it would be
difficult to provide municipal services; and
WHEREAS, the annexation is consistent with the adopted general plan of the
City; and
WHEREAS, said territory is inhabited and all owners of land included in the
proposal have not consented to this annexation; and
WHEREAS, the city has complied with all conditions imposed by LAFCO for
inclusion of the territory in the urban service area of the city; and

WHEREAS, as provided in Government Code Section 56757, the City Council of
the City of Cupertino shall be conducting authority for the annexation to the City; and
WHEREAS, the conducting authority recognizes under Government Code
Section 56375.3, it may order an annexation of the territory without an election;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Cupertino hereby initiates the change of organization (annexation) proceeding and will
consider annexation of the territory designated "Cupertino Pockets 06-01" at a public
hearing on October 3,2006.
PASSED AND ADOPTED at a regular adjourned meeting of the City Council of
the City of Cupertino this 5th day of September 2006, by the following vote:

Being a portion of Sections 22 and 27, Township 7 South, Range 2 West, Mt. Diablo
Baseline and Meridian, also being a reannexation of the property deannexed by the
deannexation entitled "Regnart 63-12 Withdrawal, Amended", adopted May 8, 1964 by
the City of Cupertino, more particularly described as follows:
BEGINNING at the common ~ Comer between said Sections 22 and 27, said comer also
lying on the westerly line of the annexation entitled "Bubb-3" adopted September 24,
1960, by the City of Cupertino, Ordinance No. 149; thence S 020 05' 48" E 102.30 feet
along said westerly line; thence leaving said annexation N 890 39' W 210.00 feet to the
southerly line of the annexation entitled "Stevens Creek - 8" adopted February 6, 1961,
by the City of Cupertino, Ordinance 158; thence northerly and easterly along the
amended line of said annexation N 02005' 48" W 302.00 feet and N 880 57' E 210
feet more or less to the said westerly line of said annexation "Bubb-3"; thence leaving

Being a portion of the Northwest lf4 of Section 26, Township 7 South, Range 2 West, Mt.
Diablo Baseline and Meridian, situate in the County of Santa Clara, State of California, more
particularly described as follows:
BEGINNING at the northeasterly corner of Parcel B as shown upon that certain Record of
Survey filed for record in Book 165 of Maps at page 37, said corner also being the southeast
corner of the annexation entitled "Upland Way 86-02 A", adopted November 17, 1986 by the
City of Cupertino and lying on the westerly line of the annexation entitled "Seven Springs
80-17", adopted April 20, 1983 by the City of Cupertino; thence southerly along said
westerly line to the southeast corner of said Parcel B; thence leaving said westerly line along
the southerly line of said Parcel B and Parcel A as shown upon said Record of Survey, S 890
57' 00" W, 399.92 feet to the southwest corner of said Parcel A, also being the southeast
comer of the annexation entitled "Upland Way 92-04" adopted July 6, 1993 by the City of
Cupertino; thence northeasterly along the easterly line of said annexation and the westerly
line of said Parcel A to the most easterly comer of said annexation, also being the most
southerly corner on Lot 7 as shown upon that certain map of Tract 492 filed for record in
Book 18 of Maps at pages 4 & 5; thence leaving said westerly line of Parcel A
northwesterly, along the northeasterly line of said annexation and the southwesterly line of
said Lot 7 to the southeasterly line of Upland Way, also being the southeasterly line of the
annexation entitled "Upland Way 90-05" adopted September 17, 1990 by the City of
Cupertino; thence northeasterly along said annexation and the northwesterly line of said Lot
7 to the most southerly common corner of Lots 7 and 9 as shown upon said Tract 492; thence
leaving said southeasterly line of Upland Way and continuing along the common line
between said Lots 7 and 9 and said annexation northeasterly to the most northerly common
corner of said Lots; thence leaving said common line between Lots 7 and 9, northwesterly
along the common line between Lots 8 and 9 of said Tract 492 and the northeasterly line of
said annexation to the general southerly line of Upland Way, said point also lying on the
general southerly line of the annexation entitled "Upland Way 00-03" adopted June 17,2000
by the City of Cupertino; thence leaving said common lot line, northeasterly, southeasterly
and easterly along said general southerly line of Upland Way and said annexation to the
