CONTRACTOR shall provide or furnish the following specified services and/or materials: Professional studies in connection with Kim Street Neighborhood Traffic Circulation Study Project EXHIBITS: The following attached exhibits hereby are made part of this Agreement: Exhibit A & B (reduced by $600.00) TERMS: The services and/or materials furnished under this Agreement shall commence on March 4. 2005 and shall be completed before April 25, 2005 COMPENSATION: For the full performance of this Agreement, CITY shall pay CONTRACTOR: Amount not to exceed $7,000.00 California Labor Code, Section 1771 requires the payment of prevailing wages to all workers employed on a Public Works contract in excess of $1 ,000.00. GENERAL TERMS AND CONDITIONS Hold Harmless. Contractor agrees to save and hold harmless the City, its officers, agents and employees from any and all damage and liability due to negligence, errors and omissions, including all costs of defending any claim, caused by or arising out of the performance of this Agreement. City shall not be liable for acts of Contractor in performing services described herein. Insurance. Should the City require evidence of insurability, Contractor shall file with City a Certificate of Insurance before commencing any services under this Agreement. Said Certificate shall be subject to the approval of City's Director of Administrative Services. Non-Discrimination. No discrimination shall be made in the employment of persons under this Agreement because of the race, color, national origin, ancestry, religion or sex of such person. Interest of Contractor. In accordance with your request, and per our recent telephone conversations regarding the changes in the scope of work and the schedule of the project, MULTITRANS is pleased to submit this proposed work program for your review and approval. The proposed work program presents a scope of work, schedule and budget to provide professional services. MULTITRANS staff members have worked on numerous projects of a similar nature throughout the northern California, including a number of projects for the City of Cupertino, and as a result our staff have substantial experience in the preparation of traffic neighborhood studies. I. PROJECT UNDEREST ANDING The Project consist of collection of traffic data. in which the City staff will review, compare, and re- evaluate the Kim Street Neighborhood circulation, and possible street closure, in the City of Cupertino. The study area is bordered by De Anza Boulevard to the west, Bollinger Road to the south, McClellan Road to the north, and Stelling Road to the east. The objectives of the project are: ,/ To determine if commute traffic is still using the neighborhood streets as a short-cut; ,/ To determine if travel patterns have changed since the opening of State Route 85 in 1994; ,/ To examine violation of the existing REGULATORY signs installed in 1984, including no right or left turns during 6:00 to 9:00 AM on weekdays and traveling the wrong direction; ,/ To determine the continue use of the automated gate on Kim Street (manual barrier in-place 1986 and automated gate in-place 1990 +/-, between the hours 6:30 to 8:30 AM). 1280 Boulevard Way, Suite 200 . SCOPE OF WORK The following scope of work has been prepared for your review and approval. Following your review of the scope of work, please provide any comments you may have so that they are incorporated in the final scope of work. The project scope of work consists the following four important tasks: Task 1 - Conduct Directional Traffic Counts Task 2 - Conduct Origin and Destination Study Task 3 - Conduct Vehicle Classification Counts Task 4 -- Project Management and Report Preparations The following paragraphs provide a general description of each project task. Task 1 - Conduct Directional Traffic Counts The project consists of conducting 72-hour directional traffic counts, during a Tuesday , Wednesday, and Thursday. The counts will be conducted by MUL TITRANS in late January or early February in 2005, during a period to be approved by the City Project Manager. All count locations will be set up by 4:30 PM on the Monday prior to the proposed counting period of Tuesday, Wednesday, and Thursday counts. The count locations are presented in Table 1. License plate recording will consist of the four last digits of a vehicle license plate including any combination of number and letters plus the color of vehicle. Special recording is required on Kim Street N/O Bollinger, where vehicle classification will also be recorded. The Origin and Destination study locations are presented in Table 2. The counts will be conducted between the hours of 6:00 to 9:00 AM, 12:00 noon to 1:00 PM, and 3:00 to 7:00 PM. Task 4 -- Project Management and Report Preparations David Yazhari will be responsible for organizing and directing the project staff, assigning responsibilities, and controlling the elements of cost, schedule and quality of work. He will work closely with the City Project Manager and other staff involved in the project, and will attend project meetings. Additionally, he will be responsible for conducting technical tasks and preparing project reports. Mr. Yazhari has managed numerous projects pertinent to this project for public agencies throughout the Country. A copy of David Yazhari's resume is attached. MUL TITRANS will prepare electronic files (Microsoft Excel) for the studies conducted for Task 1 and Task 3. Additionally, MULTITRANS will prepare hard copy reports for all project tasks. III. PROJECT SCHEDULE MULTITRANS will conduct and complete all the project tasks in two weeks. As presented in Figure 1, all the project data will be collected in the first week following the notice to proceed. During the second week, MULTITRANS will prepare and transmit all the reports. With the approval of the City, this study maybe started during the last week of January 2005 (January 24, 2005) and completed by February 4,2005. This suggested schedule offers a starting point for further review and refinement with the City Project Manager. If required, an alternative appropriate and responsive schedule to satisfy overall project req~irements can be developed with the City staff and adhere to. A fee of $7,600.00 is anticipated, based on the suggested scope of services, anticipated project staffmg and staff participation, and direct expenses estimated for the project. This suggested project budget is based on the Consultants understanding of the City's project scope and needs. A budget showing the cost for each task and the total cost for the proposed scope of work is presented in this section of proposal. 1. Perform and record directional traffic counts. TOTAL TASK 4: $900.00 TOTAL PROJECT: $7,600.00 The proposed fees include the proposed field reconnaissance, travel and fuel costs, printing, supplies, fax and communications, and other out-of-pocket expenses directly related to the proposed work.
