RE: Ordinance No. 11-2085
Dear City Council
"Cupertino's City Council" has turned it's ethical and moral back on your constituents, you have blindly sanctioned
yet another city staff sponsored hi-jacking of the multi-year Mat-ix review process, allowing staff to do a stealthy legislative
rewrite of Ordinance No. 11-2085 that vilifies your constituents.
Ordinance No. 11-2085 takes actions on issues that were not supported in any way at prior public hearings, adding to the
insult, city staffs proposed legislation rings false with public sentiments and offering punitive measures of intolerance,
including building of an insurmountable administrative wall blocking your constituents reasonable&transparent
oversight of the building permit review process.
"Your city council watch"has coldly and strategically moved against a primary tenant; one of fostering pubic disclosure
and transparency, as you are denying the public there democratic right of reasonable over site of the building process, a
process which impacts the most basic quality of life for all residents in Cupertino.
Clearly there is a new preference by the current city council for avoiding accountability, by advocating your powers for a
weaker administrative approval process of development projects done by city staff.
Your city council has abstained from the honor bound oath to protect your constituent's rights, cowardly shirking from your
elected duties in favor of your duties now being administered by city staff behind closed doors in the bowels of city hall,
perhaps wounding the powers of all future city council's in an unrecoverable way, as your council and future city councils
will not be responsible for the actions of our unelected city staffers and then for the damage to the quality of life that your
residents will surely have to swallow for your lack of insightful governance today.
Ordinance No. 11-2085 is wildly punitive; a $5000 fee/fine to appeal an administrative action, this is an outrage.
Please stop.
Please vote for a continuance on the final approval of Ordinance No. 11-2085.
Please review the city council powers you are advocating, as you are also damning your constituents rights too, rights
which perhaps you take lightly and which you must have great disdain for, but I hope to be proven 100% wrong.
Please Stop limited noticing to impacted residents as defined by the community development director, planning
commission and/or city staff alone.
Please stop the punitive $5000 appeal fees/fines for challenging these stealth approvals done at administrative level.
Please stop changing the municipal code to block any reasonable public oversight and transparency of city governance.
Thank you.
