SUCCESSOR TO THE REDEVELOPMENT AGENCY MEETING
Canceled for lack of business.
The City of Cupertino has adopted the provisions of Code of Civil Procedure §1094.6; litigation
challenging a final decision of the City Council/Redevelopment Agency must be brought within 90 days
after a decision is announced unless a shorter time is required by State or Federal law.
Any interested person, including the applicant, prior to seeking judicial review of the city council’s
decision with respect to quasi-judicial actions, must first file a petition for reconsideration with the city
clerk within ten days after the council’s decision. Any petition so filed must comply with municipal
ordinance code §2.08.096.
In compliance with the Americans with Disabilities Act (ADA), the City of Cupertino will make
reasonable efforts to accommodate persons with qualified disabilities. If you require special assistance,
please contact the city clerk’s office at 408-777-3223 at least 48 hours in advance of the meeting.

TimBrandsaidthathehasbeenanengineerfor34yearsandthatmeasurementsformercury
contentandlimestonearevariable.HestatedthatBayAreaforCleanEnvironmenthireda
consultantandforwardedtheresultsofthereporttoBAAQMD.Henotedthathereceived
onlyoneresponsefromBAAQMDandbelievesthedatawastossedbecausetheresultswere
too high. Mr.BrandrequestedthatCouncil sendalettertoBAAQMD.
PaulaWallisexpressedconcernthatsparetheairdaysintheBayAreaarebecomingtoo
common.ShenotedthattheBayAreaisanon-attainmentzonewhichmeansthattheair
qualitydoesnotmeettheozoneorparticulatematterstandardsforhumanhealth.Ms.Wallis
urgedcounciltosendalettertoBAAQMDtoholdLehightothehigheremissionsstandard
of1.5poundsofNOxpertonofcementclinkerratherthantheproposed2.3poundsperton
and .01 pounds of particulatematter perton ofcementclinkerratherthanthe proposed .04.
GaryLatshaw,CupertinoresidentandmemberoftheSierraClub,saidhesupportedsending
alettertoBAAQMDandprovidedadraftcopyofaletterhepreparedwithmorestringent
language.Mr.LatshawindicatedthatthisletterwasnotbroughtbeforetheBoardofthe
SierraClubLomaPrietaChapter.
ThorstenvonSteinsaidhesupportedsendingalettertoBAAQMDurgingthemtohold
LehightothestricteststandardsproposedbytheEPA.HenotedthatLehighisnationally
uniquebecauseitcanoperatewheretherearepeopleandinaplacethatalreadyhassub-
standardairquality.Mr.vonSteinreviewedan EPAanalysisthat showsthe newruleswould
not only savelives butalsoreduce healthcarecosts.
RichardAdlernotedthattherehasbeenconcernforyearsaboutthepollutionLehigh
produces,buttherehasn’tbeenmuchrealdata.HestatedthatinAugustof2010theEPA
releasedanationalhealthriskassessmentfromcementplantsandLehighisresponsiblefor
2%ofallcementplantpollutionnationally.Henotedthatbasedontheresultsofthe
assessment,healthcarecostsavingsfromreducingparticulatematterwouldrangefrom$134
millionto$720millionperyear,casesofprematuredeathswouldbeatalowof19toahigh
of100,andcasesofrespiratoryproblemswouldbereducedto600from1,200.Mr.Adler
urgedCouncilto sendaletterrequestingLehigh be heldtothe strictest standards.
KarenDelCompariorequestedthatCouncilsendalettertoBAAMQDrequestingthat
Lehighbeheldtothestrictestcontrolsfornewormodifiedfacilities.Shealsoprovideda
copyofaresolutionfromtheCaliforniaMedicalAssociationregardingmercuryandcement
plant pollution.
LynnFaustsaidshesupportedsendingalettertoBAAMQDandstatedthatshehopesthisis
thefirst steptomakingCupertino’sair quality safer.

Discussion
OnJanuary 17, 2012, Councilconductedthefirstreading ofthe MunicipalCodeamendmentto
establish bikelanes on RodriguesAvenuebetweenDeAnzaBoulevardandBlaneyAvenue.
Councilalso directed stafftoreturntoCouncilinayeartoreport on the operational performance
ofthe new striping on RodriguesAvenue.
FiscalImpact
ThecostofsigningandstripingisincorporatedintotheannualoperationalbudgetofPublic
Worksstaff.ThecostofrestripingRodriguesAvenuetoaccommodatebikelanesisestimatedat
$16,500andwillbeperformedbyanoutsidecontractor.SignagewillbecompletedbyCity
forces. Thereis noadditionalfiscalimpactforthiswork.

Background
AtitsJuly 5, 2011 Councilmeeting,theCityCouncil discussed having staffreturntoCouncil
with optionsforan off-leashareafor dogs.Staffindicatedthattheissuewouldreturninearly
2012. Theissue of off-leashareasfor dogsinCupertinowasfirstraisedin 1993. Themost
recent discussions on thismatter beganin 2008.TheCouncilaskedtheParksandRecreation
CommissiontoreviewtheissueandmakearecommendationtotheCouncil. TheParksand
RecreationCommissionresearchedtheissue, visited neighboring dog parks,andconducted
severalwell-attended,facilitated, public discussions. TheCommissionrecommendedtothe
Councilthatthecommunityconversationcontinuewitha smallergroup ofinterested persons.
Thisgroupmetfourteenconsecutiveweeks beforearrivingatacompromiserecommendation.
Therecommendationwasafenced dog parkatthelowerlevel ofLindaVistaPark.
WhentherecommendationwasforwardedtotheCouncil, neighborsfromtheLindaVistaarea
vigorously opposedtheidea.Council votedto not builda dog parkatLindaVista.After
listeningtothoseinfavor of off-leashareaswithoutafence,andthoseinfavor ofafencedoff-
leasharea,theCouncilvotedtogetresidents’and park users’feedbacktoestablishan unfenced
off-leashareafor dogsat specifictimes ofthedayinfourCity parks. TheparkswereJollyman,
Library, Memorial,andLindaVista. TheCitycontractedwithGodbeandAssociatestoconduct
a statistically valid surveyforresidentswithin 1,000feet ofthefour parksandto developa
surveyto gatherinformationfrom park users.ADeAnzaCollege political scienceclass
conductedthepark usersurveys duringthetime of dayproposedbytheCouncil. The surveys
wereconducted overa30-day period.
Theresults ofthe surveyshowedthatapproximately 25% oftheresidentswereinfavor of off-
leashareasinthesefourparkswith 75% opposed. Theresults ofthe parkuser survey showed
49%infavorand 51%opposed.Staffalsoconsidered developingafenced-in off-leashareaat
theCounty’sStevensCreekRegionalPark.However, dog owners preferredaCupertino
neighborhood park.Councilasked stafftoevaluate possible sitesthatwerenotinCity parksfor
afencedarea.

Staffevaluated various sitesandreturnedtoCouncilwitha site on City-ownedlandalong Mary
Avenue.Staffalso hada designforafenced off-leashareafor small dogsandafencedareafor
large dogs. Theestimated budgetforthis projectwas $250,000. Later, staff discoveredthatthe
landinthis sitecontainedleadandwould needtobecleaned up foranadditionalcost of
$100,000. The project did notgoforward duetothisadditionalcost.
Analysis
Giventhe discussionattheJuly 5, 2011 Councilmeeting, staff hasevaluated several possible
siteswhicharepresented below.
Uponfurtherevaluation,staffconsideredthree possible sites. The sitesand positivesand
negatives ofeach sitefollow:
1)Buildafour-footfencearoundLibraryFieldwitharegulargate. MakeLibraryField
availableasan off-leashareafor dogsfrom 7:00a.m. – 9:00a.m., Mondaythrough
Friday. Therest oftheday,LibraryFieldwouldbefor permitted groups suchascricket,
soccer,and volleyball.
Positives:
Afencedfieldwill provideanareafor dogstorun off-leash, butwill notinterfere
withthechildrenwalkingto Eaton ElementarySchooleachmorning.
Atime-certain off-leashareafor dogswillallowothersto usethefieldattheir
usualtimes.
Afencedfieldwill keepcricket balls, soccerballs,and volleyballsfromrolling
intothe street.
Negatives:
Residentswithin 1,000 feet ofLibraryFieldwereopposedto havingan off-leash
areafor dogs duringtheGodbe survey.However,thatwasforan unfenced off-
leasharea.
Thereis no readilyavailablewaterfor dogsatthislocation.
This option does not provide separateareasforsmallandlarge dogs.
Approximatecostforthisfenceandgateis $80,000. Thereis $250,000 intheCapital
budgetfor dog parks.
2)Providean unfenced off-leashareafor dogsat MemorialParkfrom 7:00a.m. – 9:00a.m.
MondaythroughFriday.
Positives:
Thesetimeswill notinterferewiththe specialevents scheduledforMemorial
Park.

Thesetimeswill notinterferewiththe permitteduse ofthe park.
The dogsmay beableto keepthegeeseawayfromthe park.
Negatives:
Many studentsfromGardenGateandDeAnzawalkthroughthepark duringthis
time.
Manypeoplearecurrentlywalkingthroughtheparkatthistime.
Theresults oftheGodbesurvey showedthatresidentswithin 1,000 feet ofthe
parkwere strongly opposedtoan unfenced off-leashareafor dogs.
Thisalternative does notprovidefor separateareasfor smallandlarge dogs.
Thecostisminimalastherewould benocapitalexpenditureandthe parkisalready
maintainedbyPark Maintenance staff on aregular basis.
AdditionalConsiderations
The groundrulesforanoff-leasharea havealreadybeenestablishedbythecitizens’committee
working on off-leashareasin 2008-2009.ItisalsorecommendedbyCitystaff,theABAGPlan
staff,andtheSanJoseAnimalCareandServicesstaff,thata stronggroupof volunteers be
developedto helpenforcetheserules.Iftheserulesarewellfollowedandenforced,additional
impacttotheCity’smaintenanceservices should beminimal. The proposedgroundrulesare
foundinAttachmentA.
