Subject: Director's Minor Modification, DIR-2011-06, to a previously approved Architectural
and Site Approval (ASA-2011-08) to allow exterior modifications to a previously
approved two-story home in a Planned Residential District located at 10218 Orange
Avenue.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant is requesting modification to the exterior of a previously approved two-story
home by relocating some windows on both the first and second floors to accommodate
revisions to the floor plan. Since the architecture was approved as part of an Architectural and
Site (ASA-2011-08) approval, any changes must be approved with a Director's Minor
Modification.
Interior changes include:
• Construction of a wall in the basement to create a room;
• Relocation of a bedroom, bathroom and dining room with associated changes on the
first floor; and
• Minor floor plan changes in the bathrooms on the second floor.
Exterior modifications include:
• Relocation of two windows to accommodate floor plan changes on the first floor;
• Addition of two windows on the first floor;
• Removal of three windows on the side elevations on the second floor;
• Addition of one clerestory window on the second floor; and
• Minor changes to the windows on the rear elevation to accommodate floor plan changes.
There are no changes proposed to the front elevation. The architectural trim around the
windows being relocated are consistent with those previously approved.
ACTION
The Director of Community Development deems the modifications minor and consistent with
the approved Architectural and Site Approval. The Director thereby approves the proposed
exterior and interior modifications with the following conditions:

Approval is based on exhibits titled: "New Single Family Residence, 10218 Orange Ave,
Cupertino, CA 95014;' prepared by Bruni Marcelic Architect, A.I.A., dated January 2, 2012
and consisting of four (4) sheets labeled A-3.0, A-3.1, A-3.3, A-4.0; except as may be
amended by the conditions contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective February 17, 2012. The fourteen calendar day
appeal period will expire on March 2,2012.
