NO WRITTEN MATERIALS IN PACKET 5 CUPERTINO DRAFT MINUTES CUPERTINO CITY COUNCIL Regular Meeting Tuesday, February 21, 2012 PLEDGE OF ALLEGIANCE At 6:46 p.m. Mayor Mark Santoro called the regular meeting to order in the Council Chamber, 10350 Torre Avenue, Cupertino, California, and led the Pledge of Allegiance. ROLL CALL Present: Mayor Mark Santoro, Vice -Mayor Orrin Mahoney, and Council members Barry Chang Gilbert Wong, and Rod Sinks. Absent: None. CEREMONIAL MATTERS AND PRESENTATIONS - None POSTPONEMENTS - None ORAL COMMUNICATIONS Jeffrey Su, speaking on behalf of his parents, said they received a citation for the fence in front of their house. They have cut down the wooden portion of the fence to allot 3' but the problem is with the brick fence columns that have been there since they bought the house. Mr. Su requested an extension from the Feb. 29 citation due date. Council requested staff to provide the background information and staff agreed to an extension of March 15. Absent: None. Abstain: Wong PUBLIC HEARINGS ORDINANCES AND ACTION ITEMS 8. Subject: Consider locations(s) for an off -leash area for dogs Recommended Action: Consider location(s) for an off -leash area for dogs and give direction to staff Judy Klinger said a lot of time and money has already been spent with polling and past discussion, and the issue of safety needs to be taken into account. She cited a recent dog attack of an elderly woman in an area involving two off -leash dogs. Sandra James asked Council to give Memorial Park a try to offset the decay from duck feces and associated health issues that it causes. 7 Tuesday, February 21, 2012 Cupertino City Council Successor to the Redevelopment Agency Tmima Koren suggested that the City allocate more funds to clean Memorial Park and have the dog park. Darcy Paul, Parks and Recreation Commissioner, said he grew up with dogs and the park is a good place for dogs to run around. He suggested that dog owners share the space with those that want to use the park and to use retractable fencing for particular parts of the day. Richard Robinson said he supports the dog park and prefers it to be at Memorial to support the Veterans. He said the Godbe survey is not statistically valid because only the people that are motivated and organized are going to return the ballots. He said it would be better to call people instead of sending out mailers. Helene Davis said she is in favor of the dog park because they work in other cities and foster community. Eric McKinlay said that the dog park is a good idea but realizes there are counter arguments. He wants a place to take his dog but is not looking for lots of improvements. Irene Ludwikow said Memorial Park is the only place she can walk and an off -leash dog park is a very serious problem and said could be a victim. She asked Council to take into consideration residents like her and that having off -leash dogs in the park does not honor the Veterans. David Fung, Parks and Recreation Commissioner and long time resident, presented an example of a Mission Viejo City lawsuit relating to dog parks. He said a large percentage of residents are opposed to dog parks and urged Council to find another non -park location. Ilango Ganga said he lives near the Library Field and doesn't want dogs to congregate during traffic hours, school hours, or during library hours. Delores Carson said Memorial Park is a better spot but policing would not work there. She suggested putting money into Mary Avenue by cleaning it and fencing it in and also noted that parking is better there than at the Library Field. Corky Axelson, speaking on behalf of the Veterans at Memorial Park, said there is a problem with cleanliness and they have to cleanup daily. He encouraged trying a dog park for a couple hours at day at Memorial Park which might help with the cleanup. Ardith West said she opposes the off -leash dog park locations because it could be hazardous for the seniors at the Senior Center. She also noted that the geese might move to Jollyman Park from Memorial Park, and the nearby homes at Library Field might be disturbed. She suggested working with the County on a trial basis at Stevens Creek Reservoir Park or the Mary Avenue location. Tuesday, February 21, 2012 Cupertino City Council Successor to the Redevelopment Agency Jim Black suggested posting signs with a notice of fines, using dog patrols to scare the geese like at Shoreline golf course, physically removing the geese at Memorial, or trying already fenced -in parks like Linda Vista or Wilson. Suzette Pangrle said she is in favor of an off -leash dog park as a way to get to know her neighbors and said she prefers a fenced -in area. Hari Guleria said he is in favor of a fenced -in dog park and suggested using dog patrols and off hours at the Library field when no children are present by changing the proposed use times. Betsey Dougherty said she is in favor of a fenced -in park at the Library Field because it would be safer for kids and wouldn't detract from the park, like at Eagle Park in Mountain View. She said she would like to give it a try. Claudette Miller said she has lived a block and half from the Library field for 32 years and said it is about time we got a dog park. She cited that most bites are done by the family dog or a neighbor's dog. She suggested working together and urged Council to approve an off - leash area. Don Krenn asked Council to support the right of citizens for an off -leash area and to move ahead with the proposal as stated. He commended Council for budgeting and finding a location, and helping to get rid of the geese at Memorial. Sinks moved and Wong seconded to promote Mary Ave. as a dedicated dog park from dawn to dusk; have the Parks & Recreation Commission set specific guidelines for usage within reasonable parameters; notice residents within 1500 feet or whatever is customary; and direct staff to find up to $350,000 to sequester the lead and add artificial surface, or make the surface decision a Capital Improvement Project (CIP) in the next budget cycle. After clarifying that Council had previously approved the Mary Ave. dog park, Sinks amended his motion to reinforce the Council's prior action and directed staff to move forward with the additional budget allocation totaling $350,000 rather than $250,000, seeking Council's approval for the increased funding. Wong agreed with the amendment. Sinks further amended his motion that, after expert review and after finding a way to properly sequester the lead so that it isn't a hazard to humans or dogs, put the extra money toward a surface that would work year- round. Wong agreed with the amendment. The motion carried with Vice Mayor Mahoney voting no. Approve the Public Tree Damage or Removal Fee Schedule Description Municipal Code Amendment to Chapter 14.12 (Trees) of the Cupertino Municipal Code regarding responsibilities of public tree management, increasing penalties for damaging /removing public trees and meeting requirements to become a Tree City USA (see Attachment A — Draft Ordinance). Discussion Municipal Code Chapter 14.12 regulates public trees of the City. Public trees include trees adjacent to the edge of the street and on medians (street trees) and trees in parks and other property owned by the City. Maintenance of public trees is the responsibility of the City and includes all care from planting, trimming, pest management and removal. Chapter 14.12 currently allows for residents to apply for a permit to trim or remove street trees; however issuing permits to residents has not been necessary because the City has always provided such a high level of service upon receiving calls from residents with concerns or requests regarding street trees, and no permits have been issued or even requested. Additionally, it is in the City's best interest to consistently provide tree maintenance with our trained and experienced City tree crew staff, since public trees not maintained properly can present a safety liability. When the City has become aware of others trimming street trees, the circumstances are investigated and a fine of $100 for the first violation, $200 for the second violation and $500 for a third violation will result. An additional fine of $150 for doing work on City property without an encroachment permit will also be levied. When severe trimming (more than 25% of the tree removed) or complete removal has occurred, the conditions of Chapter 14.18 (Protected Trees) have been applied. Chapter 14.18 identifies street trees as protected trees. When protected trees have been severely trimmed or removed without a permit, the person responsible for the action has been required to submit for a retroactive tree removal permit at a cost of $2,937 per tree. On average there have been fewer than ten removals of healthy street trees per year. 35 The current penalties levied for damage to or removal of public trees may not be proportional to the value that street trees provide to our community. The damage or removal of any one of the approximately 13,000 street trees is likely to result in the loss of a desirable healthy large tree. A common tree that is removed is a Modesto Ash, 30 inches in trunk diameter. Using an objective appraisal method, as provided by the Guide for Plant Appraisal (published by the Council of Tree and Landscape Appraisers), the value of this tree is $24,000. The most common species of street trees is the Crape Myrtle and the average diameter of all street trees is 11 inches. If an 11 inch Crape Myrtle were removed, the value is $3,900. If the same tree is removed but the species is a Chinese Pistachio (second largest segment), the value is $3,460. If a Liquid Amber (third largest segment) is removed, the value is $1,520. These dollar values are based upon species, condition, trunk diameter, location and costs of planting a 4 inch diameter replacement tree. In recognition of the value of street trees, Council adopted a Resolution on September 6, 2011 that will assist the City in applying for designation as a Tree City USA community. To receive this distinction, the City must meet four standards established by the Arbor Day Foundation and the National Association of State Foresters. These standards include observance of an annual Arbor Day, expenditures of $2.00 minimum per capita on tree - related programs, a tree ordinance that requires a written annual forestry work plan and a recognized tree department. The City has met three of these standards - our first annual Arbor Day was held October 22, 2011; current street tree expenditures are in excess of the requirement; and Public Works — Tree Division is the Tree Department for the City. The remaining requirement of a written forestry work plan is addressed in the recommended amendment. The purpose of a work plan includes tree inventories, defining benchmarks to measure success and developing strategies to improve and to encourage citizen involvement. Proposed Changes: The three significant changes are: 1) Removal of permit application language allowing residents to trim and /or remove public trees 2) Escalating penalties depending on tree size to individuals damaging or removing public trees consistent with actual values 3) Addition of language requiring an annual written forestry work plan 4) Addition of language recognizing financial hardship to individuals required to pay penalties In providing a recommendation for the level of fee or penalty to be charged for damage to or removal of public trees, staff has attempted to propose a fee schedule that is significant enough to dissuade those who believe that it may be more efficient for them to cut a tree and pay the consequences, but not so high as to create financial hardship on those that may have cut a tree under less malicious intent. Smaller trees are easier to replace, some species are more desirable than others, and not all trees are in the same condition or have the same contribution to a neighborhood. The Public Tree Damage or Removal Fee Schedule (Attachment F) places a penalty amount for damage to or removal of a public tree. These amounts are based upon averages in terms of species, size and condition and approximately parallel values as would be calculated by the Guide for Plant Appraisal (published by the Council of Tree and Landscape Appraisers). Due to the approximate nature of these penalties, the penalties have been established intentionally under what would be 36 likely calculated on a tree -by -tree basis. This format will not require a consulting arborist to determine valuation. To understand some of the range of how other cities penalize these actions, Saratoga appears to be the only city that does use the formal process of completing an appraisal per the Guide for Plant Appraisal. This method will result in penalties or fees slightly higher than that is recommended in the Public Tree Damage or Removal Fee Schedule. The City of Palo Alto administers a penalty or fee of $100 per inch of tree diameter, which is not reflective of the exponentially higher value of larger trees to the neighborhood, and the inability to plant a replacement tree anywhere near as large as the one that was removed. For example, in Palo Alto the removal of a 14 inch diameter tree would cost $1,400 and under the proposed Public Tree Damage or Removal Fee Schedule, the cost would be $4,900. The proposed ordinance does include a provision that, if a financial hardship is demonstrated, the penalty may be deferred and instead a lien is placed upon the property. Changes to Chapter 14.18 (Protected Trees) are not proposed at this time. Amended Chapter 14.12 (Public Trees) will take precedence over Chapter 14.18 with regards to Public Trees. Public Trees will not be considered Protected Trees. Community Education: Chapter 14.12 proposed changes will be accompanied by outreach to City property owners to increase their level of awareness and to help avoid inadvertent violations of the code sections. It is in the best interests of the City and of the citizens and public thereof that a comprehensive plan for the purchase, planting and maintenance of public trees within the City should be developed and established; and that this chapter is adopted for the purpose of developing and providing for such a plan and program, and for establishing rules and regulations relating to the planting, care and maintenance of public trees; for the purpose of providing for the continued maintenance of the public trees and to provide for the funds to implement this purpose by establishing a requirement for the payment of reimbursement costs to City to plant street trees as a condition to the issuance of a building permit, when applicable, or as a result of damage to or removal of existing trees. In establishing this plan and program, the health, safety, welfare and quality of life for residents is promoted. It is also the intent of this chapter to encourage the preservation of trees. 14.12.020 Definitions. A. "City" means the City of Cupertino. B. "City Forestry Work Plan" means a plan written and annually updated by the Tree/Right of Way Supervisor. This plan includes the adoption of arboricultural standards for public trees and other public area tree care operations, establishment of near and long -term tree management and the promotion of tree care education and outreach programs. C. "Damaged or Removed Public Tree Fee Schedule" means to determine fee for damage to tree branches and roots and to determine fee for removed public trees. D. "Excessive Pruning" means removal of more than 25% of functioning leaf and stem area of a public tree in any 12 month period, or removal of foliage so as to cause the unbalancing of a public tree. E. "Hazardous" means an imminent hazard to threat to the safety of persons or property. F. "Master Street Tree List" means a listing of street tree species that may be planted by the Tree Department. G. "New Street Tree Cost Schedule" means an all inclusive cost schedule of direct and indirect labor, materials and equipment to plant street trees as may be required. H. "Owner" means the legal owner of real property fronting on any street of the City, and any lessee of such owner. L "Park Trees" means trees, shrubs, bushes and all other woody vegetation in public parks and public facilities owned by the City, or to which the public has access as a park. J. "Person" means an individual, a firm, an association, a corporation, the lessees, trustees, receivers, agents, servants, employees or contractors. K. "Private Trees" means trees on land lying outside the public right of way of the City. L. "Public Streets" or "Streets" means all roads, streets, avenues, boulevards, alleys, parkways and public rights -of -way, or any portion thereof, of the City. M. "Public Trees" means park trees and street trees collectively. N. "Remove" means any of the following: (1) Complete removal, such as cutting to the ground or extraction, of a public tree; (2) Taking any action foreseeable leading to the death of a tree or permanent damage to its health; including but not limited to excessive pruning, cutting, girdling, poisoning, overwatering, excavating, altering the grade, or paving within the drip line area of a public tree. O. "Street Trees" means trees located on land within the public right of way on all streets, avenues, or ways within the City. 14.12.030 Responsibility. The Tree/Right of Way Supervisor or any other person designated by the City Manager, is the person responsible for the consideration, investigation, the making of findings, reporting and recommendation upon any special matter of question coming within the scope of this chapter. Additional responsibilities shall include the development / annual update and administration of a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of public trees. Such plan will be prepared and shall constitute the official comprehensive City forestry work plan. 14.12.040 Enforcement. The City Manager, or his /her designee, shall be charged with the enforcement of this chapter. 14.12.050 Master Street Tree List. The Tree/Right of Way Supervisor, or his /her designee, is charged with the duty of promptly determining the types and species of street trees suitable and desirable for planting and the public areas in which the conditions under which such street trees shall be planted in. Such determination shall be made by consulting with those familiar with the subject of such plantings, such as landscape architects, arborists, nurserymen and park executives. When such determination has been made the list shall be reported to the City Council. When approved by the City Council the report shall be known as the Master Street Tree List, shall be placed on file in the office of the City Clerk, and shall thereafter be the official determination for the planting of trees. Revisions or changes in the Master Street Tree List may be made from time to time by the Tree/Right of Way Supervisor, in the manner described hereinabove for the development, approval and filing of the original Master Street Tree List. 2 39 14.12.060 Planting Specifications. The Tree/Right of Way Supervisor shall have jurisdiction and control of the planting, setting out, location and placement of all street trees of the City, and shall see that a specie is uniformly planted, as is practical, in a given block and shall likewise have supervision, direction and control of the care, trimming, removal, relocation and replacement thereof. Planting shall conform to International Society of Arboricultural Standards for Tree Operations. 14.12.070 Public Tree Management. The City and its residents share in the care and management of street trees located adjacent to private property. A. The City is solely responsible for the planting, management and care of public trees. B. Property owners are responsible for watering street trees in the right -of -way in front of their homes. C. Property owners are responsible for notifying the City of hazardous or damaged street trees in the right -of -way in front of their homes. D. Property owners are responsible for the trimming and maintenance of private trees that may overhang beyond the property lines of the City, subject to the provisions of Section 14.12.110 and Chapter 14.08: Obstruction of Streets, Section 14.08.020. 14.12.080 Prohibited Acts It is unlawful and it is prohibited for any person other than the Tree/Right of Way Supervisor or his /her designee, for any person to engage in, cause or allow any of the following acts: A. Plant, trim or cause to be planted, trimmed or removed any public tree. B. Cause or permit any activities that may be deemed detrimental to the health of any public tree as determined by the Tree/Right of Way Supervisor. C. Remove, cut, trim, prune, spray, brace, plant, or move, any public tree within the City, or cause the same to be done. D. Intentionally poison, kill, significantly damage the functioning root system of, or remove any public tree within the City, or cause the same to be done. E. Break, injure, deface, mutilate, or destroy any tree or set fire or permit any fire to burn where such fire or the heat thereof will injure any portion of any public tree in the City, nor shall any person place, apply, attach, or keep attached to any public tree or to the guard or stake intended for the protection thereof any wire, rope (other than one used to M support a young or broken tree), sign, paint, or any other substance, structure, thing or device of any kind or nature whatsoever. F. Cause or permit any vegetation to grow on any street tree located adjacent to private property that may have adverse effects on the health of the tree as determined by the Tree/Right of Way Supervisor, or his / her designee. In addition to any other penalty or enforcement provided by law, any person who violates the provisions of this chapter shall be liable for restitution and or mitigation to the City for any damage to a street tree or a park tree. 14.12.090 Public Utilities —Tree Trimming Permit. Any person doing business as a public utility subject to the jurisdiction of the Public Utilities Commission of the state of California and any duly constituted public agency authorized to provide and providing utility service, shall be given a permit from the City Manager, or his / her designee, permitting such public utility to trim, brace, remove or perform such other acts with respect to public trees of the City as may be necessary to comply with the safety regulations of said Commission and as may be necessary to maintain the safe operation of its business. Permittee shall be required to have persons who are qualified to perform the work of tree trimming and maintenance. Any proposed public tree work that meets the definition of "remove" set forth in this chapter shall be first communicated to the Tree/Right of Way Supervisor or his /her designee a minimum of 10 working days prior to the start of any proposed work. The City has the authority to approve or deny removal requests. All work performed must be done to International Society of Arboricultural Standards. 14.12.100 Replacement Tree — Deposit. The Planning Department may as a condition of granting a development permit require the permittee to reimburse the City for expenses to plant street tree(s) within the limits of City property adjacent to private property. The permittee shall deposit the amount specified in the New Street Tree Cost Schedule. 14.12.110 Nuisance — Liability. The Tree/Right of Way Supervisor, or his /her designee, may inspect any private tree or shrub adjacent to or overhanging any public right of way, or any tree or shrub planted adjacent to private property in areas reserved for public trees in the City to determine whether the same or any portion thereof is in such a condition as to constitute a hazard or impediment to the progress or vision of anyone traveling on such public right of way. Any private tree or shrub or part thereof growing upon private property but overhanging or interfering with the use of any public right of way, or any tree or shrub planted adjacent to private property in areas reserved for public trees that in the opinion of the Tree/Right of Way Supervisor or his /her designee, endangers the life, health, safety, or property of the public shall be declared a public nuisance. If the owner of such private property does not correct or remove such nuisance within 5 working days after 4 41 receipt of written notice thereof from the Tree/Right of Way Supervisor, or his /her designee, the Tree/Right of Way Supervisor shall cause the nuisance to be corrected or removed and all costs shall be assessed to such owner. When the nuisance is any tree or shrub planted in areas reserved for public trees, the individual responsible for the planting may, at the opinion of the Tree / Right of Way Supervisor, be required to reimburse the City for all actual costs incurred to remove the tree or shrub. If the individual responsible for the nuisance planting cannot be determined, the City will remove the tree or shrub. Nothing contained herein shall be deemed to impose any liability upon the City, its officers, or employees, nor to relieve the owner of any private property from the duty to keep any private tree upon his property or under his control in such a condition as to prevent it from constituting a public nuisance as hereinabove defined. 14.12.120 Condition for Building Permit. Every person who constructs, remodels or alters any dwelling, commercial or industrial property, or who constructs on any unimproved land or property abutting a public street where approved street trees from the Master Street Tree List do not exist shall pay the required fee, prior to the issuance of a building permit, per the New Street Tree Cost Schedule, for the purchase, planting and maintenance of the street trees by the City. All public trees shall be protected against damage during construction operations. There shall be no storage of materials, tool washout, or vehicle parking near or upon public trees. 14.12.130 New Street Tree Costs and Public Tree Damage or Removal Fee Schedules. A. New Street Tree Costs Schedule The fees imposed by the City to purchase and plant street trees shall be as specified in the New Street Tree Cost Schedule. All planting costs associated with a building permit shall be collected for deposit into the City's general fund prior to the issuance of a building permit. B. Public Tree Damage or Removal Fee Schedule The fees imposed for public tree removal and /or damage to public tree branches and roots shall be as specified in the Public Tree Damage or Removal Fee Schedule. Damage and removal fees collected shall be deposited into the City's tree fund. 14.12.140 Remedies. In addition to all other remedies set forth in this chapter or otherwise provided by law, the following remedies shall be available to the City for violation of this chapter: 'r A. Stop Work - Temporary Moratorium If a violation occurs during development, the City may issue a stop work order suspending and prohibiting all further activity on the property pursuant to the grading, demolition, and /or building permit(s) until the Public Tree Damage or Removal Fee has been determined by the City and paid by the permittee. If a violation occurs in the absence of development, or while an application for a building permit or discretionary development approval for the lot upon which the street tree is located is pending, the Director of Community Development may issue a temporary moratorium on development of the subject property, not to exceed eighteen months from the date the violation occurred. Mitigation measures as determined by the Director of Community Development shall be imposed as a condition of any subsequent permits for development on the subject property. B. Injunctive Relief A civil action may be commenced to abate, enjoin, or otherwise compel the cessation of such violation. C. Costs In any civil action brought pursuant to this chapter in which the City prevails, the court shall award to the City all costs of investigation and preparation for trial, the costs of trial, reasonable expenses including overhead and administrative costs incurred in prosecuting the action, and reasonable attorneys' fees. 14.12.150 Penalty. A. Misdemeanor Any person who violates any provision of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punished as provided in Chapter 1.12. B. Administrative Citation The City may pursue the remedies set forth in Chapter 1.10 in addition to or separately from the remedies provided in Chapter 1.12 C. Measurement of the removal shall be the diameter width at 4.5 feet above the ground. If the tree is multi - trunk, the diameter of the largest trunk is to be multiplied by 1.5 to determine removal fee. If there is tree damage 4.5 feet above the ground, trunk diameter is to be measured 1 foot above ground level and 1 inch is to be subtracted from the diameter to determine removal fee. If the tree is removed to the ground, tree inventory data or other available information will be used to determine the trunk diameter. The penalty for removal of a public tree shall not exceed the trunk formula method of appraised value as determined by the most recent edition of the `Guide, for Plant Appraisal', published by the Council of Tree and Landscape Appraisers. 14.12.160 Financial Hardship and Lien Procedure A. Any person who claims financial hardship from the imposition of a penalty under this chapter, and who is financially unable to make the penalty payment may, in lieu of making the payment, file a request for imposition of a lien upon the real property where the tree or trees were located. This process shall include a hardship waiver which shall include a sworn declaration as described in subsection (C) below. B. The request shall be filed on a hardship waiver application form, available from the City Clerk's office, submitted within 21 days of the determination of penalty. C. The City may waive the requirement of an immediate payment of penalty, issue the hardship waiver and record a lien only if the cited party submits to the City a sworn declaration, together with any supporting documents or materials, demonstrating to the satisfaction of the City Manager or his /her designee the person's actual financial inability to pay the penalty immediately. In determining the cited party's financial ability or inability to pay the penalty immediately, the City Manager or his /her designee shall consider the amount of the penalty imposed, the income of the cited parry, the expenses of the cited parry, and any other factors that are reasonably related to the cited party's ability to pay the penalty amount. "Excessive Pruning" means removal of more than 25% of functioning leaf and stem area of a public tree in any 12 month period, or removal of foliage so as to cause the unbalancing of a public tree. E. "Hazardous" means an imminent hazard to threat to the safety of persons or property. F. "Master Street Tree List" means a listing of street tree species that may be planted by the Tree Department. G. All references to a permit for trees not on the list have been deleted. 14.12.060 Planting Specifications This is 14.12.050 in the current ordinance. Language updated to indicate that the Tree/Right of Way Supervisor is responsible for the planting of public trees. Language for planting guidelines is based upon International Society of Arboricultural Standards as opposed to the prescriptive requirement of the existing ordinance. 14.12.070 Public Tree Management This is 14.12.055 in the current ordinance. Language updated to clarify that the City is solely responsible for the planting, management and care of public trees. Property owners are responsible for maintenance of private trees overhanging beyond property lines. 14.12.080 Prohibited Acts This is all new language. The purpose of the new language is to define prohibit acts by persons other than the Tree/Right of Way Supervisor or his /her designee. 57 14.12.090 Public Utilities — Tree Trimming Permit This is 14.12.070 in the current ordinance. Language updated to his /her designee for consistency. New language requires utility to notify Tree/Right of Way Supervisor a minimum of 10 days prior to work on trees within the public right of way that meets the definition of remove. City has authority to deny requests. All such work is to be to International Society of Arboricultural Standards. 14.12. 100 Replacement Tree — Deposit This is 14.12.090 in the current ordinance. Language updated to indicate that permittee may be required to reimburse City for the expense to plant a tree within the public right of way. Reference to removal permit has been deleted. 14.12.110 Nuisance — Liability This is 14.12. 100 in the current ordinance. Updated language designates the Tree/Right of Way Supervisor as the City employee determining liability of private trees overhanging any public right of way. Added language of when the nuisance is caused by individuals planting trees or shrubs in areas reserved for public trees. 14.12.120 Condition for Building Permit This is 14.12.110 in the current ordinance. Updated language indicates street tree and references the New Street Tree Cost Schedule. New language also requires protection of street trees during construction activities. 14.12.130 New Street Tree Costs and Public Tree Damage or Removal Fee Schedules. This is 14.12.120 in the current ordinance. Updated language refers to the New Street Tree Cost Schedule and Public Tree Damage or Removal Fee Schedule. 14.12.140 Remedies This is all new language. Provides for the remedies of stop work, civil penalties not to exceed seventy five thousand dollars per street tree unlawfully removed or injunctive relief and award of costs caused by civil action. The Public Tree Damage or Removal Fee Schedule is to be applied to determine costs and fees. The maximum fee may not exceed the trunk formula method of appraised value as determined by the most recent edition of the `Guide for Plant Appraisal', published by the Council of Tree and Landscape Appraisers. Existing language provides for penalties of $100, $200 and $500 for each progressive occurrence within one year. 14.12.150 Penalties This is 14.12.140 in the current ordinance. This new language provides that any person violating the provisions of this chapter shall be guilty of a misdemeanor. 14.12.160 Financial Hardship and Lien Procedure This is all new language. Provides a person who claims financial hardship an option, if agreed to by the City, to have the penalty amount imposed as a lien upon real property in lieu of immediate payment. Existing 14.12 sections deleted in entirety include 14.12.055 Tree Maintenance and 14.12.095 Tree Destruction Unlawful and 14.12.130 Appeal. The requirements of 14.12.055 and 14.12.095 have been included in various amended sections. 14.12.130 has been deleted in entirety. ATTACHMENT D Master Street Tree List 1. TRISTANIA. conferta — Evergreen tree with moderate to fast growth to 30 -40 ft. trunk and limbs resemble those of madrone , with reddish brown bark peeling away to show smooth light colored bark. Upright growth with a rounded head, leaves are 4 -6 in. long oval, leathery, bright green. Flowers in clusters 3 -7 in summer 3/4 in. across white to creamy. This tree can be seen on Blaney Ave north of Stevens Creek Blvd. 2. ARBURUS 'Marina' growing 30 -40 ft. tall with abroad dense crown. The upright branches are covered with a smooth mahogony colored bark which exfoliating to expose new bark. Dark green leaves 4 -5 inches long. The pendulous clusters of urn- shaped pink flowers are produced year- round. The fruit that follows is yellow, orange, and dark red. These trees can be seen in the lawn near the main entrance at city hall. 3. PYRUS. callervana. `Aristocrat' — Deciduous tree known as `Flowering Pear'. Grows fast to 30' in height. Pyramidal in shape. Glossy, oval leaves to 3" long. Small, white clustered flowers appear late winter /early spring. Leaves turn to a purple red in fall. Tree can be seen on Stevens Creek Blvd median strip between Blaney Ave & Torre Ave. 4. PISTACIA. chinesis — Deciduous tree known at `Chinese Pistache'. Shade tree growing to 40' in height. Leaves are narrow up to 4' long turning to a vivid red, yellow and orange in fall. Tree can be seen at City Hall on Rodrigues Ave @ Torre Ave. 5. LAGERSTROEMIA X FAURIEI HYBRIDS. 'Tuscarora'— Deciduous tree also known as `Crape Myrtle'. Can grow to 30' in height. 1"— 2" oval, glossy leaves producing deep coral pink flowers in July- September. Considered mildew resistant. Tree can be seen at De Anza Blvd median strip (north -end) between Mariani Ave & 280 Freeway. 6. GINGKO biloba. `Autumn Gold' — Deciduous tree grows to 30' — 50' in height. Broad, fan shaped leaves turning gold in fall. Not generally bothered by insects or diseases. Resistant to oak root fungus.Fruitless. 7. ACER. Rubrum.'October Glory' — A deciduous tree growing to height of 40' — 60' with a spread up to 25' — 45'. Leaves are 2" — 5" long with 3 — 5 lobes. Leaves are green on top with a pale bottom. As fall approaches the leaves turn to a brilliant scarlet red. Tolerates most soils. Occasional deep watering and periodic feeding will help keep roots deep. 8. KOELREUTERIA BIPINNATA `Chinese Flame Tree'. - A deciduous tree growing to height of 30 - 40' with a Spread up to 30 - 40' Blooms in June with yellow showy flower clusters to 15" long. Fruit is inflated papery - walled capsule, turning from red to coppery- colored and brown in the fall.
