Subject: Director's Minor Modification, DIR-2012-10, to a previously approved Architectural
and Site Approval (ASA-2011-16) to allow changes to the rear parking lot
landscaping, walkway material, and relocation of a required pick-up and drop-off
space located at 19885 Stevens Creek Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant is requesting a modification of a previously approved Architectural and Site
Approval (ASA-2011-16) to make additional minor changes to the rear parking lot, specifically
to the area along the west side of the playground. The changes include:
• Different widths of the three landscape finger islands (no net reduction in total landscaping
area)
• Substitution of bollards along the walkway with wheel stops and curbing
• Substitution of the raised concrete walkway with an at-grade stamped concrete walkway
(same grade as the rear entrance to the building)
• Reduction of the walkway width to three feet(not a required ADA accessible pathway)
• Relocation of one of the six required pick-up and drop-off spaces to the north side of the
landscape finger island just north of the remaining five pick-up and drop-off spaces.
Staff supports the proposed modifications because they are in general conformance with the
previously approved Architectural and Site Approval.
ACTION
The Director of Community Development deems the modification minor and approves the
addition with the following conditions of approval:

Approval is based on exhibits titled: "Cort Furniture Rental Showroom and Clearance
Center," prepared by SHK and Associates, dated February 27, 2012 consisting of 6 sheets

labeled A-1, A-7, C-1, C-2, L-1, and L-2; except as may be amended by the conditions
contained in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. PREVIOUS CONDITIONS OF APPROVAL
All prior use permit conditions of approval (U-2009-09) and prior conditions of approval
through past approvals shall remain in effect unless superseded by or in conflict with
subsequent conditions of approval, including conditions of approval for M-2011-07/ASA-
2011-16.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective March 16, 2012. The fourteen calendar day appeal
period will expire on March 30, 2012.
