Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant, Blake Reinhardt, representing ECI Two Results, LLC, proposes minor landscape improvements to the front entry way and driveway median, an art sculpture, replacement ground signage and a new entry canopy on the interior side between Buildings #3 and #4. The changes include: 1) Removing nine trees: seven smaller trunk diameter Crape Myrtles (Lagerstroemia indica) will be given to Apple, Inc. for replanting as part of its tenant improvement project in the office park and two sweet gums (Liquidambar styraciflua). A tree removal permit for these trees, among others, was previously approved in 2008 as part of a larger redevelopment project (TR-2008-06) and later extended multiple years in 2009 (M-2009- 02). The removed and relocated trees will be replaced by 12, 24-inch box Tulip trees. Two existing specimen size oak trees in the re-landscape area will remain. 2) A combination of ground covers and hardscaping will be used to redesign the front entry way and driveway medians as depicted on the plan set. The plans are a more detailed design that is consistent with the conceptual re-landscaped plan approved in 2008 (ASA- 2008-OS) (Exhibit A). 3) A new proposed feature is an art sculpture which consists of two monolithic stone slabs that have been cut on one side to create a smooth surface (see plan set details.) The applicant indicates that this artwork is his voluntary contribution and not the mandatory public art contribution required as part of the 2008 redevelopment project approval. As such, this sculpture need not meet certain minimum cost requirements nor be reviewed and approved by the Fine Arts Commission. 4) The existing office park ground sign will be replaced with two low-profile, ground sign walls constructed of concrete with a Corten steel face. The wedge-shaped, ground signs DIR-2012-09 2 to 6,11to 16 Results Way Page 2 are five feet tall and seventeen feet long (42.5 square feet in area) are designed to complement the raised landscaped beds and frame the entry driveway. The two signs sit on different parcels and meet the City's Sign Code. 5) A new canopy is proposed for the interior side of the connecting building between Buildings #3 and #4 (Exhibit B). The canopy design, materials and color will match the other new canopies approved to be built in this office park. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on Plan Set titled: "Results Way Campus/Results Way /Cupertino, CA/Campus Entry", prepared by Studio Five�Design, consisting of 4 sheets dated 12/15/2001, and labeled L-1.0, L-2.0, L-2.1, and L-3.0, except as may be amended by the conditions contained in this memorandum. 2. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This Director's approval is effective March 16, 2012. The fourteen calendar day appeal period will expire on March 27, 2012.
