Annexation proceedings for territory designated as Cupertino Pockets 06-01, consisting
of the annexation to the City of Cupertino of approximately .:!:,17.38 acres of developed
and undeveloped, unincorporated territory generally bounded by Stevens Creek
Boulevard, Stelling Road, the southerly city limits and Stevens Canyon Road.
RECOMMENDATION:
Staff recommends that the City Council:
A. Conduct the public hearing and accept written protests and withdrawal of
protests.
B. Close the public hearing and ask the City Clerk to determine the value of the
submitted written protests.
C1. If the City Clerk cannot immediately determine the value of the protests,
continue the item to the meeting of October 17th ;
OR
C2. If the protests represent less than 25% of the registered voters who reside in
the affected territory or less than 25% of the landowners of the affected territory,
1. Adopt a Negative Declaration for the project, Cupertino Pockets 06-01;
2. Order the annexation of territory per the model resolution;
OR
C3, If the protests represent 50% or more of the registered voters, terminate the
annexation proceeding.

BACKGROUND:
Annexation strategy On February 2, 1998, the City Council adopted an overall
annexation strategy for three of the larger inhabited, unincorporated pockets in
Cupertino: Rancho Rinconada, Garden Gate and Monte Vista. By late 2004, all three
large pockets were successfully annexed, leaving the Creston neighborhood and a few
scattered small, unincorporated pockets. This annexation proceeding addresses the
latter: .2:.17.38 acres of scattered vacant land or land developed with single-family
dwellings, consisting of eight distinct islands with 18 parcels, 15 single-family dwellings
and about 40 residents (Exhibit A-1).
DISCUSSION:
Public Outreach Staff did extensive outreach with Cupertino Pocket property owners
and residents that included:
a, The mailing of the "Urban Pockets Annexation Questions and Answers"
handout on June 30,2006;
b. A web page on the City of Cupertino website that provides information on
upcoming meetings and on-line documents; and
c. Timely responses to resident questions via telephone, fax, email and personal
contact.
City Taxes and Fees Upon annexation, unincorporated areas receive city services and
are subject to city taxes and fees. The city taxes and fees that would be extended to this
area include:
1. The Utility Users' Tax, which is currently 2.4% of the natural gas,
electricity and local and long distance telephone charges, Homeowners
age 65 or over may apply for utility tax exemption;
2. The Storm Drainage Service Fee, which is currently $12.00 per single-
family or duplex residential parcel per year, $144.00 per acre of apartment,
commercial, or industrial land, and $36.00 per acre of vacant land, on an
annual basis; and
3. The Business License Fee, which is currently $105.00 per year for most
home businesses.
Annexation Protests All registered voters and property owners of the affected territory
are eligible to protest the annexation proceeding in accordance with state law, They
were informed of their protest rights and procedures in the public hearing notice
(Exhibit B-1). Protestors may submit written protests until the closure of the public

hearing. They may also withdraw their protests. Protest valuations are based on the
current registered voter roll and the year 2006-07 equalized assessment roll of property
owners and assessed land valuations. There are 37 registered voters, 30 property
owners and a current assessed land valuation of $7,549,861.
The following are the alternative City Council actions in accordance with state law:
1. Order the annexation if the protest valuation is less than 25% of the registered
voters, and less than 25% of the property owners who own less than 25% of
the assessed land valuation.
2. Order the annexation subject to confirmation by the registered voters of the
affected territory if the protest valuation is more than 25%, but less than 50%
of the registered voters, or more than 25%, but less than 50% of the property
owners who own at least 25% of the assessed land valuation.
3. Terminate the annexation proceeding if the protest valuation is 50% or more
of the affected registered voters.
To reach the protest levels required to have an election (minimum 25%), protesters must
have at least 10 valid protests from affected registered voters, or at least 8 valid protests
from property owners who own a combined assessed land valuation of at least
$1,887,465,25.
A valid written protest from one individual has been received as of September 25, 2006.
This protest represents one registered voter (2.7%), one property owner (3.33 %) and an
assessed land valuation of $257,743.50 (3.41 %). New property owners not on the
current assessment roll must provide satisfactory evidence of property ownership to the
City Clerk for their protests to be validated. Staff expects that additional protests will
be submitted on October 3, 2006.

A RESOLUTION OF THE CUPERTINO CITY COUNCIL MAKING
DETERMINATIONS AND ORDERING THE ANNEXATION OF TERRITORY
DESIGNATED "CUPERTINO 06-01," CONSISTING OF THE ANNEXATION OF
ABOUT 17,38 ACRES OF TERRITORY GENERALLY BOUNDED BY STEVENS
CREEK BOULEVARD, STELLING ROAD,
SOUTHERLY CITY LIMITS AND STEVENS CA1\TYON ROAD
WHEREAS, on September 5, 2006, the City Council adopted Resolution No. 06-
153, initiating proceedings for annexation of the area designated "Cupertino Pockets 06-
01"; and
WHEREAS, Section 56757 of the California Government Code states that the
Local Agency Formation Commission shall not have any authority to review an
annexation to any City in Santa Clara County of unincorporated territQry which is within
the urban service area of the city of the annexation if initiated by resolution of the
legislative body, and therefore the City Council of the City of Cupertino is now the
conducting authority for said annexation; and .
WHEREAS, said territory is inhabited and all owners of land included in the
proposal have not consented to this annexation; and
WHEREAS, in accordance with Section 56157 of the California Govenunent
Code, the City of Cupertino has provided mailed notice of the initiating hearing on the
annexation to all property owners of record and registered voters within 300 feet of the
exterior boundary of the affected territory, affected agencies and other interested parties;
and
WHEREAS, in accordance with Section 57025 of the California Government
Code, the City of Cupertino has provided mailed notice of the protest hearing on the
annexation to all affected property owners and registered voters, affected agencies and
other interested parties, along with notification of eligibility of the affected property
owners and registered voters to protest this City-initiated proceeding and instructions on
how to prepare a valid, written protest; and
WHEREAS, the City of Cupertino opened and conducted a public hearing on the
annexation in accordance with Section 57050 of the California Govenunent Code, to
accept protests and withdrawals of protests, objections or evidence which is made,
presented, or filed; and
WHEREAS, the City of Cupertino, subsequently closed the public hearing on
October 3, 2006, and intends to determine the value of the written protests in order to take
the appropriate action on the annexation; and

WHEREAS, the City Clerk has determined that the valid protests received from
affected property owners of record and affected registered voters had insufficient value in
accordance with State law, to require an election on the annexation,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino as follows:
1, That it is the conducting authority pursuant to Section 56757 of the California
Government Code for the annexation of territory designated "Cupertino Pockets
06-01 ", more particularly described in Exhibits "A & B";
2, That the following findings are made by the City Council of the City of Cupertino:
a, That said territory is inhabited and comprises approximately 17.38 acres.
b, That the annexation is consistent with the orderly annexation of territory
within the City's urban service area and is consistent with the City policy
of annexing when providing City services,
c. The City Council has completed an initial study and has found that the
annexation of said territory has no significant impact on the environment,
and approves the granting of a Negative Declaration.
d, The City Council has prezoned the subject territory that constitutes the
entirety of the subject annexation to pre-ML-rc on May 1, 1967, pre-RHS-
21 on May 6, 1996, Pre-RHS or Pre-RI-6 on September 8, 1981, Pre-
RHS-40 on'June 19, 1995 or May 6, 1996; or prezoned the territory to pre-
RI-6 on September 8, 1981.
e. That the territory is within the city urban service area as adopted by the
Local Agency Formation Commission (LAFCO).
f. That the County Surveyor has determined the boundaries of the proposed
annexation to be definite and certain, and in compliance with the
LAFCO's road annexation policies, The County has waived its
certification fees that are normally imposed on the city/conducting
authority,
g, That the proposed annexation does not create islands or areas in which it
would be difficult to provide municipal services.
h, That the proposed annexation does not split lines of assessment or
ownership as determined by the Santa Clara County Assessor's Office.
1. That the proposed annexation is consistent with the City's General Plan.

J, That the territory to be annexed is contiguous to existing City limits under
provisions of the Government Code.
k. That the City has complied with all conditions imposed by LAFCO for
inclusion of the territory in the City's urban service area.
. 1, That _ valid protests to the annexation proceeding were received by the
Clerk of the City of Cupertino, and the value of those protests submitted
prior to the close of the public hearing constituted _% of the 37
registered voters residing in the affected territory; and _% of the 30
property owners who own _% of the $7,549,861 total assessed land
valuation and that the last equalized' County assessment roll and Registrar
of Voters list of registered voters within the unincorporated area were used
to make these determinations.
BE IT FURTHER RESOLVED:
A) City of Cupertino taxes and fees will be extended to this territory, which
includes:
1) The Utility Users' Tax of 2.4% of the natural gas, electricity, local and
long distance telephone charges;
2) The Storm Drainage Service Fee on an annual basis is $12,00 per
single-family or duplex residential parcel; $144.00 per acre of
apartment, commercial, or industrial land, and $36.00 per acre of
vacant land;
3) The Cupertino Business License Fee applicable to businesses in the
City and currently $105.00 per year for most home-based businesses.
NOW, THEREFORE, be it resolved that the City Council ofthe City of Cupertino hereby
approves and orders the annexation of territory designated "Cupertino Pockets 06-01"
without an election, and that annexation consists of the annexation of about 17,38 acres
of territory to the City of Cupertino, generally bounded by Stevens Creek Boulevard,
Stelling Road, the southerly City limits and Stevens Canyon Road.

NOTICE OF PUBLIC HEARING OF THE "CUPERTINO
POCKETS" ANNEXATION
NOTICE IS HEREBY GIVEN that at their regular meeting of Tuesday, October 3,2006, the Cupertino City
Council will conduct a public hearing to consider the annexation to the City of 17.38 acres of unincorporated
territory designated as "Cupertino Pockets 06-01," generally bounded by Stevens Creek Boulevard, Stelling
Road, the southerly city limits and Stevens Canyon Road (See enclosed maps).
In connection with this annexation of territory, there will be a concurrent extension of City of Cupertino
taxes and fees to this area. The taxes and fees include:
1. The Utility Users' Tax, which is currently 2.4% of the natural gas, electricity, local and long distance
telephone charges. Homeowners age 65 or over may apply for a utility users' tax exemption at City
Hall.
2. The Storm Drainage Service Fee, which is currently $12.00 per single-family or duplex residential
parcel, $144,00 per acre of apartment, commercial or industrial land, and $36,00 per acre of vacant
land, on an annual basis.
3. The Business License Fee applies if you have a home business in Cupertino. The annual fee is
currently $105.00 for most home businesses.
Only written legal protests, dated between September 5,2006 and October 3,2006, from registered voters or
property owners of the affected Cupertino Pockets parcels will be counted toward the protest of the
annexation proceeding in accordance with State law. Instructions for preparing a valid, legal protest are
enclosed for registered voters and property owners of the affected territory (See maps). The City Council
meets at 6:45 p.m., Community Hall, 10350 Torre Avenue, Cupertino, California. Interested parties are
invited to attend and be heard. If you wish to challenge the City Council's action in court, you may'be
limited to raising only those issues you or someone else raised at the public hearing described in this notice,
or in written correspondence delivered to the City of Cupertino City Clerk's Office, at or prior to, the public
hearing.
For new Cupertino Pockets residents and property owners, the City has a limited supply of the "Urban

Cupertino, there are certain requirements to make a valid protest. The protest must be submitted
in the following manner to the Cupertino City Clerk by the close of the public hearing on this
item, October 3,2006. All of the information listed below must be included.
IF YOU ARE A CUPERTINO POCKETS RESIDENT, BUT NOT A CUPERTINO
POCKETS PROPERTY OWNER:
D You must be a resident of the Cupertino Pockets area proposed for annexation (See maps).
D The protest must be in writing, dated and signed, Print your name as well.
D The protest must oppose the annexation by name, which is "Cupertino Pockets 06-01".
D You must provide your street address,
D You must be a registered voter at your current address for your protest to count.
OR
IF YOU ARE A CUPERTINO POCKETS PROPERTY OWNER:
D You must be a property owner of the Cupertino Pockets area proposed for annexation (See
maps).
D The protest must be in writing, dated and signed, Print your name as well.
