SUBJECT AND ISSUE
Adopt a resolution authorizing the Director of Public Works to negotiate and execute a
cost-sharing agreement between the Cities of San Jose and Cupertino for additional
Cupertino traffic system improvements to be constructed as part of the Silicon Valley
Intelligent Transportation Systems West Corridor Project.
BACKGROUND
On January 22, 2002, City Council authorized the City Manager to execute a
Memorandum of Understanding (MOD) relating to the Silicon Valley Intelligent
Transportation Systems (SV-ITS) Program. The parties to the MOU include the
California Department of Transportation, California Highway Patrol, City of Campbell,
City of Cupertino, City of Fremont, City of Milpitas, City of San Jose, City of Santa
Clara, County of Santa Clara, Metropolitan Transportation Commission, Valley
Transportation Authority, and the Town of Los Gatos. The MOU acknowledges the
agreement of all parties to coordinate activities and work cooperatively in the
development and implementation of ITS projects in Silicon Valley.
The purpose of the SV ~ITS Program is to deploy projects to permit multi-agency
coordination of traffic operations along freeways, expressways and arterials in Santa
Clara County and neighboring counties in order to mitigate congestion resulting from
incident and day-to-day traffic. One of these projects is the SV-ITS West Corridor
Project. This project, which is currently being put out to bid by the City of San Jose, will
coordinate traffic signals and install CCTV cameras on Stevens Creek Boulevard and will
also connect with key Caltrans traffic signals at the interchanges of SR-85/Stevens Creek
Boulevard, I-280/Stevens Creek Boulevard, and I-880/Stevens Creek Boulevard.
The approved Cupertino Capital Improvement Program budget includes $35,000.00 for
extension of fiber optic cable and related improvements along Stevens Creek Boulevard
to provide additional interconnectivity between the traffic signals, work which is
currently outside of the scope of the SV - ITS West project. The cost-sharing agreement
will allow the City of San Jose to include these improvements within the scope of the
larger SV-ITS West project, ultimately resulting in a savings in cost and staff time for the
City of Cupertino.

FISCAL IMPACT
Execution of the cost-sharing agreement will require an expenditure from the approved
ClP Account # 420-9555 of up to $35,000.00. Sufficient funds are available in the
account.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND EXECUTE

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino
hereby authorizes the Director of Public Works to negotiate and execute a cost-sharing
agreement between the Cities of San Jose and Cupertino for additional Cupertino traffic system
improvements to be constructed as part of the Silicon Valley Intelligent Transportation Systems
(SV-ITS) West Corridor Project.

Cupertino this 17th day of October 2006, by the following vote:
