The petitioner is Jane Wu. The project is located on the southwest corner of North De Anza Boulevard and Mariani Avenue. RECOMMENDATION The City Council can take any of the following actions: 1) Uphold the petitioner's reconsideration request of U-2006-06, ASA-2006-06 and TR-2006-09 and deny the aforementioned applications; Or 2) Deny the reconsideration by making required findings outlined by the City Attorney. Environmental Assessment: Reuse Mitigated Negative Declaration BACKGROUND: On August 15,2006, the City Council heard the request to redevelop this property to a new 60,000 square foot office building and remove a number of trees to allow the development (Exhibit A). The petitioner, Mrs. Wu and related parties, attended the hearing and testified as to their dissatisfaction with the site planning and design of the 1&- ( U-2006-06, ASA-2006-06, TR-2006-09, EA-2006-09 Page 2 October 17, 2006 project, particularly the parking structure, which they felt would have negative impacts on her acupuncture clinic business. The Council took in the testimony, deliberated at length and approved the project with additional conditions of approval and a new finding attached to the Planning Commission's resolutions of approval (Exhibit B). 1) The new finding was that the project is not unreasonably detrimental to the adjacent property provided that the conditions of approval are met; 2) Traffic mitigation is capped at $25,000 subject to the satisfaction of the Director of Public Works; 3) Delete condition #14 from the use permit and AS A, pertaining to consent of adjacent property owner prior to issuance of building permits; 4) Levy lump sum sales-tax-in-lieu fee of $181,610 and cap it at this amount to address general plan policy No. 2-42. Condition subject to any future implementation of policy 2-42 that may allow for rebate or partial rebate of the fee if office tenants are revenue generating; and 5) Design of garage is subject to review by the Design Review Committee with Council direction to lessen the visual impact of the structure on the adjacent office building (Mariani Business Center). This may include: . Using a smaller footprint parking garage, such as the one approved by the planning commission; . Setting back the garage as far as possible from the rear property line nearest the Mariani Business Center; . Landscaping around the parking structure to soften the view of the structure from the Mariani Business Center; . Flipping the garage, so the less massive ramp is closer to the Center; and . Lower garage height by depressing garage 1/2 level below grade. DISCUSSION: Subsequently, the project applicant applied for ASA for a revised garage design and this application file no. ASA-2006-16 was reviewed by the Design Review Committee on September 21, 2006 (Exhibit C). The redesign incorporated the Council directions and provided additional improvements. The petitioner, Mrs. Wu, was pleased with the redesigned garage and supported it at the DRC hearing. The DRC approved the ASA on a 2-0 vote. PETITIONER'S RECONSIDERA nON REQUEST: The petitioner, Mrs. Wu, alleges flaws in the hearing process that prevented a full and fair hearing of her concerns about the project (Exhibit D). The City Attorney has responded to each point made by the petitioner in her reconsideration request (Exhibit E). Whereas, Application No. U-2006-06, a use permit for the construction of an office building and parking garage, to be located at 10495 N. De Anza Blvd. in Cupertino, ASA-2006-06, TR- 2006-09, and EA-2006-09, a mitigated negative declaration, was approved by the City Council with conditions on August 15,2006; and Whereas, Jane Wu has requested that the City Council reconsider its decision under the provisions of section 2.08.096 of the City's ordinance code; and Whereas, the City Council has considered all relevant evidence presented by the parties at all hearings, including evidence presented at the October 17, 2006 reconsideration hearing. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 1. The petitioner's Reconsideration Petition is defective on its face in that it does not offer proof of facts as required by Municipal Code section 2.08.096. 2. The petitioner has made no offer of new relevant evidence that, in the exercise of reasonable diligence, could not have been produced at any earlier city hearing. (See Municipal Code 9 2.08.096B(1).) 3. The City Council did not exclude any evidence presented by the petitioners at any prior city hearing. (See Municipal Code 92.08.096B(2).) 4. The City Council has proceeded entirely within its jurisdiction regarding the application for a use permit. (See Municipal Code 9 2.08.096B(3).) 5. The petitioner has failed to present any evidence that the City Council failed to provide a fair hearing. (See Municipal Code 9 2.08.096B(4).) 6. The petitioner has failed to demonstrate that the City Council abused its discretion regarding the application. (See Municipal Code 9 2.08.096B(5).) Specifically, the City Council determines that: a. The City Council proceeded in a manner required by law. b. The City Council's decision is supported by findings of fact. c. The findings of fact related to the City Council's decision were supported by substantial evidence in the record of proceedings. (& -L( 7. The building was originally constructed for Any Mountain ski retailer in 1976, but was subsequently allowed to convert to office use in 1997 and was occupied by Packeteer for several years before becoming vacant. DISCUSSION A number of significant project issues were identified during the Commission hearing process: Planning Commission Issues: . The Planning Commission recommended approval of the Negative Declaration, ASA and Tree Removal request on 5-0 votes. The Use Permit was approved on a 4-0-1 vote (Giefer abstained). The ASA approval and use permit approval were based on the office project including the revised parking structure design submitted by the applicant during the hearing (Alternative A), which had a larger rear setback and one level of underground parking. The Commission recommendations of approval included recommendations for: . Traffic operational analysis. . A requirement that the applicant obtain recorded written consent from the adjacent property owner for the change in the parking configuration per the reciprocal parking easement (See later staff discussion). . The City Council to determine the level of compliance needed for General Plan Policy 2-42, Revenue Analysis of the Office Development, which requires new office developments greater than 50,000 square feet to provide revenue benefits to the City (See later staff discussion). Applicant Issues: At the Commission hearing, the applicant submitted a revised parking structure design that increased the rear setback from 3 feet to about 16 feet, and created one level of underground parking. The previous design had three levels of parking above ground. There were no revisions to the office building. This revised garage design is shown as Exhibit A and is part of the Planning Commission recommendation of approval. (~-I Applications: U-2006-06, ASA-2006-06, TR-2006-09, EA-2006-u9 Page 3 August IS, 2006 The applicant has verbally indicated to staff that it prefers its original parking structure design that is part of the submitted plan set (no underground parking, 3-foot rear setback) and desires Council consideration of that design. Public Issues: Five members of the public spoke about the project. Some expressed concerns about the size of the building/ parking structure, which might create vacancies among the other surrounding buildings, resulting in pressure to convert office buildings to housing. Most were worried about additional traffic impacts to the area, particularly with the existing congestion at Mariani Avenue and the N. De Anza Boulevard intersection during the evening commute hours. One speaker suggested a new traffic light at Bandley Drive and Mariani Avenue. The adjacent office building/ property owner was concerned that she would have to look out at the parking garage structure from her office window and felt the parking structure was too close to her property. She provided the Commission and City Attorney with a copy of a reciprocal parking and ingress/ egress easement that she owned on the project site. She addressed a letter to the Planning Commission after the hearing (Exhibit B). StafjIssues: Traffic. In his June 13, 2006 trip generation comparison report (Exhibit C), the traffic consultant, Pang Engineers, concluded that the net increase in peak hour trips during the AM peak hour (52 trips), and the PM peak hour (50 trips) created an insignificant. impact on traffic. At the request of the Planning Commission, further traffic analysis was completed to look at the operational aspects of the Mariani/N. De Anza intersection, turning movement counts, traffic queues, and estimated trip distribution. In his August I, 2006 report, which has already incorporated staff review and comments (Exhibit D), Pang Engineers observed the operational problems ,of the Mariani/N. De Anza intersection and made several recommendations and other considerations to improve the intersection traffic flow. 1. Retain existing lane designations and striping. 2. Prohibit on-street parking on both the north and south sides of Mariani A venue from Bandley Drive to N. De Anza Boulevard. 3. Increase the" green" time of the signal light controlling the eastbound left turn movement on Mariani Avenue to northbound N. De Anza Blvd. to clear the traffic. Other considerations suggested by the traffic consultant are: 1& -~ Applications: U-2006-06, ASA-2006-06, TR-2006-09, EA-2006-u~ Page 4 August 15, 2006 1. Add "Do Not Block Intersection" signs on all four approaches to the intersection. Provide police enforcement during PM peak hours. 2. Consider prohibiting U-turn movements from southbound N. De Anza Blvd. at Mariani A venue during the 4-7 p.m. peak period. 3. Provide more in-depth evaluation of the operation of the BJ's Restaurant driveway on N. De Anza Blvd. 4. Upgrade the traffic signal controller cabinet for this intersection. Staff is recommending these traffic improvements be included as a condition of approval subject to the satisfaction of the Director of Public Works. Parking Easement. The owner of the abutting property to the rear, Mariani Business Center, LLC/Jane Wu, presented recorded easement language to the Commission that indicates her legal interest in the parking and vehicular access of the applicant's property (Exhibit B). Lik~wise, the applicant owns an easement for parking and access on Mariani Business Center's property. The easement language of concern reads as follows: "... The owner of Parcel A and the owner of Parcel B, respectively, each may relocate and reconfigure the parking spaces on their respective properties so long as same remain reasonably accessible to the tenants, occupants, invitees, and guests of the other parcel and so long as the number of spaces are not reduced below said number. Any reconfiguration or reduction in number of spaces shall require the recorded written consent of the owner of the other Parcel." The situation appears similar to the one between Greg Bunker and the owners of Yamagami Nursery and Mr. Bunker's attempts to redevelop his property. After consulting with the Assistant City Attorney, the Planning Commission recommended adding a development condition that tied development approval to the requirement of obtaining recorded written consent from the adjacent property owner for the parking reconfiguration. Planning staff prefers that the City not insert itself in this disagreement between the two property owners over the easement language. Conformance with General Plan Policy 2-42: Revenue Analysis of Office Developments. This General Policy states that: "In reviewing office development proposals, l;?ncourage office uses and activities that generate significant revenues to the City, such as local sales offices, capturing point of sale internet transactions and business to business tax revenues. New office development exceeding 50,000 square feet shall be approved only if one of these or similar benefits are provided." As this is a speculative office development with no current prospective tenant, it is not possible to perform this type of revenue analysis. The City Council has not discussed how this policy would be implemented, and the Planning Commission requests that the (~-( Applications: U-2006-06, ASA-2006-06, TR-2006-09, EA-2006-u':J Page 5 August 15,2006 Council undertake this determination with respect to this 60,000 square foot office building. The Director of Administrative Services is developing some alternative strategies for implementing this policy. Her work is not completed yet to be included in this staff report, but will follow shortly and be available before the hearing. BICYCLE PARKING The applicant shall provide bicycle parking and bike racks for the proposed project in accordance with the City's Parking Regulations under Chapter 19.100 of the Cupertino Municipal Code. 6. DEMOLITION REQUIREMENTS All demolished building and site materials shall be recycled to the maximum extent feasible subject to the Building Official approval. The applicant shall provide evidence that materials will be recycled prior to issuance of final demolition pennits. 7. DEVELOPMENT ALLOCATION The applicant shall receive an allocation of 33,000 square feet of the office industrial allocations for the North De Anza Boulevard Planning Area. 8. LANDSCAPE PLAN The applicant shall submit a detailed landscape and irrigation plans to be reviewed and approved by the Director of Community Development prior to issuance of building pennits. The landscape plan shall include: a) water conservation and pesticide reduction measures in confonnance with Chapter 14.15, Xeriscape Landscaping, and the pesticide control measures referenced in Chapter 9.18, Stonnwater Pollution Prevention and Watershed Protection, of the Cupertino Municipal Code. b) Four 48" box Arbutus Marina trees in lieu of the 24" box trees proposed. c) Landscaping where feasible to soften the appearance of the westerly side of the parking structure. 9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation require~ents, and other exactions. Pursuant to Government Code Section 66020( d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally balTed from later challenging such exactions. 10. PUBLIC ART The applicant shall install public art onsite prior to final occupancy. The public art shall be valued at a minimum of one-quarter percent (1/4%) of the total project budget, not to exceed $100,000. The applicant shall submit a public art plan to be reviewed by the Fine Arts Commission prior to installation of the public art. r~ -{ J U-2006-06 4 August 22, 2006 11. SCREENING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. No parking or storage of materials shall be allowed under the protected trees. 12. TREE PROTECTION Prior to the issuance of grading and demolition permits, the applicant shall enter into a contract with an ISA-certified arborist to review and comment on all construction drawings and monitor grading, demolition and building construction to ensure that the recommendations described in an arborist report titled: "Tree Assessment and Recommendations for the Redevelopment Project Proposed at 10495 North De Anza, Cupertino, California, " prepared by Walter Levison and dated 5/12/06. Applicant shall provide a copy of the contract to the Director of Community Development. No parking or storage of materials shall be allowed under the protected trees. The tree protection measures shall be inspected and approved by the certified arborist with a confirmation letter sent to the Director of Community Development prior to issuance of grading and demolition permits. The supervising arborist shall monitor construction activities and prepare a final report ascertaining the health of the protected trees plior to issuance of final occupancy. 13. TREE PROTECTION BOND The applicant shall provide a tree protection bond in the amount of $100,000 to ensure protection of the trees slated for preservation prior to issuance of grading, demolition or building permits. The bond shall be returned after completion of construction, subject to a letter from the City arborist indicating that the trees are in good condition. 14. APPROVAL OF PARKING LOT RECONFIGURATION (Council deleted this condition) SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT 15. STREET WIDENING Street widening and dedications shall be provided in accordance with City Standards and specifications and as required by the City Engineer. 16. STREET LIGHTING INSTALLATION Street lighting shall be installed and shall be as approved by the City Engineer. Lighting fixtures shall be positioned so as to preclude glare and other forms of visual interference to adjoining properties, and shall be no higher than the maximum height permitted by the zone in which the site is located. 18. FIRE HYDRANT Fire hydrants shall be located as required by the City and Santa Clara County Fire as needed. 19. GRADING Grading shall be as approved and required by the City Engineer in accordance with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404 permits maybe required. Please contact Anny Corp of Engineers. and/or Regional Water Quality Control Board as appropriate. 20. DRAINAGE Drainage shall be provided to the satisfaction of the City Engineer. 21. FIRE PROTECTION Fire sprinklers shall be installed in any new construction to the approval of the City as needed. 22. UNDERGROUND UTILITIES The developer shall comply with the requirements of the Underground Utilities Ordinance No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected Utility provider and the City Engineer. 23. RECOMMENDATION: Staff recommends approval of file no. ASA-2006-16 per the model resolution. BACKGROUND: On August 15, 2006, the City Council approved a use permit and ASA for a 3-story, 60,000 square foot office building with parking structure to be located at 10495 N. De Anza Blvd. In its conditions of approval, the City Council directed the applicant to seek ASA approval through the DRC for the final design of the parking structure as its mass and location had negative visual impacts on the adjacent office building (Mariani Business Center) toward the rear. The Council provided design direction for the garage using the Commission-recommended parking structure as a reference point (Exhibit A). The DRC may include the following items in its considerations: 1) Use a smaller footprint parking garage, such as the one recommended for approval by the Planning Commission; 2) Setting back the garage as far as possible from the rear property line nearest the Mariani Business Center (MBC); 3) Landscaping around the parking structure to soften the view of the structure from the Mariani Business Center; 4) Flipping the garage, so the less massive ramp is closer to the Mariani Business Center; and 5) Lower garage height by depressing garageV2level below grade (Council did not favor under grounding the parking). DISCUSSION: The key consideration is creating as wide a separation between the Mariani Business Center (labeled "OFFICE" on the plan set) and the parking structure. The adjacent property owner was concerned about the garage mass looming over her building and the openness of her view from her ground level office. The project architect has accomplished this by contracting the garage footprint on the north side and notching the parking structure near MBC. While the parking structure is predominantly set back 10 feet from the property line, it increases to 30+ feet near MBC. The quantity of parking provided, 214 spaces, meets the City parking requirement of 211 parking spaces. 1(0.-2. Lf September 21, 2006 ASA-2006-16 Page 2 Staff did not agree with the design concept of placing the less massive garage ramp near MBC because of the frequency of vehicular noise, glare and exhaust that would impinge upon the MBC occupants. The internalized ramping system is a much better solution for MBC. The ramps are set even further back from MBC and are buffered by the intervening driveway aisles, parking and landscaping. The project architect also created a split level design to present a shorter structure (23'6") toward MBC and the taller structure (28'6") facing the new, approved office building. The landscaping design is not well-developed yet, so staff requests that DRC direct staff to work with the applicant during the building permit phase to improve the amount of landscaping. The proposed landscape margins are only five feet wide, which could accommodate tall plants like bamboo or Italian Cypress, which is needed to soften the appearance of the building. The grounds for reconsideration ate outlined below: 1. An offer of new relevant evidence which, in the exercise of reasonable diligence, could not have been produced at any earlier city hearing. After the proposed building was passed, it was brought up by Commissioners Kwok and Wang that Peter Pau should continue negotiations with the Mariani Business Center. Since Friday, August 17th, repeated attempts have been made to contact Peter and Sand Hill Property. Up to this day, they have failed to respond to our phone calls or send a representative to discuss the changes in the parking lot design. I believe this serves as new evidence showing that PeterPau has no interest in continuing negotiations with Mariani Business Center. We would like to come to an amenable solution with the new proposed design for the garage, however, with no contact from Peter, we are unable to create a solution. I would like the City to reconsider their approval of the building and add a condition that both parties must agree on the [mal design for the parking garage. 4. Proof of facts which demonstrate that the City Council failed to provide a fair ( ~ - 27 if, i' hearing. At the hearing, the Council determined the new project was not "unreasonably detrimental to the adjacent property owner." However, I felt that I was not adequately able to present my case in front of the City Council. First of all, our representative, Sful1 \Vu, was not able to present l:-tis entire conversation before the City Council dismissed him. There were many key points in his presentation that he was unable to present to the City Council. Secondly, when Mayor Lowenthal was making his determination, he stated that "it was nota parking issue", and therefore, the easement would not have to be obeyed. We were not given a chance to respond. Ifthis building were to be built according to plan, it would defmitely affect our parking rights by affecting how our patients would access the building and, ultimately, determining where they would park. I felt we were not given the opportunity for a full and fair hearing Our acupuncture clinic adds great value to the city through tax revenue and the medical care we provide to the community. I support the redevelopment of the building next door and I hope to continue negotiations with our new neighbor and the City Planning Department. However, we need the help of the City Council to balance the interests of both the new residents and the current residents to make sure the end result is beneficial to all parties. In granting the use permit application U-2006-06 (Chang Architecture, former Any Mountain building), the City Council finds: a. that the use was in accord with the Cupertino General Plan Land Use Map; and, b. that the use of the subject property will not be detrimental to the public health, safety, general welfare, or convenience. Municipal Code section 2.08.096 states: "A petition for reconsideration shall specify, in detail, each and every ground for reconsideration. Failure of a petition to specify any particular ground or grounds for consideration, precludes that particular omitted ground or grounds from being raised or litigated in a subsequent judicial proceeding. Applicant Peter Pau discussed the project highlighting the garage plan, the landscape plan, the parking agreement with the neighbor (Mariani property), and mitigating traffic concerns. Architect Cliff Chang reviewed the project and clarified the parking scheme. Jennifer Griffin said she liked the look of the building and is glad they want to keep the trees. She said she thinks the building is too big for the property, and that it would be preferable to have the parking garage completely under the building. She said she was concerned about the building taking excess of office in this area, and shared concerns about the possibility of housing coming in the future. Sam Wu, co-owner of the Mariani Business Center, said he is not against the development but against the proposed plans. He said the project looks overbuilt, making the two pieces of land inequitable regarding access. He shared concerns regarding the patient walkway posing a safety hazard, and traffic issues. He submitted a petition from local businesses against the proposed development. Judith Rentschler, representing the owners of the Mariani Business Center, said that she supports the Planning Commission's recommendation that the project not be voted on until the parking and easement issues are resolved between the two property owners. She commented that the building is too big for the lot and devalues the Mariani property behind. She noted that the conditional use permit must make a finding that the project isn't injurious to the adjacent property. Lydia Song said that the building and the parking garage are huge compared to the small office development. She noted that it would be more pleasing if the garage were to be completely underneath. Suggested flipping the parking garage so that the outside ramp would be on the side allowing the other property to still see through. Kwok/Sandoval moved and seconded to: 1) adopt a Mitigated Negative Declaration; 2) approve an additional finding that the project is not unreasonably detrimental to the adjacent property provided that conditions of approval are met; 3) approve a Use Permit and Architectural and Site Review with the following conditions and direction for the Design Review Committee: . Traffic mitigation is capped at $25,000 subject to the satisfaction of the director of public works; . In reviewing the Petition filed by Jane Wu to Reconsider the Council's decision to grant the applications as noted in detail above, the City Council finds that there is no relevant evidence or proof of facts that support any of the grounds for reconsideration as required by Cupertino Municipal Code Section 2.08.096 B. 1-5.
