Dear Joe,
Based on our meeting on 12/15/92, I looked into the possibility of offsetting to
toilet to achieve the additional 3 12" distance between it and the lay. There are only
two possibilities that we can determine, neither of which are desirable from our
perspective.
One is to jackhammer out a large section of the concrete and install the offset
below where the 4" waste line enters the area under the toilet. After reinstalling the
toilet, new floorcovering will have to be put down for the whole bathroom. In
addition to the expense, the noise of this activity would be most disturbing in an
occupied health care facility.
The second alternative is to build a concrete base under the toilet large
enough to install the offset above the floor level and then move the toilet with its
mounting flange and bolts over to the new location. The problem with this
arrangement is that the concrete base, because it will be larger than the base of the
• toilet, will be extremely unsightly and could possibly create a tripping hazard. The
unsightly condition would not be consistent with an upscale facility and will hamper
our ability to market the unit.
Would it be possible to include some statement with our final C of O that, in
the event a handicapped person occupies this unit in the future and the distance
between the toilet and the lav becomes a problem, Forum will make all necessary
modifications to satisfy the requirement. We both know that the likelihood of this
matter surfacing as a mayor issue is highly unlikely and I do not believe that it
represents a significant risk for anyone. In this manner, you have brought the issue to
our attention, we acknowledge the "error" of the installation and agree to modify the
configuration anytime in the future should it be warranted. I might add that based on
the 10;1 ratio for handicapped units we are only a fraction over the number of units
that would require only 3 handicapped bathrooms.
