SUBJECT: DESIGN REVIEW COMMITTEE ACTION LETTER - Application 02-R-00.
This letter confirms the decision of the Design Review Committee, given at the meeting of
June 28, 2000, approving residential design review for a 465 square foot second story addition to
an existing residence, according to Design Review Resolution No.8
Please be aware that if this permit is not used within one year, it shall expire on
June 28, 2001.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

RESOLUTION NO.8
OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO APPROVING A 520
SQ. FT. ADDITION, INCLUDING A 465 SQ. FT. SECOND STORY, RESULTING IN A 44%
FLOOR AREA RATIO ON A 6,003 SQ FT LOT.
SECTION I: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Design Review Committee has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the fonowing requirements:
1. The project will be consistent with the Cupertino Comprehensive General Plan, any applicable
specific plans, zoning ordinances and the purposes of this title, and exceeds the minimum visual
mass regulations of the R -1 ordinance.
2. The granting of the special permit will not result in a condition that is detrimental or injurious to
property or improvements in the vicinity, in that the second story win be only 465 square feet, is
sufficiently setback from all adjacent properties, and the height of the house will be less than many
new one story homes on file with the Building Department.
3. The proposed addition is harmonious in scale and design with the general neighborhood, in that the
overall architectural style of the residence is maintained and the addition is setback to the rear.
4. The proposed addition/home is generally consistent with design guidelines developed by the
Director of Community Development, in that the addition is considerably set back from the street
and complements the original architectural design.
5. The proposed additionlhome will not result in significant adverse visual impacts as viewed from
adjoining properties, in that the addition is sufficiently setback from adjacent properties, the
addition does not include any second story windows with floor to sill heights under five feet, and
the height of the house will be less than new one story homes on file with the Building Department.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the second story deck exception is hereby approved subject to the conditions which are
enumerated in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 02-R-00 set forth in the Minutes of
Resolution No.8

fully set forth herein.
