SECTION I: FINDINGS WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Design Review Committee has held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirements: 1. The project will be consistent with the Cupertino Comprehensive General Plan, any applicable specific plans, zoning ordinances and the purposes ofthis title. 2. The granting of the special permit will not result in a condition that is detrimental or injurious to property or improvements in the vicinity. 3. The proposed addition is harmonious in scale and design with the general neighborhood, in that the predominant hip roof pattern of the neighborhood is maintained, similar roof and eave lines are utilized, and the second story addition is sufficiently set back from the first story wall plane. 4. The proposed addition/home is generally consistent with design guidelines developed by the Director of Community Development. 5. The proposed addition/home will not result in significant adverse visual impacts as viewed from adjoining properties, in that the second story addition is sufficiently set back from the first story wall plane. 6. The deck design is such that it decreases privacy intrusion to adjoining properties to the greatest extent. Privacy screening is provided to screen vievvs from the deck into neighboring yards. NUW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the second story deck exception is hereby approved subject to the conditions w'hich are enumerated in this Resolution beginning on page 2 thereof; and That the subconclusions upon \vhich the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application 05-R-OO set forth in the Minutes of Resolution No. Page 2 OS-R-OO August 9, 2000 the Design Review Committee meeting of, August 9, 2000, and are incorporated by reference as though fully set forth herein. APPROVED PROJECT This approval is for a first and second story addition, causing the floor area ratio to be 45%, with a second story that is not more than 35% of the first floor area, including the garage. The design is conceptually based on the plan set entitled "Addition & Remodel of 7497 Bollinger Road" dated July 11, 2000, last updated on July 31, 2000, as amended by Exhibit B, south elevation and Exhibit C, east elevation. 2. NATURAL LIGHTING FOR RECESSED ENTRY The applicant shall submit details for a light-well that provides natural light to the recessed entry area, subject to staff approval. The provision of the light-well shall not change the appearance of the front elevation, as shown in the approved Exhibit B. 3. PRIVACY PROTECTION Privacy planting will be provided along the side and rear property lines in the form of trees and shrubs that are listed in Section 19.28 of the Cupertino Municipal Code.
