This letter confirms the decision of the Residential Design Review Committee, given at the
meeting of February 16, 2000, approving an exception to the second story wall height
requirement to remodel an existing single family residence that includes a new second story
addition, according to Residential Design Review Resolution No.6.
Please be aware that if this permit is not used within one year, it shall expire on
February 16,2001.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

RESOLUTION 6
OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING AN EXCEPTION TO SECTION 19.28.060 D5a OF THE Rl ORDINANCE.
SECTION I: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1. The literal enforcement of the provisions of this chapter will result in restrictions inconsistent with
the spirit and intent of this chapter, in that the addition is of minimal size and has been designed to
have a minimal visual impact from the street and the adjoining properties.
2. The granting of the exception will not result in a condition that is materially detrimental to the
public health, safety, and welfare, as all neighbors but one have signed a petition in support of the
addition, and the remaining neighbor will be adequately screened from the addition.
3. The exception to be granted is one that will require the least modification of the prescribed design
regulation and the minimum variance that will accomplish the purpose.
4. The proposed exception will not result in significant visual impact as viewed from abutting
properties, since the proposed second floor is smaller than that of nearby two-story homes, the
addition is setback from adjoining properties, the design is in keeping with the existing first story
and the neighborhood, and the addition is adequately screened by mature landscaping from the
properties to the rear. .
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for an exception to the Rl Ordinance to allow a 588 square foot second floor
addition is hereby approved subject to the conditions which are enumerated in this Resolution beginning
on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 2-RDRC-00 set forth in the Minutes
Resolution No.6

reference as though fully set forth herein.

1. APPROVED EXHIBITS
Approval is based on the plan set entitled "Room Addition to 7920 Festival Court" dated
November 26, 1999.
2. SECOND STORY HEIGHT
Approval is based on 8 foot floor to plate height on the second floor and proportional reduction in
size of the second story window element on the front elevation. Additionally, the entry element
and the roof element over the family room will be reduced in height by 1 foot to maintain the
proportionality of the design.
