SUBJECT: RESIDENTIAL DESIGN REVIEW COMMITTEE ACTION LETTER-
Application 3-RDRC-00.
This letter confirms the decision of the Residential Design Review Conunittee, given at the
meeting of March 15, 2000, approving an exception to the Rl Ordinance to allow a 70 square
foot addition to the second story of an existing residence that exceeds the 35% second floor ratio,
according to Residential Design Review Resolution No.7.
Please be aware that if this permit is not used within one year, it shall expire on
March 15,2001.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

RESOLUTION 7
OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING EXCEPTIONS TO THE Rl ORDINANCE FOR A FIRST FLOOR TO SECOND
FLOOR RATIO EXCEEDING 35% AND A VISIBLE SIX FOOT WALL HEIGHT FOR MORE
THAN 50% OF THE SECOND STORY WALL PERIMETER.
SECTION I: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1. The literal enforcement of the provisions of this chapter will result in restrictions inconsistent with
the spirit and intent of this chapter, in that the addition is of minimal size and has been designed to
have a minimal visual impact from the street and the adjoining properties.
2. The granting of the exceptions will not result in a condition that is materially detrimental to the
public health, safety, and welfare, as adjacent neighbors have signed petitions in support of the
addition and have waived privacy protection.
3. The exception to be granted is one that will require the least modification of the prescribed design
regulation and the minimum variance that will accomplish the purpose.
4. The proposed exception will not result in significant visual impact as viewed from abutting
properties, since the proposed second floor is smaller than that of nearby two-story homes, the
addition is setback from adjoining properties, the design is in keeping with the existing first story
and the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the exceptions to the Rl Ordinance are hereby approved subject to the conditions which are
enumerated in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 3-RDRC-00 Set forth in the Minutes
