SUBJECT: RESIDENTIAL DESIGN REVIEW COMMITTEE ACTION LETTER-
Application 4-RDRC-00.
This letter confirms the decision of the Residential Design Review Committee, given at the
meeting of April 5,2000, residential design approval for a new 2,700 square foot two-story
residence that exceeds a 35% floor area ratio and a second story deck exception to allow a front
and rear balcony, according to Residential Design Review Resolution No.9.
Please be aware that if this permit is not used within one year, it shall expire on
April 5,2001.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

RESOLUTION 9
OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING A NEW TWO STORY RESIDENCE THAT RESULTS IN A 45% FLOOR AREA
RATIO AND EXCEPTIONS FOR TWO SECOND STORY DECKS.
SECTION I: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1. The project will be consistent with the Cupertino Comprehensive General Plan, any applicable
specific plans, zoning ordinances and the purposes of this title.
2. The granting of the special permit will not result in a condition that is detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health, safety or
welfare.
3. The proposed addition/home is harmonious in scale and design with the general neighborhood, in
that the new residence is smaller than the adjacent home at 10650 Carver, and has been designed in
accordance with the R-1 Ordinance.
4. The proposed addition/home is generally consistent with design guidelines developed by the
Director of Community Development.
5. The proposed addition/home will not result in significant adverse visual impacts as viewed from
adjoining properties in that the proposed residence is similar in design with 10650 Carver, and the
applicant has provided signed written statements from neighbors indicating their support for the
project.
6. The deck design is such that it decreases privacy intrusion to adjoining properties to the greatest
extent. The applicant has provided sign written waivers of privacy protection from affected
property owners.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Residential Design Approval and Exceptions for two second story decks is
hereby approved subject to the conditions which are enumerated in this Resolution beginning on page 2
thereof; and

That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 4-RDRC-00 Set forth in the Minutes
of the Residential Design Review Committee meeting of, April 5, 2000, and are incorporated by
reference as though fully set forth herein.
