SUBJECT: RESIDENTIAL DESIGN REVIEW COMMITTEE ACTION LETTER-
Application 5-RDRC-OO.
This letter confirms the decision of the Residential Design Review Committee, given at the
meeting of March 15,2000, residential design approval for a two-story addition resulting in a
floor area ratio greater than 35% and exception to the Rl Ordinance to exceed the 35% second
story to first story ratio, according to Residential Design Review Resolution No.8.
Please be aware that if this permit is not used within one year, it shall expire on
March 15,2001.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled before the City
Council.

OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING A SECOND STORY ADDITION THAT RESULTS IN A 40% FLOOR AREA RATIO
AND APPROVING AN EXCEPTION TO SECTION 19.28.060 D5a OF THE Rl ORDINANCE.
SECTION I: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1. The project will be consistent with the Cupertino Comprehensive General Plan, any applicable
specific plans, zoning ordinances and the purposes of this title.
2. The granting of the special permit will not result in a condition that is detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health, safety or
welfare.
3. The proposed addition/home is harmonious in scale and design with the general neighborhood, in
that the addition is architecturally consistent with the existing residence, which is representative of
the architectural style of the surrounding neighborhood.
4. The proposed addition/home is generally consistent with design guidelines developed by the
Director of Community Development in that the addition will serve as a transition between the two
story neighborhood and the adjacent park, the addition will result in the elimination of a two story
vertical wall plane, and the addition consists of highly articulated forms and wall planes.
5. The proposed addition/home will not result in significant adverse visual impacts as viewed from
adjoining properties in that the addition softens the visual impact of the residence from the adjacent
public park.
6. The literal enforcement of the provisions of this chapter will result in restrictions inconsistent with
the spirit and intent of this chapter, in that the addition is of minimal size and has been designed to
have a minimal visual impact from the street and the adjoining properties.
7. The granting of the exception will not result in a condition that is materially detrimental to the
public health, safety, and welfare, as the addition has been designed to be sensitive to views from
adjacent properties.

8. The exception to be granted is one that will require the least modification of the prescribed design
regulation and the minimum variance that will accomplish the purpose, and the proposal decreases
the non-conformance with the Rl Ordinance.
9. The proposed exception will not result in significant visual impact as viewed from abutting
properties, since the proposed second floor is smaller than that of nearby two-story homes, the
addition is setback from adjoining properties, the design is in keeping with the existing residence
and the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Residential Design Review and an Exception to the Rl Ordinance to allow a
187 square foot second floor addition is hereby approved subject to the conditions which are enumerated
in this Resolution beginning on page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 5-RDRC-00 set forth in the Minutes
of the Residential Design Review Committee meeting of, March 15, 2000, and are incorporated by
reference as though fully set forth herein.
