This letter confirms the decision of the Residential Design Review Committee, given at the
meeting of August 4, 1999, approving an exception to exceed the maximum 45% tloor area ratio
by adding a 30 sq. [1. first-floor addition to an existing 3,970 sq. ft. residence, according to
Residential Design Revie\\t Resolution No.1.
Please be aware that if this permit is not used \vithin one year, it shall expire on
August 4, 2000.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be notified of a public hearing which will be scheduled befc)l'l:: the City
Council.

RESOLUTION NO. 1
OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO
APPROVING AN EXCEPTION TO EXCEED THE MAXIMUM 45% FLOOR AREA RATIO BY
ADDING A 30 SQ. FI. FIRST-FLOOR ADDITION TO AN EXISTING 3,970 SQ. FT. RESIDENCE,
IN ACCORDANCE WITH CHAPTER 19.28 OF THE CUPERTINO MUNICIPAL CODE
SECTION I: FINDINGS
WHEREAS, the Residential Design Review Committee of the City of Cupertino received an
application for a Prescriptive Design Regulations exception as described in Section II. of this
Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and

WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
"
1) The literal enforcement of the provisions of this chapter will result in restrictions inconsistent with
the spirit and intent of this chapter. The proposal fills in an existing niche in the rear of the first
story; there are no visual or environmental impacts. The circumstances of this case are unique
regarding f100r area ratio, in that square footage isn't being extended but is being filled in, and the
square footage involved is extremely small. .
2) The granting of the exception will not result in a condition that is materially detrimental to the
public health, safety, and welfare. There are no negative impacts from the proposal.
3) The exception to be granted is one that will require the least modification of the prescribed design
regulation and the minimum variance that will accomplish the purpose. Thirty square feet is a
small modification.
4) The proposed exception will not result in significant visual impact as viewed from abutting
properties. There are no visual impacts.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for a Prescriptive Design Regulations exception is hereby approved subject to the
conditions which are enumerated in this Resolution beginning on page 2 thereof; and
