Please be aware that if this permit is not used within one year, it shall expire on September 15,2000. Also note that an appeal of this decision can be made within 14 calendar days of the decision. RhY~ ~~tland Planning Intern Enclosure: Resolution No.2 g:planninglRDRC Committee/action letter3rdrc99 3-RDRC-99 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO.2 OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO APPROVING AN EXCEPTION TO ADD TO AN EXISTING SECOND STORY DECK FACING A RESIDENTIAL DISTRICT, IN ACCORDANCE WITH CHAPTER 19.80 OF THE CUPERTINO MUNICIP AL CODE SECTION I: FINDINGS WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirement: 1) The deck design is such that it decreases privacy intrusion to adjoining properties to the greatest extent. The additions of landscape screening will adequately screen views to the adjacent properties. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for an Second Story Deck exception is hereby approved subject to the conditions which are enumerated in this Resolution beginning on page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application 3-RDRC-99 Set forth in the Minutes of the Residential Design Review Committee meeting of, September 15, 1999, and are incorporated by reference as though fully set forth herein. Approval is based on Sheets L3, L4, and L6 dated March 5, 1999. Resolution No.2 Page 2 3-RDRC-99 September 15, 1999 2. LANDSCAPE SCREENING The applicant shall either submit a statement from the property owner at 10371 Riviera Road that waives the requirement for privacy protection to their property or the applicant shall submit landscape plans to add non-deciduous shrubs along the northern perimeter of the property in accordance with the requirements of the privacy protection measures contained in Chapter 19.28 of the Municipal Code. The statement or landscaping plans shall be submitted prior to the issuance of a building permit and are subject to approval by staff. 3. DECK DESIGN The applicant shall re-submit deck design plans to incorporate a two tiered deck that reduces the height of the landing to that of the existing landing. The deck addition redesign shall also use balustrade to match the balustrade of the existing deck. The elevations of the deck addition shall show all details required for structural supports as required by the UBC. The redesign of the deck addition is subject to staff approval prior to the issuance of a building permit.
