SUBJECT: RESIDENTIAL DESIGN REVIEW COMMITTEE ACTION LETTER-
Application 7-RDRC-99.
This letter confirms the decision of the Residential Design Review Committee, given at the
meeting of December 15, 1999, approving an exception to add 1,013 sq. ft., including a second
story, to an existing single family residence, according to Residential Design Review Resolution
No.5.
Please be aware that if this permit is not used within one year, it shall expire on
December 15, 2000.
Also note that an appeal of this decision can be made within 14 calendar days of the decision. If
this occurs, you will be noti.fied of a public hearing which will be scheduled before the City
Council.

OF THE RESIDENTIAL DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTfNO
APPROVING A TWO-STORY, 1,013 SQUARE FOOT EXPANSION OF A 2,413 SQUARE FOOT
SINGLE F AMIL Y RESIDENCE, RESULTING IN AN F,A.R. OF 44.5%.
SECTION 1: FINDINGS
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Residential Design Review Committee has held one or
more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) The project will be consistent with the Cupertino Comprehensive General Plan, any applicable
specific plans, zoning ordinances and the purposes of this title.
2) The granting of the special permit will not result in a condition that is detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health, safety or
welfare, because of the petition submitted in support of the application by the neighbors.
3) The proposed addition/home is harmonious in scale and design with the general neighborhood.
4) The proposed addition/home is generally consistent with design guidelines developed by the
Director of Community Development.
5) The proposed addition/home will not result in significant adverse visual impacts as viewed from
adjoining properties, because of setbacks to adjoining property buildings, the position of the
proposed second story, the petitions in support of the application by adjoining property owners and
because the design is in harmony and character with the existing first story and the neighborhood.
6) The proposed second story is smaller than the existing two-stories on lots 21, 24 and 25.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for a 1,013 square foot expansion to an existing 2,413 square foot single family
residence is hereby approved subject to the conditions which are enumerated in this Resolution
beginning on page 2 thereof; and
That the subconc1usions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 7-RDRC-99 set forth in the Minutes
Resolution No.5

1. APPROVED EXHIBITS
Approval is based on the plan set entitled "Alagaratnam Residence" dated November 12,1999.
2. LANDSCAPE SCREENING
The applicant shaH either submit a statement from the property owner at 10433 Noel Road that
waives the requirement for privacy protection to their property or the applicant shall submit
landscape plans to add non-deciduous shrubs along the northern perimeter of the property in
accordance with the requirements of the privacy protection measures contained in Chapter 19.28 of
the Municipal Code. The statement or landscaping plans shall be submitted prior to the issuance of
a building permit and are subject to approval by planning staff.
3. MAXIMUM BUILDING HEIGHT
The maximum height of the proposed structure shall be within one foot of the existing two-story
building on the adjacent lot (326-48-21), which shall be measured from its finished grade to the
ridge.
