Recitals WHEREAS, CITY and CONSULTANT desire to amend the AGREEMENT to modify the basic agreement, scope of services, and increase the total compensation; and WHEREAS, the CITY OF CUPERTINO desires to obtain professional consultant services for the Library and Community Hall Upgrade(hereinafter, PROJECT); and WHEREAS, City's rules and regulations authorize City to enter into agreements for professional temporary services; and WHEREAS, SMWM has the necessary professional expertise and skills to perform the professional services required, Now, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, stipulated and agreed, the parties agree as follows: 1. Date: Project: 10 November 2006 Cupertino Library and Community Hall Upgrade ASP No: 001 Project No: 20627.01 Re: Design Services for Automated Book Drop In accordance with Section 24 of the Agreement for Design, Project, and Construction Administration Services (the "Prime Agreement" Between the City of Cupertino (the "Owner") and SMWM, A California Corporation (the" Architect") for the Library and Community Hall Upgrade Project, dated 25 September 2006, the Architect is submitting this proposal for additional services, as requested by the Owner. We request your authorization of the additional services described below. We will proceed with the work upon receipt of your signed authorization. The Architect is considering this work an Additional Service because the services described below are outside of the scope of the Architect's basic services as described in Exhibit A of the Prime Agreement. DESCRIPTION OF ADDITIONAL SERVICES: The Architect will provide the following additional services related to the attachment of the County's automated book drop system to the interior and exterior walls of the library. 1. Review drawings of the book drop unit provided by vendor. . 2. Review as-built drawings of the site. 3. Visit the site once to observe the existing conditions. 4, Prepare construction documents (including drawings and outline finish specifications) for modifications to exterior wall and interior wall to receive tenant-furnished equipment Drawings for interior wall to also include a temporary millwork shelf for a receipt printer. 5. Provide one set of electronic documents and one hard copy set to the Owner's contractor for pricing. 6. Respond to requests for information and review required submittals during construction. 7. Visit the site once during cOnstruction to observe the progress of the work. ASSUMPTIONS: 1. Owner to provide cost estimating services. Page 1 SCHEDULED TIME FOR A/E PERFORMANCE: Start: As soon as authorized by Owner Completion: Documentation will be completed within one week of receipt of authorization to proceed, contingent upon Owner providing all information required by Architect and timely review and approval of all submittals. FEES FOR ADDITIONAL SERVICES: Compensation for the above additional services shall be computed on an Hourly (time and materials) Basis, based on the Rate Schedule attached hereto, with a not-to-exceed total, as follows: 1 . 2. Not-to-Exceed Fee = Reimbursable Expense Allowance = $6,500.00 $500.00 3. Total Not-to-Exceed Fee + Reimbursable Expense Allowance = 7000.00 METHOD OF COMPENSATION: As per the Prime Agreement ORIGINALS: This Additional Service Proposal shall be executed in two (2) originals, each of w.hich shall be deemed an original, but all of which together shall constitute one -and the same instrument.
